HomeMy WebLinkAbout05-12-1986 Adopted CC MinREGULAR MEETING - May 12, 1986 A regular meeting of the City Council of the City of Dublin was held on Monday, May 12, 1986 in the meeting room of the Dublin Library. The meeting was called to order at 7:35 p.m. by ~Mayor Peter Snyder. ROLL CALL PRESENT: Councilmembers Hegarty, Jeffery, Moffatt, Vonheeder and Mayor Snyder. '~ PLEDGE OF ALLEGIANCE The Mayor led the Council, Staff and those present in the pledge of alleg- iance to the flag. PROCLAMATION TRAFFIC SAFETY WEEK Mayor Snyder read a proclamation declaring the week of May 18-24, 1986 as Traffic Safety Week. It was hoped that this observance will lead to greater safety on our streets and highways. ALAMEDA COUNTY HAZARDOUS MATERIALS PROGRAM In order to address hazardous materials within the City, Staff initially pursued the development of a hazardous materials ordinance. However, at approximately the same time, the Alameda County Health Care Services Agency implemented a comprehensive program. The level of expertise provided through a consolidated County Program has distinCt advantages to the City of Dublin. An outline of the County Program was given to the Council. The program addresses both hazardous waste and the use and handling of hazardous materials. An important component of the program is the provision of an Emergency Response Mobile Unit. This will be an important resource for the City of Dublin, as the unit will be staffed by trained personnel available for emergency response. The vehicle is outfitted to allow for an on-site analysis of materials. Following proper identification, the responders will be capable of recommending a course of action for local emergency personnel. Representatives from the Hazardous Materials Program made arrangements to have the mobile unit on display prior to the City Council meeting. Hazardous Material Program staff members were available to discuss the capabilities of the unit. Mr. Gerry Winn of the Alameda County Health Care Agency was in attendance and gave a brief overview of the program. CM-5-94 Regular Meeting May 12, 1986 Mr. Gerry Winn explained that this is the second year of a three year phase in program. Cm. Jeffery indicated she had sat through some past public hearings and discussion was held regarding double tanking. Cm. Jeffery questioned the penalties if a company conceals or does not report certain hazardous materials. Mr. Winn explained that non-conformance fines could be up to $25,000 per day. REPORT BY ZONE 7 ON URBAN WATER MANAGEMENT PLAN Robert Buddemeier, Chairman, Board of Directors, Zone 7 of Alameda County Flood Control & Water Conservation District requested time to make a presentation to the City Council regarding the District's Urban Water Management Plan. Mr. Buddemeier felt that one of the best ways to insure that there is adequate water supply is to generate a communication between everyone. The required usage will be running close to the supply by year 2000. They are relying on cities and major water users to give them the best information possible with regard to their future demand. It's .also very important to start looking at issues of water conservation. Mr. Buddemeier stated that they had used the ABAG 1985 population projection figures in their projections. They anticipate that there will be 215,000 people in their service area by year 2000-2005. Cm. Moffatt felt it would be a good idea to form a liaison committee to meet with Zone 7 on an ongoing basis. Mayor Snyder felt that the Arroyo Management Plan Program should be one of the first items discussed by a liaison committee. On motion of Cm. Jeffery, seconded by Cm. Hegarty, and by unanimous vote, the Council determined that Cm. Moffatt and Cm. Hegarty would be the formal liaison committee that would meet with Zone 7 on an ongoing basis and inform the Council of items of interest. DELAYED ENFORCEMENT OF TRUCK PARKING ORDINANCE Lyle Walters, a resident of Dublin addressed the Council and indicated he was very distressed over the Council's decision to not enforce the truck parking ordinance until October. He lives in the vicinity of Galindo & Valencia Streets and reported that a neighbor continually works on large trucks in his garage and driveway, blocks the sidewalk, and creates a safety hazard. CM-5-95 Regular Meeting May 12, 1986 Staff reported that it is currently illegal to park tractor/trailer rigs within residential areas. The new ordinance adds commercial areas to the already restricted residential areas. Another area that can be immediately addressed which would be illegal, is the operation of a repair business in a residential zone. Discussion was held with regard to residential versus commercial streets. Bellina Street is considered to be commercial. Police Chief Shores reported that he considered the south side of the street to be residential and his officers are currently citing trucks that park longer than 2 hours. Staff advised that typically an area is considered residential only if houses front the street, which is not the case on Bellina Street. Discussion was held regarding the possibility of painting red curbs to improve safety and visibility to motorists and pedestrians entering and leaving the shopping center. City Attorney Nave felt that it would be better to enforce both ordinances in October. Cm. Jeffery indicated that even though the truckers had convinced the Council to give them extra time before enforcement, it was made clear that if advantage was taken, the Council coUld reconsider. Mayor Snyder suggested that this item be agendized at the next meeting with a recommendation from the City Attorney. CONSENT CALENDAR On motion of Cm. Hegarty, seconded by Cm. Vonheeder, and by unanimous vote, the Council took the following actions: Approved City Treasurer's Investment Report for Period Ending April 30, 1986; Adopted RESOLUTION NO. 44 - 86 FOR THE ACCEPTANCE OF LANDSCAPING IMPROVEMENTS, STAGECOACH ROAD, TRACT 4719 Adopted RESOLUTION NO. 45 - 86 DIRECTING THE PREPARATION OF ANNUAL REPORT FOR LANDSCAPING & LIGHTING DISTRICT NO. 83-2 Adopted RESOLUTION NO. 46 - 86 DIRECTING THE PREPARATION OF ANNUAL REPORT FOR STREET LIGHTING MAINTENANCE ASSESSMENT DISTRICT CM-5-96 Regular Meeting May 12, 1986 Authorized payment of $3,921 to replace two Paratransit Vans and authorized a budget transfer of $3,921 from Contingent Reserve; Adopted RESOLUTION NO. 47 - 86 GRANTING'AN EASEMENT FOR AGGREGATE BASE FOUNDATION MATERIAL FOR A RETAINING WALL STATE OF CALIFORNIA (Hopyard Road/Dougherty Road/I-580 Interchange) Authorized a waiver of the formal bid procedure for base stations and purchase through Alameda County General Services Agency; authorized Staff to proceed with procurement of 3 hand-held radios in the current Fiscal Year; Approved Warrant Register in the amount of $366,796.07. Cm. Vonheeder requested that the April 28th minutes be removed from the consent calendar and a correction be made on page 90. The word "park sites" should be changed to "school sites". On motion of Cm. Vonheeder, seconded by Cm. Jeffery, and by unanimous vote, the Council approved the corrected Minutes of the Regular Meeting of April 28, 1986; MODEL SMOKING CONTROL ORDINANCE The City received a letter from the Alameda County Smoking Action Coalition requesting that the City Council set a public hearing date to consider the Alameda County Smoking Action Coalition's Model Smoking Control Ordinance. Shirley Anderson, a Dublin resident who is a member of the Alameda County Smoking Action Coalition was.present in the audience. Mayor Snyder questioned inconsistencies in the model ordinance with regard to Page 4, Section 1004.4 which includes retail tobacco stores in the prohibited areas, and then Page 6, Section 1006.4 indicates that smoking is not regulated in retail tobacco stores. Ms. Anderson indicated that these are the types of things that could be clarified at a public hearing. Staff questioned who would enforce such an ordinance. Ms. Anderson stated she believed that the Public Health Department works with those cities that have adopted the ordinance on the enforcement issues. On motion of Cm. Moffatt, seconded by Cm. Jeffery, and by majority vote, the Council agreed to agendize this item as a public hearing at the.May 27, 1986 City Council meeting. Cm. Vonheeder voted NO on this motion. CM-5-97 Regular Meeting May 12, 1986 REQUEST FROM TED FAIRFIELD REGARDING DUBLIN SAN RAMON SERVICES DISTRICT SEWER CAPACITY STUDY Mr. Ted Fairfield has submitted a letter asking the City to request that DSRSD reconsider the sewer capacity study entitled DSRSD Sewer System Master Plan Alamo Creek and East Dublin, Interim Final Report, November 1985. Mr. Fairfield made the request that two areas within the "natural drainage boundaries" be added to the Study which includes lands in Alameda County immediately east of the Dublin and DSRSD sphere of influence and lands in Contra Costa County that might be within a drainage service area. Mr. Fairfield also requested that the density or intensity of potential development in the area in Alameda County east of Tassajara Road be reviewed. Staff recommended that the Council request DSRSD to reconsider the sewer capacity study with the following provisions: 1) The request to study the lands in Alameda County immediately east of the Dublin sphere of influence should also be referred to Alameda County for comment. 2) The request to study the lands in Contra Costa County should be referred to San Ramon and Contra Costa County. 3) The request to review the density or intensity for the area east of Tassajara Road outside the Dublin sphere of influence should be referred to Alameda County. 4) The City Council to discuss the density and intensity of potential development within the Dublin.sphere of influence consistent with Dublin General Plan Policies and give staff direction. 5) Costs of the City and DSRSD for the reviews to be paid for by Mr. Fairfield. Mr. Fairfield indicated he is a Consulting Civil Engineer with offices located in Pleasanton and has been in the area for approximately 20 years. He agreed with Staff's recommendations with the exception of #5. He did not feel he should pick up the entire cost, but he would agree to pay Dublin's costs. He felt that if the costs were in the $10,000-$15,000 range he would be willing to pay. Mr. Fairfield stated he did not have a chance to comment when the study was done and suggested that fine tuning rather than redoing the entire report would be required. City Manager Ambrose asked for clearer direction with regard to what exactly what we want DSRSD to study. We need to address density options. City Attorney Nave indicated Staff would prepare some type of agreement for Mr. Fairfield with regard to the payment. Cm. Hegarty felt we should look at the highest possible density, as it is better to oversize the pipe than undersize it. CM-5-98 Regular Meeting May 12, 1986 Discussion was held with regard to developable acres as opposed to gross acres. ~ On motion of Cm. Hegarty, seconded by Cm. Vonheeder, and by unanimous vote, the Council directed Staff to request that DSRSD redo the numbers in their study based on a density factor of 4 units per gross acre. PUBLIC HEARING SIGN REGULATION ORDINANCE Mayor Snyder opened the public hearing. On April 28, 1986, the City Council introduced an amended ordinance regarding sign regulations. The ordinance establishes comprehensive sign regulations with the intent to provide effective and attractive identification. The ordinance is the result of over 3 years of work by the Sign Regulation Committee, Planning Commission and City Council, with notices sent to approximately 600 Dublin businesses, input from the Chamber of Commerce and various businesses, and more than 8 public hearings. Mayor Snyder closed the public hearing. Cm. Moffatt questioned if banners are allowed. Staff explained that banners would be considered a promotional sign, and are generally allowed, with proper permits, on a temporary basis. On motion of Cm. Hegarty, seconded by Cm. Jeffery, and by unanimous vote, the Council waived the reading and adopted ORDINANCE NO. 7 - 86 REPEALING CERTAIN PROVISIONS OF CHAPTER 2 OF TITLE 8 OF THE DUBLIN ZONING ORDINANCE REGARDING SIGN REGULATIONS AND ADOPTING ARTICLE 7 OF CHAPTER 2 OF TITLE 8 OF THE DUBLIN ZONING ORDINANCE WHICH SERVES TO REORGANIZE AND MODIFY THE CITY OF DUBLIN SIGN REGULATIONS PUBLIC HEARING PEPPERTREE ROAD TRAFFIC STUDY & PROPOSED IMPROVEMENTS Mayor Snyder opened the public hearing. As a result of a petition from 39 residents, TJKM performed a Traffic Study of the 8000 block of Peppertree Road. TJKM reviewed the accident history, traffic citations, conducted a radar speed survey, performed 24 hour approach counts and did field investigation. Based on their study, TJKM made recommendations of: CM-5-99 Regular Meeting May 12, 1986 Chris Kinzel, Traffic Engineer explained TJKM's recommendations of: 1) Installation of raised pavement markers in a double yellow pattern on Peppertree Road from West Vomac Road to the existing double yellow strip. 2) Stop signs on WeSt Vomac Road at Peppertree Road. 3) "Stop Ahead" signs and pavement markings on West Vomac Road and Peppertree Road. TJKM also suggested a continuing concentration of speed limit enforcement along Peppertree Road. George Zika, a resident of Peppertree Road, indicated he did not know when the study was done, as no one he knew had provided input. He did not understand how putting in 2 more cross street stop signs will slow down the race track. They continually call the Police Department and normally an officer is not there for more than 2 minutes before issuing a citation. Mr. Kinzel indicated that the people who initiated the petition were the ones contacted and TJKM tried to address the overall traffic problems, not just the speeding. Mr. Zika admitted that he had'not read the petition which he signed. He suggested that stop signs be put in at Shannon Avenue & Peppertree ROad. Cm. Jeffery indicated that the installation of stop signs in the past for the purpose of controlling speed had proven to be ineffective. She felt that the recommendations of the City's professional Traffic Engineer should be followed to see if they solve the traffic accidents and then check back in the future. Mayor Snyder closed the public hearing. Cm. Vonheeder felt that in responding to the petition, it should be noted that the only way to totally resolve the traffic problems· would be to prohibit driving on the streets. By taking the recommended measures, the City is simply trying to reduce and minimize some of the traffic problems in this area. On motion of Cm. Hegarty, seconded by Cm. Vonheeder, and by unanimous vote, the Council waived the reading and adopted on an urgency basis ORDINANCE NO. 8 - 86 ESTABLISHING TRAFFIC REGULATIONS (Stop Signs-West Vomac Road @ intersection of Peppertree Road) and approved the installation of raised double yellow traffic markers along the center of Peppertree Road between West Vomac Road and Shannon Avenue. CM-5-100 Regular Meeting May 12, 1986 AMADOR LAKES MINI-PARK Rafanelli & Nahas are proposing to contribute an additional $13,000 toward the construction of Amador Lakes Mini-Park instead of constructing a modified lake overlook and tot lot at the Amador Lakes project. Staff provided several options for Council consideration: 1) Approve the request for a total cash contribution (including the estimated $14,045 for the overlook and tot lot, instead of $13,000) toward the construction of Amador Lakes Mini-Park. 2) Amend the request to have a tot lot in Amador Lakes and a total cash contribution of $80,140 (including the estimated $5,140 for the overlook only). 3) Deny the request, keeping both the overlook and tot lot in Amador Lakes and maintaining a total cash contribution of $75,00 toward Amador Lakes Mini-Park. 4) Approve request for a total cash contribution of $88,000 toward the construction of Amador Lakes Mini-Park as requested by the developer. Cm. Moffatt questioned is there was any recommendation from the Park & Recreation Commission. City Manager Ambrose explained that this is primarily a planning issue and as such, did not go before the Park & Recreation Commission. On motion of Cm. Jeffery, seconded by Cm. Vonheeder, and by unanimous vote, the Council approved Option ~4. OTHER BUSINESS Park & Recreation Commission Appointment Cm. Vonheeder reported that her appointment to the Park & Recreation Commission, Eric Ovlen, is moving out of Dublin, and she is in the process of interviewing for a replacement on this Commission. Cm. Vonheeder requested that a Proclamation be prepared for Mr. Ovlen. Department of Aging - Commission Appointment Mayor Snyder indicated that the City needs to make an appointment to replace Alice Pitchford, who resigned her position on this Commission. He reported that Recreation Director Lowart has given him a list of people active in the area. CM-5-101 Regular Meeting May 12, 1986 New Bus System Cm. Jeffery reported that the new bus system is having a kick-off on June 29th to initiate the new system. Further information will be available soon. San Ramon Road Undergrounding of Utilities Project City Manager Ambrose reported that the undergrounding of utilities on San Ramon Road is almost complete, so residents should notice quite an improvement along this road. CLOSED SESSION At 9:35 p.m. the Council recessed to a closed executive session to discuss personnel matters and potential litigation.
