FINANCIAL STATEMENT Estimated cost for cross access easement on library property is $5,000 to $6,000. A budget transfer from the contingent reserve account would be needed. DESCRIPTION Background: On July 20, 1987, the Planning Commission approved the Conditional Use Permit and Site Development Review (PA 87-043/PA 87-044) for the expansion of the outdoor plant nursery use at the Target store, 7200 Amador Plaza Road. Condition #5 of the Resolution of Approval for the Conditional Use Permit requires establishment of a cross access easement between the library property and the Target store property (Property Owner: TDC, Transpacific Development Corporation). Condition #6 requires a cross access easement between the Target store property and the adjacent Rainbow Investment property and Albertsons property. The cross access easements are essential to improve circulation in the downtown and are essential to the function of the Dublin Place Shopping Center, the Dublin Plaza Shopping Center and the Dublin Library as one unified center. The cross access easements will eliminate the need for a vehicle to exit the Downtown Shopping Center Area onto public streets and re-enter at a different location when traveling between the library and various shops within the Core Downtown Shopping Area. To date all of the property owners affected by the required cross access easement have tentatively approved the easements with the exception of TDC (Transpacific Development Corporation, property owners of the Target site), who appealed the Planning Commission approval. The initial position of TDC was that they were willing to establish the cross access easement to the Library and Target was willing to make the improvements on the TDC property provided that the Library was willing to establish the easement on the Library property. Target was even willing to post a bond for the improvement work pending the Library's approval of the easement. The Library has determined an acceptable location for the easement on the east property line. Meanwhile, TDC has changed their position and has indicated they will roOt grant the easement between either the library site or The Rainbow Investment/Albertson's site because of a dispute between TDC and their tenant, Target. TDC maintains that they are willing to establish the easements if Target agrees that in the future TDC could add additional development on the TDC property. Target maintains that they will need to review any additional development so that their operations are not adversely impacted. No applications for additional development on the TDC property have been submitted to the City. Staff is working with TDC and Target toward resolving the dispute and establishment of the easements. If the easemen¿ is not established, none of the improvement work will take place. The location of the cross access easement between the Target store site and library site is proposed along the library's eastern property line (See Exhibit 2). Analysis: The Alameda County Librarian has indicated the Library will agree to the access easement on the library's eastern property line subject to the following conditions: 1. Removal of the "no turn on red" sign at Amador Valley Boulevard and Donohue Drive. 2. Placement of speed bumps within the library parking lot to slow traffic. The Uno turn on red" sign which the County is requesting be removed, is located on Amador Valley Boulevard at the Donohue Drive intersection. The sign was authorized by a Council adopted Ordinance in order to facilitate pedestrian crossings, even though, by law, a vehicle must yield to a pedestrian appropriately using the crosswalk. It prohibits vehicles on Amador Valley Boulevard from turning right on a red light into the Dublin Place Shopping Center. A similar sign prohibits right turns on a red light from Amador Valley Boulevard onto Donohue Drive. The County Librarian believes the Uno turn on red" sign would encourage vehicles to "short cut" through the library parking lot to obtain access to the Dublin Place Shopping Center without waiting at the Amador Valley Boulevard/Donohue Drive intersection traffic signa!. Staff does not believe the cross access easement will result in the use of the library parking lot as a "short cut". Use of the library parking lot as a short-cut will involve five to six turns to reach the main parking lot area for the Target store site, while direct access from the Amador Valley Boulevard/Donohue Drive signalized intersection would involve one to two turns to reach the main parking lot area. The increased turning movements and the difficulty in contending with vehicles backing up and pedestrian crossing within the library parking lot is likely to discourage its use as a short cut. If the City Council chooses to have the Uno turn on red" signs removed, Staff will prepare an ordinance for City Council consideration. If the City Council chooses to keep the signs as is, no further action is needed. The placement of speed bumps within the library parking lot will act to slow traffic within the parking lot as well as discourage through traffic. The cost and construction of the cross access easement improvements are to be shared by Target stores (or Transpacific Development Corporation) and the City. The estimated cost for design and construction of the cross access easement on the library site is between $5,000 and $6,000 (including removal and repair of fencing, landscaping, and irrigation, access drive, curbs, speed bumps and signing). No improvements will be made until after the easement is established. -2- Staff recommends the City Council: 1. Provide Staff direction concerning removal of the "no signs on Amador Valley Boulevard at the Donohue Drive and turn of red" intersection; ./ 2. I) .":(0 PUBUN PLANNINC Dear Larry: SU8JECT: ALTERNATE TARGET STORE/DU8LIN LIBRARY ACCESS EASEMENT This is in response to your letter of May 19, 1988, regarding an alternate location for a cross access easement between the Dublin Library and the Target Store, The County Library would agree to the proposed alternate location for access on the east side of the library parking lot. We remain concerned about the possible increase of traffic through the library parking lot that may result from the easement. Should this become a problem, we would expect the City to revoke the access. The following conditions should make the library parking lot less attractive as a "short-cut:" 1. We request the removal of the "No Right Turn On Red" sign at Amador Valley Boulevard and Donahue Drive. 2. We request that speed bumps be provided to slow down traffic through the library parking lot. It is our understanding that the grantin9 of this easement will not result in any costs to the County. It is also our understanding that there will be no further request for a cross access easement on the library's southern property line.
