HomeMy WebLinkAboutReso 203-01 Shea PM7589RESOLUTION NO. 203 - 01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING PARCEL MAP 7589 (SHEA HOMES LIMITED PARTNERSHIP, A CALIFORNIA LIMITED PARTNERSHIP) WHEREAS, the Final Map for Parcel Map 7589, in the incorporated territory of the City of Dublin, State of California, has been presented to this City Council for approval, all in accordance with the provisions of the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and WHEREAS, the subdivider, Shea Homes Limited Partnership, a California Limited Partnership, has dedicated to the public on Parcel Map 7589 a Public Services Easement (P.S.E.), an Emergency Vehicle Access Easement (E.V.A.E.), a Traffic Signal Easement (T.S.E.), and a Sidewalk Easement (S.W.E.), all in accordance with the Vesting Tentative Parcel Map approved by the City of Dublin Planning Commission via Resolution 00-34; and WHEREAS, Shea Homes Limited Partnership has executed and filed with the City of Dublin an Improvement Agreement to improve Tassajara Road, Glynnis Rose Drive, Central Parkway, Dublin Boulevard, and Required Site Improvements in accordance with the Conditions of Approval for the Vesting Tentative Parcel Map, and in accordance with the improvement plans and the specifications attached thereto; and WHEREAS, said Improvement Agreement is secured by bonds furnished by American Home Assurance Company in the amounts of $771,900.00 for off-site improvements (Bond No. 00255032), $1,892,100.00 for on-site improvements (Bond No. 00255009), and $330,000.00 for traffic signals (Bond No. 00283320) conditioned upon faithful performance of said Agreement; and WHEREAS, said Improvement Agreement is secured by bonds furnished by American Home Assurance Company in the amounts of $771,900.00 for off-site improvements (Bond No. 00255032), $1,892,100:00 for on-site improvements (Bond No. 00255009), and $330,000.00 for traffic signals (Bond No. 00283320) conditioned upon payment for labor performed or materials furnished under the terms of said Agreement; NOW, THEREFORE, BE IT RESOLVED that said Improvement Agreement and bonds are hereby approved, and the Mayor is hereby authorized by the City Council to execute the Improvement Agreement. BE IT FURTHER RESOLVED that the Final Map of Parcel Map 7589 is hereby approved, and the rights to easement areas marked as Public Services Easement (P.S.E.), Emergency Vehicle Access Easement (E.V.A.E.), Traffic Signal Easement (T.S.E.), and Sidewalk Easement (S.W.E.) as offered for dedication to the public in conformity with the terms of the dedication are hereby accepted, subject to improvement, and the Clerk of this City Council is hereby directed to transmit said Map to the County Recorder for filing. PASSED, APPROVED AND ADOPTED this 4th day of December, 2001.
