HomeMy WebLinkAbout02-28-1983 Adopted CC MinutesREGULAR MEETING - FEBRUARY 28, 1983 A regular meeting of the City Council of the City of Dublin was held on Monday, February 28, 1983 in the meeting room, Dublin Library. The meeting was called to order at 7:35 p.m. by Mayor Peter Snyder. ROLL CALL PRESENT: Councilmembers Burton, Hegarty, Jeffery, Moffatt and Mayor Snyder. PLEDGE OF ALLEGIANCE The Mayor led the Council, Staff and those present in the pledge of allegiance to the flag. CONSENT CALENDAR On motion of Cm. Burton, seconded by Cm. Hegarty, and by unanimous vote, the following were approved: Minutes of adjourned regular meeting of February 8, 1983; Warrant Register in the amount of $24,086.29; Financial Report for Period Ending January 31, 1983; RESOLUTION NO. 7 - 83 FOR THE ACCEPTANCE OF IMPROVEMENTS TRACT 4668 Denial of claim of Ian E. ChiSholm RESOLUTION NO. 8 - 83 DESIGNATING THE SERVICE DELIVERY AREAS UNDER THE JOB TRAINING PARTNERSHIP ACT PROCLAMATION Mayor Snyder read proclamation declaring the week of March 6 - 13, 1983 as "Girl Scout Birthday Week". CALMET, INC., TRACT 5047 Request to temporarily suspend the appeal of Calmet, Inc., Tentative Map, Tract 5047. CM-2-25 Regular Meeting February 28, 1983 Cm. Burton explained that because he is a real estate agent, acting on behalf of the buyer, he felt it appropriate to withdraw and abstain from any participation in discussion re this matter. On July 12, 1982, the City Council considered an appeal of Tentative Map, Tract 5047, proposed by Calmet, Inc. The project involved 145 condominium units near the intersection of San Ramon Road and Dublin Boulevard, behind the Iceland skating facility. Appeals to the Tentative Map were filed by the developer and by area residents. The City Council continued the matter and directed Staff to try to resolve the issues. Staff has Deen concentrating on the traffic issue. Calmet, Inc., requested the City Council to temporarily suspend any action on the appeal for 150 days. The reason for the suspension was to allow consideration of a different application on the site. The developer indicated a desire to apply for a Planned Development for apartment units. Calmet further requested that the appeal of the Tentative Map be reinstated at no additional cost if 1) the City Council denies the new application, or 2) 150 days lapse, whichever comes first. Cm. Moffatt felt the apartments would much better serve a need in Dublin at the present time, as there are a limited number of apartments, and waiting lists exist for all. On motion of Cm. Moffatt, seconded by Cm. Jeffery, and by unanimous vote (Cm. Burton abstaining from vote), the Council granted Calmet's request. Cm. Hegarty questioned the density of the proposed project, in that there were concerns with traffic when the condominium project was to have been 145 units. Fred Howell, Attorney for the developer and partner involved, stated they would like to defer answering this and other questions until such time as they can get their submittals and go through the necessary processes. Mr. Howell stated it would be a higher density, and they are aware of the traffic situation, but they hope to satisfy that issue. STREET LIGHTING MAINTENANCE ASSESSMENT DISTRICT At the City Council meeting of February 14, 1983, the Council directed Staff to proceed with the necessary steps and documentation for the formation of a street lighting maintenance assessment district. A resolution is the first step; and appoints the law firm of Jones, Hall, Hill and White as legal counsel for the district and Lee Thompson, City Engineer as the assessment district engineer. The City Manager introduced Mr. Steve Casaleggio, representing the firm of Jones, Hall, Hill and White, who will be working with City Staff and City Council, guiding Dublin through the necessary process for formation of a maintenance assessment district. Cm. Burton asked that Staff determine who is responsible for the provision of street lighting services to the Arroyo Vista development. CM-2-26 Regular Meeting February 28, 1983 On motion of Cm. Burton, seconded by Cm. Moffatt, and by unanimous vote the Council approved the resolution and authorized the Mayor to sign resolution. RESOLUTION NO. 9-83 INITIATING PROCEEDINGS FOR THE FORMATION OF A MAINTENANCE ASSESSMENT DISTRICT PARKS & RECREATION ADVISORY COMMITTEE GUIDELINES At its meeting of February 14, 1983, the City Council directed Staff to develop a set of operating guidelines for a Parks & Recreation Advisory Committee which it agreed to establish. A copy of the draft guidelines was presented for City Council review and approval. Each member of the City Council will appoint two individuals to this Committee. Staff will send letter confirming this appointment. On motion of Cm. Moffatt, seconded by Cm. Burton, and by unanimous vote the Council approved the guidelines as written. 1982 PARKS & 'RECREATION OBJECTIVES IMPLEMENTATION PLAN S~aff presented to the City Council an implementation plan for the goals and objectives which were established by the Council at their meeting on December 14, 1982. The City Manager advised the Council that the City was contacted by the Valley Volunteer Bureau, and the City is participating in the Women's Re- entry Program. The Bureau set up a 3 month program and the City identified a work program with which the bureau is comfortable, as well as the individual who is attempting to get back into the job market. The individual who has come to work for the City on a 15 hour per week basis, has a degree in Planning & Geography, which is of great benefit to the City. Animal Control Services were discussed and Staff was directed to look at the possibility of contracting with the City of Pleasanton for leash law enforcement. Staff was further requested to review the role of the SPCA in the shelter services prior to contract review of animal control. Cm. Jeffery requested that Staff obtain agendas on an ongoing basis from the City of Danville, Zone 7, City of Livermore and San Ramon, if it incor- porates. Cm. Moffatt asked that the City Manager and City Attorney research and report back to the Council re information recently presented to him; namely, if you are already licensed by the State of California, do you still have to have a City Business License? CM-2-27 Regular Meeting February 28, 1983 Undergrounding of utilities were discussed. The City Manager indicated that the City Engineer and Lou Holveck of PG&E are going to be doing some site investigation work, and Staff will be coming back to the Council at a future time with some suggested areas to look at for undergrounding. The City Manager and City Attorney were asked to review the feasibility and legal precedent of obtaining funds from the County under Rule 20. DEVELOPMENT OF GENERAL PLAN PLANNING AREA City Staff and the Planning Commission have conducted a General Plan Consultant selection process. One of the issues identified that needs to be resolved before the process can proceed is with respect to development of a planning area boundary for the City. The City Manager and Planning Director recently met with Mr. Roland Mayne, Executive Director of the Alameda County Local Agency Formation Commission regarding the establishment of a sphere of influence for the City of Dublin. The City needs to undertake a fairly detailed study to demonstrate that all municipal type services could and would be provided to the area it proposed for its sphere of influence. The City must further designate the land use for the area in question before LAFCO acts on the question of sphere of influence. Staff recommends that the City Council hold a joint study session with the Planning Commission for the purpose of determining the City's planning area to be studied. Consensus of the Council was that the best date would be Tuesday, March 15, at 7:30 p.m. at the Dublin Library, if the meeting room is available on that date. The General Plan Consultant selection will be presented to the City Council at their regular meeting on March i4th, so the March 15th adjourned regular meeting will be for purposes of discussing and determining the one issue only. OTHER BUSINESS Traffic Signal Phasing Cm. Hegarty indicated he had recently timed the "WALK" signals in Dublin and reported that the solid walk light was on for a maximum of 8 seconds, and a flashing 'don't walk' appeared for approximately 18 seconds. The City Engineer explained that once the don't walk light starts flashing, a pedestrian should have ample time to continue across the street. The flashing light doesn't mean a pedestrian has to stop, it simply means a pedestrian should not start to cross a street. After discussion, Staff was asked to look into traffic signal phasing at the intersections of Amador Valley Boulevard/Donahue Drive, San Ramon Road/Amador Valley Boulevard, and San Ramon Road/Dublin Boulevard. CM-2-28 Regular Meeting February 28, 1983 Cm. Hegarty also reported that once a pedestrian crosses Amador Valley Boulevard at Donahue Drive (to enter the Gemco area), there is no sidewalk, and therefore, pedestrians have no choice but to walk in the street area. Staff was also directed to write a letter to the Dublin Place Merchant's Association to determine if the property owner has any interest in modifying the entrance to the shopping center from Amador Valley Boulevard. League of CA Cities Community Service Conference April 6-8, 1983, Fresno Cm. Burton questioned registration procedures for this conference. The City Manager advised that Staff would register those Councilmembers wishing to attend. City of Vista Resolution Re HCDA Cm. Burton questioned whether Dublin will support this request. The City Manager will question further and report back to Council. Dublin Police Services Burglary Statistics Cm. Burton questioned status of the letter from the resident on Amador Valley Boulevard who was cited for parking upon the curb. The City Manager indicated that the individual who had written the letter had parked halfway in the street and halfway on the sidewalk. This is illegal and the person was cited. There was no indiscriminate enforcement. Cm. Burton questioned several statistics related to the report supplied by the Dublin Police Services. Staff will have Lt. Shores review those items questioned and report back to the Council. ACTEB/ACAP Cm. Moffatt indicated that this group is trying to develop a program for providing homes to those street people who have no homes. They have discussed the possibility that perhaps some of the schools that are closing down could be utilized for this purpose. 1-580 Name Change Mayor Snyder discussed the request for support with regard to changing the name of Highway 580 to Arthur H Breed, Jr. Freeway. CM-2-29 Regular Meeting February 28, 1983 Consensus of the Council was to support this change. ADJOURNMENT There being no further business to come before the Council, at 9:30 p.m. the meeting was adjourned to an adjourned regular meeting on Tuesday, March 8, 1983 at 8:00 p.m. for joint study session with the Murray School District Board of Directors.
