EXECUTIVE SUMMARY:
The City Council will consider approving the plans and specifications and awarding a construction
contract to Suarez & Munoz Construction, Inc. for the Forest Park Project. The project will
construct a two -acre park located along Central Parkway, Pino Grande Road, Twain Harte Road,
and Pandora Way. The City Council will also consider approving a budget change to increase the
project funding.
STAFF RECOMMENDATION:
Adopt the Resolution Approving the Plans and Specifications and Awarding a Contract to Suarez &
Munoz Construction, Inc. for the Forest Park Project, CIP No. PK0322, and approve the budget
change.
FINANCIAL IMPACT:
As approved in the 2024-2029 Capital Improvement Program (CIP), the total budget for the
project is $3,148,947. The base bid submitted by Suarez & Munoz Construction, Inc. is $2,197,000.
Staff recommends approval of the base bid and a 10% construction contingency in the amount of
$219,700 to facilitate change orders for unforeseen construction issues, bringing the total
potential construction contract amount to $2,416,700.
In addition to the construction contract, the project budget includes expenditures for utility
connection fees and soft costs, which includes Staff time, consultant costs, permit fees, and other
miscellaneous costs. In total, the estimated project cost is approximately $3,540,000, which will
require a budget increase of $390,000. Staff proposes a budget change to allocate $350,000 in
General Fund (Unassigned Cash Flow Reserve), and $40,000 from Measure BB Funds to cover the
shortfall. The proposed project funding and costs are as follows:

DESCRIPTION:
The 2024-2029 Capital Improvement Program (CIP) includes the Forest Park (formally known as
Jordan Ranch Neighborhood Square) Project, CIP No. PK0322 (Attachment 2), which will
construct a two -acre park along Central Parkway, Pino Grande Road, Twain Harte Road, and
Pandora Way. On December 6, 2022, the City Council approved the schematic design for the
project, which includes the following park amenities:
• One multi -use court that allows for basketball and futsal
• Picnic tables, shade elements, and BBQ
• Fitness stations
• Playgrounds for ages 2 to 5 years and 5 to 12 years
• Grass area for free play
• Interior pathways for circulation and exercise
Additionally, the project construction will upgrade the existing pedestrian curb ramps and
crosswalks along the park frontages of Central Parkway, Twain Harte Road, and Pino Grande Road
to meet current Americans with Disabilities Act (ADA) requirements. The ADA upgrades portion
of the project are funded through the Measure BB Sales Tax - Bike and Pedestrian Fund.
Bid Process and Results
The City of Dublin issued the bid package for the Forest Park Project on April 19, 2024. The bid
package consisted of three base bid items. Three sealed bids were received on May 23, 2024 with

the base bids ranging from $2,197,000 to $2,865,707. The lowest base bid was submitted by
Suarez & Munoz Construction, Inc. A summary of the bids is provided as Attachment 3.
Staff reviewed the bid results, checked references and necessary licenses, and recommends that
the City Council award the construction contract to Suarez & Munoz Co., Inc. as the lowest
responsive and responsible bidder.
To facilitate the approval of contract change orders and avoid construction delays, it is requested
that the City Manager or designee be authorized to approve change orders up to the contingency
amount of $219,700. The resolution will authorize this change as it relates to the project. Staff
expects work to begin in August 2024 and be completed late -spring 2025.
Community Workforce Agreement
On January 11, 2022, the City Council approved a Community Workforce Agreement (CWA) with
the Building and Construction Trades Council of Alameda County and its Affiliated Local Unions.
The CWA is applicable to public works projects valued at over $1,000,000, ensures that there are
no labor issues related to said projects, and bolsters local efforts to connect residents with careers
in the building and construction trades. The CWA includes a Local Hire Goal where 20% of all
hours on a project are worked by Local Residents, which are defined as individuals that reside
within Alameda County or within a 15-mile radius of City limits. The CWA also requires
contractors to hire one new apprentice for the first $1,000,000 of construction costs, and an
additional new apprentice for every $5,000,000 construction costs, based on the engineer's
estimate. Apprentices must work a minimum of 10% of the total craft's work hours, but the CWA
allows that apprentices may be deployed to another project to ensure the minimum number of
hours are met.
Staff worked with a consultant, Workforce Integrity and Training Solutions, to prepare bid
documents and solicit bids for the Forest Park Project that comply with the provisions of the CWA.
The provisions include the requirement that responsive bidders include an executed Agreement to
be Bound to and by the CWA, and that all subcontractors of the successful bidder also execute the
Agreement to be Bound within 14 days after Notice of Award.
California Environmental Quality Act (CEOA)
On May 8, 2012, the City Council adopted Resolution No. 91-12 Adopting a CEQA Addendum for
the Project Known as Jordan Ranch 2 Specific to Four Subareas and Adopting a Related Statement
of Overriding Considerations, which specifically addressed the construction of Forest Park. No
further action related to CEQA is necessary for the Project.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
APPROVING THE PLANS AND SPECIFICATIONS AND AWARDING A CONTRACT TO
SUAREZ AND MUNOZ CONSTRUCTION, INC. FOR THE FOREST PARK PROJECT, CIP
NO. PK0322
WHEREAS, on December 6, 2022 the City Council approved the schematic design for the
Forest Park Project (Project), formally known as Jordan Ranch Neighborhood Square, located
along Central Parkway, Pino Grande Road, Twain Harte Road, and Pandora Way; and
WHEREAS, the design team has completed the plans and specifications for the Project;
and
WHEREAS, the City of Dublin did, on May 23, 2024, publicly open, examine, and declare
all sealed bids for doing the work described in the approved plans and specifications for the
Project, which plans and specifications are hereby expressly referred to for a description of said
work and for all particulars relative to the proceedings under the request for bids; and
WHEREAS, said bids were submitted to Staff and Suarez and Munoz Construction, Inc.
was determined to be the lowest responsive and responsible bidder for doing said work.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby
approves the Plans and Specifications for the Project.
BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby award
the Contract for the Project to the lowest responsive and responsible bidder, Suarez and Munoz
Construction, Inc., at a bid of two million one -hundred and ninety-seven thousand dollars and zero
cents ($2,197,000.00), the particulars of which bids are on file in the Office of the Public Works
Director.
BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby
authorize the City Manager or designee to approve the Project contract change orders based on
the appropriated funds designated for the Project up to the contingency amount of two -hundred
nineteen thousand seven -hundred dollars and zero cents ($219,700.00).
BE IT FURTHER RESOLVED that the City Manager or designee is authorized to execute
the Construction Agreement for the Project with Suarez and Munoz Construction, Inc. and make
any necessary, non -substantive changes to carry out the intent of this Resolution.

PROJECT DESCRIPTION
This project provides for the planning, design, and construction of a 2.0-acre neighborhood square in the Jordan Ranch Development. The neighborhood square will
be designed in accordance with the Neighborhood Square Standards contained in the Parks and Recreation Master Plan.
PROJECT TIMELINE: The planning phase began in Fiscal Year 2021-22 and the conceptual plan was approved by the City Council in December 2022.
The project is currently in design and construction will start in 2024.
