San Ramon Road Phase III Project

RECOMMENDATION:
~/~ Adopt Resolution approving Program Supplement No.4 to
~. the Local Agency - State Agreement for Federal Aid
Projects No. 04-5432 and authorizing Mayor to execute
the Agreement.
FINANCIAL STATEMENT: None
DESCRIPTION:
The Program Supplement is a project specific agreement which attaches
to the master City-State agreement. It binds the City, among other things, to
non-discrimination in contracting for Federally-funded projects and
maintenance of the completed work.
This is one of the documents that is required in order for the City to
use the allotted $500,000 in FAU funds for this project. The approval of this
document will not preclude Dublin from purchasing additional FAU funds from
other agencies.

APPROVING PROGRAM SUPPLEMENT NO. 4 TO LOCAL AGENCY - STATE AGREEMENT
NO. 04-5432 FOR FEDERAL AID PROJECTS
AND AUTHORIZING THE EXECUTION OF SAID AGREEMENT
WHEREAS, the City of Dublin has a Master Agreement (Agreement No.
04-5432 for the Federal Aid Program with the State¡ and
WHEREAS, the City of Dublin intends to undertake a street project
on San Ramon Road from Vomac Road to Alcosta Boulevard¡ and
WHEREAS, the State of California Department of Transportation has
prepared and submitted to the City of Dublin two copies of Program Supplement
No.4 to Local Agency - State Agreement No. 04-5432 for funding the above
project¡ and
WHEREAS, said project will qualify for Federal funds provided
that the City of Dublin has approved Program Supplement No. 4 to Local Agency
- State Agreement No. 04-5432¡ and
WHEREAS,
approve said Program
04-5432¡ and
it is in the best interest of the City of Dublin to
Supplement No. 4 to Local Agency - State Agreement No.
WHEREAS, said Program Supplement No.4 to Local Agency - State
Agreement No. 04-5432 is attached hereto and made a part hereof¡
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Dublin hereby approves this Resolution and authorizes the Mayor of the City
of Dublin to execute this agreement.

Attached are two copies of Program Supplement No. 04 to Local
Agency - State Agreement No. 04-5432 for funding of the
above-referenced Federal-aid Project on San Ramon Road from Vomac
to Alcosta Boulevard.
If the supplement is satisfactory, please have both copies signed
by the appropriate City officials, and enter the resolution number
and date of execution on the first page. Return both copies of the
Supplement together with a certified copy of the City Council's
Resolution approving the Program and authorizing its execution.
Following our execution of the Supplemental Agreement, we will
return a copy for your files.

This Program Supplement Is hereby incorporated into the Local Agency-State Agreement
for Federal-Aid which was entered Into between the LOCAL AGENCY and the STATE on
12-12-83 and is subject to all the terms and conditions thereof. This Program
Supplement is adopted in accordance with Paragraph 2 of Article II of the aforementioned
Master Agreement under authority of Resolution No. . approved by the
LOCAL AGENCY on (See COpy allached).
The Local Agency further stipulates that as a condition to payment of funds obligated to this project.

SPECIAL COVENANTS OR REMARKS
1. All maintenance, involving the physical condition and the
operation of the improvements, referred to in Article VI
MAINTENANCE of the aforementioned Master Agreement will be
performed by the Local Agency at regular intervals or as
required .for efficient operation of the completed improvements.
2. In executing this Program Supplemental Agreement the Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for
Federal-Aid Programs.
3. The Local Agency will advertise, award, and administer this
project and will obtain the State's concurrence prior to
either award or rejection of the contract.
4. The Local Agency agrees the payment of Federal iunds will be
limited to the Detail Estimate amounts approved by the
Federal Highway Administration in the Federal-Aid Project
Agreement (PR-2), or its modification (PR-2A), and accepts
any increases in Local Agency Funds as shown on the Finance
or Bid Letter or its modification as prepared by the Division
of Local Streets and Roads.
