DESCRIPTION:
Mr. Michael D. Kunce of Armstrong Garden Centers representing John Nicandros is requesting a Specific
Plan Amendment Study fora 1.9-acre parcel located betweenAmador Valley Boulevard and Sleep EZ.
The site is located within Area three of the San Ramon Specific Area (see Attachment 4).
The proposal is to amend the permitted uses for Area 3 of the San Ramon Road Specific Plan to allow a
garden center use.
Nearby uses include Kindercare (just west of the Nichandros parcel); Kildara Homeowners Association to
the west and a retail use to North.

The Applicant proposes to build a new retail garden center that would include indoor and outdoor garden'
materials. The current plan indicates that the 6,400 sq.ft. garden center building set back on the parcel
providing a gazebo and heavily landscaped area along San Ramon Road.
Issues•
1. Should the comparison retail designation as presently designated for this site be maintained?
2. Is a garden center appropriate for this area?
Analysis
•
In 2000 the Council approval a Special Plan Amendment initiation request for an office building on three
adjacent properties at this location. Since that time,the office building developers withdrew their
application and a new restaurant opened on the site of one of the parcels,the old Dublin Fishery
(McNamara's Steak and Chop House). The possibility exists that another proposal may be brought
before the City in the future that would combine this parcel with the adjacent .43 parcel to the north(Sleep
EZ). Should this parcel develop on its own, it is unlikely that the parcel to the north(Sleep EZ)will be
significantly improved due to its small size. It should be noted that the designated fault line(and required
50-foot setback on either side)is a major barrier to development on these parcels. The proposed garden
center would likely be able to easily work the fault line issue into their site plan.
The City Council needs to determine whether a Specific Plan Study should be authorized. All other
entitlements, land use, site plan and scale of any project would be addressed by the Planning Commission
and City Council and will be decided in appropriate public hearings, if the City Council initiates the
Study. Both approved and denial resolutions have been included for your evaluation.
Recommendation
Staff recommends that the City Council receive the staff presentation and public testimony; question staff
and the public and adopt a Resolution either authorizing or denying the Specific Plan Amendment Study
request. - -

putting it on the City Council agenda for the next available date.

Garden Center use on my property, .
In the event the Amendment is granted, 1 do riot want it to prohibit the other allowed

APPROVING THE INTIATION OF A SPECIFIC PLAN AMENDMENT
STUDY FOR ARMSTRONG GARDEN CENTERS FOR PROPERTY LOCATED AT 7360
SAN RAMON ROAD
WHEREAS, a Specific Plan Amendment Study has been requested by Armstrong Garden Centers
and John Nichandros, for the 1.9 acre property located at 7360 San Ramon Road; and
WHEREAS, the property is in Area 3 of the San Ramon Road Specific'Plan, which does not
permit garden centers; and
WHEREAS, a Specific Plan Amendment to allow garden centers would be required to facilitate
this type of retail development; and
WHEREAS, additional entitlements including site development review and other associated
permits would need to be processed before development could occur; and
WHEREAS, the initiation request has been reviewed in accordance with the provisions of the
California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under
Section 15306, Class 6 of the State CEQA Guidelines; and
WHEREAS, the staff report submitted one recommendation that the City Council approve the
initiation of a Specific Plan Amendment Study for the proposal; and
WHEREAS, the City Council did hear and consider all such reports, recommendations, and
testimony hereinabove set forth and supports the initiation of a Specific Plan Amendment Study for
the 1.9 acre site.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Dublin does
hereby approve the initiation request for a Specific Plan Amendment Study for the site located at 7360
San Ramon Road.
