Indicate what if any new recycling programs the Council would like added in the future. FINANCIAL STATEMENT: None DESCRIPTION: The City's Franchise Agreement with Livermore Dublin Disposal (LDD), a division of Waste Management of Alameda County (WMAC) extends 7 ½ years from December 31, 1995 to June 30, 2003. As the City approaches the end of the Agreement, it needs to evaluate options to provide future solid waste, recycling and other related services to Dublin residents and businesses. There are two options provided in the Agreement: Option to Extend the:Term - The City has the sole option to extend the term of the current Agreement three (3) times up to thirty-six (36) months (until June 30, 2006), in periods of at least twelve (12) months each. If the City chooses this option, it must give written notice specifying the number of months by which it elects to extend the term, not later than ninety (90) days prior to the termination date. Option to Negotiate with Third Parties - The City may explore all options for solid waste collection and disposal, recycling, green waste and related services after the expiration of the term. The City may solicit proposals from the current Franchisee 'and from third parties. It may then negotiate and execute agreements for these types of services that would take effect upon expiration of the current Franchise Agreement. The City has approximately 17 months before the current Franchise Agreement expires. If the City Council chooses Option 2, the City would need to hire a consultant to perform a program assessment and ratepayer survey, prepare, solicit and review the proposals, and negotiate a contract. Should the selected contractor be different than the existing contractor, a transition would need to be coordinated, which takes considerable time. It is estimated that this process could take up to 17 months. Staff estimates that the consultant fees are estimated to be in the range of $80,000 to $100,000. The costs for these services could be included in a proposed rate structure or offset by franchise fees the. City collects from the contractor. Conversely, should the City Council choose to extend the term of the existing Agreement, there would be no need to prepare, solicit .and review proposals or consider a possible transition to a new contractor at this time. In determining whether to extend the current Franchise Agreement or solicit proposals, the Council may wish to evaluate the services currently provided by Livermore Dublin Disposal. Factors to be considered could include rates, customer satisfaction, and programs and services. Dublin's current garbage rates are among the lowest in Alameda County. The attached chart (Attachment 1), compiled by the Alameda County Waste Management Authority, compares the rates and services of all jurisdictions in Alameda County. Attachment 2 indicates .customer cOmplaint calls received by LDD during calendar year 2001. The majority of calls were for missed pick-up commitments, which are often the result of containers not being placed at the curb on time. In addition to the calls received by LDD, City Staff receives approximately 1-2 calls per month regarding various concerns. Given the nature of the business and the number of collections every day, Staff believes that the level of complaints is reasonable. LDD makes approximately 90,000 residential pickups every month and with an average monthly complaint level of 31 calls, the complaint ratio is approximately 3.4 calls per 10,000 pickups. Additionally, LDD has been responsive in dealing with problems and complaints as they arise. The City's solid waste and recycling programs are comparable to most jurisdictions in the County. Livermore Dublin Disposal provides weekly residential curbside collection for both recycling and green waste, as well as three special clean-ups per year. Most Alameda County jurisdictions provide weekly curbside recycling collection, however only half provide weekly green waste collection. While LDD provides many programs and services to Dublin residents and businesses, there are other programs provided by County jurisdictions that are not offered in the City of Dublin. These programs include commercial and residential food waste recycling, curbside used oil recycling and special events such as tire, electronics and appliance collections. Any or all of these programs could be included in a future franchise agreement, should the City choose to solicit proposals. It should also be noted that according to the City's current Franchise Agreement, the. City may direct changes to the existing service including adding any or all of these potential programs. Section 2.8.1 of the Franchise Agreement reads as follows: City may direct Company to perform additional services (including new diversion programs, billing services, etc.) or modify the manner in which it performs existing services. Pilot programs and innovative services which may entail new Collection methods, different kinds of services and/or new requirements for Waste Generators are included among the kinds of changes which City may direct. Combany shall be entitled to an adjustment in its Company Compensation for providing such additional or modified services. Regardless of whether the City directs LDD to make program changes or requests that they be included in any future proposal, the City will pay for the service either through higher rates and/or by using available Measure D funds. However it should be noted that by seeking proposals, the cost associated with any new program could be lower due to competition. This is an appropriate time to indicate which new program(s), if any, the City would like to pursue. If the Council elects to extend the current Franchise Agreement, Staff would request that LDD submit a formal proposal to the City including program descriptions and applicable costs. Staff would return to the Council at a future date with the proposal and an analysis of the impact to Dublin residents and/or businesses. If the Council elects to solicit proposals for solid waste and recycling services, Staff would include any new programs in its request for proposals. RECOMMENDATION Staff recommends that the Council consider the options regarding the provision of solid waste, recycling and other related services to the City, and determine how it wishes to proceed. If the Council decides to extend the current Agreement, Staff recommends that the Council indicate the length of the extension (12- 36 months). Regardless of how the City chooses to proceed, Staff recommends that the Council indicate its interest in enhancing the current level of service through the addition of new programs.
