HomeMy WebLinkAboutReso 206-01 FMapTr7252DubRanARESOLUTION NO. 206 -01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING FINAL MAP FOR TRACT 7252 (AREA A, DUBLIN RANCH, TOLL BROTHERS) WHEREAS, the second of several final maps for Master Vesting Tentative Map 7135 (Area A of Dublin Ranch), in the incorporated territory of the City of Dublin, has been presented to the City Council for approval; and WHEREAS, the first final map for Tract 7135 was approved by the City Council on July 17, 2001, the Council finding that certain of the Conditions of Approval of Planning Commission Resolution No. 00- 36 had been met; and WHEREAS, the Conditions of Approval of Resolution No. 00-36 which were met prior to the approval of the first final map are listed in City Council Resolution No. 126-01, which was adopted on July 17, 2001; and WHEREAS, Final Tract Map 7252 is the second phase of Master Tentative Parcel Map 7135 (Area A of Dublin Ranch), which was approved by the City Council on July 17, 2001, in the incorporated territory of the City of Dublin, State of California, which Final Tract Map 7252 has been presented to this City Council for approval, all in accordance with provisions of the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and WHEREAS, the Developer, Toll CA II, LP, has executed and filed with the City of Dublin a contract to improve Tract 7252 in accordance with Master Vesting Tentative Map 7135, the Tract improvement plans and specifications attached thereto; and WHEREAS, this Final Map for Tract 7252 is the second phase of a phased development, and not all of the Conditions of Approval of Planning Commission Resolution No. 00-36, approving the Master Vesting Tentative Map for Tract 7135 Development have been met. Of such resolution, the following Conditions of Approval will have been complied with for this Final Map and the first phase of this phased development (see City Council Resolution No. 126-01): 14, 15, 16, 17, 18, 19, 20, 23, 24, 26, 27, 28, 32, 33, 40, 41, 44, 45, 47, 49, 50, 51, 52, 53, 54, 55, 57, 60, 63, 67, 72, 73, 74, 76, 79, 80, 81, 82, 86, 87, 88, 89, 90, 91, 92, 93, 96, 97, 100, 101, 102, 103, 104, 112, 125, 126 and 141; and WHEREAS, pursuant to Government Code section 664561.1, the Master Vesting Tentative Map for Dublin Ranch, Area A (Tract 7135), as approved by said Resolution No. 00-36, is not invalidated by the approval of this Final Map; and WHEREAS, the remaining Conditions of Approval of said Resolution No. 00-36 shall be complied with prior to approval of remaining Final Maps to create the remaining master parcels; and -1- WHEREAS, said agreement is secured by bonds in amounts totaling $2,961,735. Required improvements include: Fallon Road Extension and Signal Hill Drive improvements, of which $1,548,435 for said improvements is conditioned upon faithful performance of said contract, and $1,548,435 for said improvements for the benefit of laborers and materials upon the work and improvements, conditioned upon payment for labor performed or material furnished under the terms of said agreement; and WHEREAS, said agreement is secured by bonds in amounts totaling $2,961,735. Required improvements include: Fallon Road landscape improvements, of which $1,094,300 for said improvements is conditioned upon faithful performance of said contract, and $1,094,300 for said improvements for the benefit of laborers and materials upon the work and improvements, conditioned upon payment for labor performed or material furnished under the terms of said agreement; and WHEREAS, said agreement is secured by bonds in amounts totaling $2,961,735. Required improvements include: Traffic signals on Fallon Road at Turnberry Drive and Kingsmill Terrace and signal interconnect improvements, of which $319,000 for said improvements is conditioned upon faithful performance of said contract, and $319,000 for said improvements for the benefit of laborers and materials upon the work and improvements, conditioned upon payment for labor performed or material furnished under the terms of said agreement; THEREFORE, BE IT RESOLVED that the Final Map of Tract 7252 be and the same is hereby approved, and that rights to the area marked as the following Road: Fallon; the area marked as the following Drive: Signal Hill; and those strips of land marked as Public Service Easement (P.S.E.), Storm Drain Easement (S.D.E.) and Public Access Easement (P.A.E.), offered for dedication to public use in conformity with the terms of dedication be, and they are hereby accepted, subject to improvement, and that the Clerk of this City Council be and is hereby directed to transmit said Map to the County Recorder for filing. PASSED, APPROVED AND ADOPTED this 4th day of December, 2001.
