Both parcels are slated to be rezoned PO zoning district with C-2, General Commercial, uses. also to a From a practical standpoint, the site is -so small (6,720 sq. ft.) that future construction needed to be incorporated into an adj acent development. In this case, the new construction is to be incorporated into the existing commercial project to the east. Both parcels will share a common driveway and parking area and the design of the new structure is intended to match the existing structure as much as possible. The principal concern of staff relates to the design of the west elevation. This elevation will be the most visible to the public and yet is the back side of the building. The existing M-l, Light Industrial District requires 10 foot sideyard setbacks and a 20 foot rear yard setback. Staff has suggested to the applicants that the building be setback 5' from the property line and landscaping be installed to soften the appearance of the wall. The applicants maintain that the site is so small they need to maximize their building coverage. Through the PO Rezoning process, the applicants are proposing zero sideyard and rear yard setbacks. This allows approximately 1,860 square feet of building area that otherwise would not be permitted. The applicants have agreed to provide architectural treatment along the west elevation to create some visual interest. Staff believes the proposed project will result in a substantial improvement to the site and eliminate an eyesore on Dublin Boulevard. Final design details for landscaping, trash enclosures, architectural treatment and easements will be resolved between Staff and the applicants after the PO Rezoning and Site Development Review are approved. The Planning Commission heard this application at a public hearing on 4/15/85. At the meeting, Mr. Kent, an adjacent property owner, submitted a letter expressing concerns with respect to parking. (See Attachment 3). In response to this letter, the Planning Commission required that, as part of the Zoning Approval process, a parking and site plan analysis be conducted prior to each tenant moving into the building to ensure there was adequate parking. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ------------------------------------------------------------------ ADOPTING A NEGATIVE DECLARATION FOR PA 85-020, A REQUEST BY TOM HUENING FOR A PD REZONING AND SITE DEVELOPMENT REVIEW ON THE ABANDONED DSRSD PROPERTY ON THE NORTH SIDE OF DUBLIN BOULEVARD SOUTH OF SIERRA COURT WHEREAS, Tom Huening filed an application for a PO and Site Development Review to construct a 4,485 sq. ft. building on the abandoned DSRSD property on the north side of Dublin Boulevard, south of Sierra Court; and WHEREAS, the commercial site located immediately to the east is to be rezoned from a PO with M-l and C-2 uses to a PO with C-2 uses as part of this application; and WHEREAS, an Initial Study was completed which indicated that the proposed project will not have a significant effect on the environment; and WHEREAS, a Negative Declaration has been prepared for this application in accordance with CEQA; and WHEREAS, the Planning Commission held a public hearing on this application on 4/15/85 and recommended a Negative Declaration be adopted; and WHEREAS, the City Council held a public hearing on this application on 5/13/85; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, a Staff Report was submitted recommending the Negative Declaration is in compliance with CEQA NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council does hereby adopt a Negative Declaration for this / application. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ------------------------------------------------------------------ APPROVING AND PLANNED ESTABLISHING DEVELOPMENT TOM HUENING FINDINGS AND GENERAL PROVISIONS REZONING CONCERNING PA 85-020, COMMERCIAL DEVELOPMENT FOR A WHEREAS, Tom Huening filed an application for a PO RRezoning on two parcels (APN 941-205-4-2, 6,720 sq. ft. and APN 941-205-1-21, 1.5 acres) located on the north side of Dublin Boulevard south of Sierra Court; and WHEREAS, the existing commercial site located immediately to the east is to be rezoned from a PD with C-2 - M-l uses to a PO with C-2 uses as part of this application; and WHEREAS, a Negative Declaration has been prepared for this application; and WHEREAS, the Planning Commission did hold a public hearing on said applications on April 15, 1985 and recommended approval; and WHEREAS, the City Council did hold a public hearing on said applications on 5/13/85; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, a Staff Report was submitted recommending that the applications be conditionally approved; and WHEREAS, the City Council did hear and consider all said reports, recommendations, and testimony as herein set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council does hereby find that: 1) The PD is consistent with the policies of the Dublin General Plan 2) The PD will not have a sign~ficant effect on the environment 3) The PD is appropriate for the subject property in terms of being compatible to existing land uses in the area, will be visually attractive, and will not overburden public services. BE IT FURTHER RESOLVED that the Dublin City Council does hereby approve the PD subject to the following conditions: 1) Development on the site shall be consistent with materials labeled Exhibit "A" on file in the Dublin Planning Department titled Dublin Business Center II, Huening Investment Corporation by Burns/Nettle, sheets land 2, dated 4/1/85, and as amended by these provisions. 2) The conditions imposed on the SDR are incorporated by reference into the PD. 3) Any changes or modifications of these plans shall be processed according to Section 8-31.18 of the Zoning Ordinance. 4) Approval of this Planned Development is subject to review at the expiration of two (2) years from the effective date of the PO as is specified in Section 8-31.2(by/of the Zoning Ordinance. DP 83-20 EXHIBIT ~ 5) Both parcels are to be rezoned to a PD with C-2 uses and regulations, as specified in Section 8-49.1 and 8-49.2 of the Dublin zoning Ordinance as amended by this PD and Site Development Review. 6) These findings, conditions, and general provisions are hereby adopted as the regulations for the use, improvements and maintenance of property within this District. 7) The previous PD is hereby rescinded and replaced with this PD. S~-..;dï "niil be pr=¡::c~e::i c,.è c t'~.::sc~i'le C~-:k:rc~icn will be: re-::¡:.:~~d ilS"e-:;,: c~ / RESOLUTION NO. 85- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN ------------------------------------------------------------------ RECOMMENDING THAT A NEGATIVE DECLARATION BE ADOPTED FOR PA 85-020, A REQUEST BY TOM HUENING FOR A PD AND SITE DEVELOPMENT REVIEW ON THE ABANDONED DSRSD PROPERTY ON THE NORTH SIDE OF DUBLIN BOULEVARD SOUTH OF SIERRA COURT WHEREAS, Tom Huening filed an application for a PO and Site Development Review to construct a 4,485 sq. ft. building on the abandoned DSRSD property on the north side of Dublin Boulevard, south of Sierra Court; and WHEREAS, the commercial site located immediately to the east is to be rezoned from a PO with M-l and C-2 uses to a PD with C-2 uses as part of this application; and WHEREAS, an Initial Study was completed which indicated that the proposed project will not have a significant effect on the environment; and WHEREAS, a Negative Declaration has been prepared for this application in accordance with CEQA; and WHEREAS, a public hearing was held on this application; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, a Staff Report was submitted recommending the Negative Decla~ation is in compliance with CEQA NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby recommend that a Negative Declaration be adopted for this application.
