APPROVING MEMORANDUM OF UNDERSTANDING
FOR 1-580 INTELLIGENT TRANSPORTATION SYSTEM
MANAGEMENTffRAFFIC OPERATIONS SYSTEM (ITSffOS)
AND PROJECT CHARTER FOR "PHASE I" 1-580 HOV LANE PROJECT
WHEREAS, the 1-580 Smart Corridor system enables the Cities of Dublin, Livermore and
Pleasanton to monitor local traffic flows and manage traffic incidents in a coordinated manner in the Tri-
Valley area; and
WHEREAS, it is proposed to participate in a Memorandum of Understanding with Alameda
County, Caltrans, Livermore-Amador Valley. Transit Authority (LAVTA), Alameda County Congestion
Management Agency (CMA), the Metropolitan Transportation Commission (MTC), and the Cities of
Livermore and Pleasanton, in order to improve traffic operations along highly traveled corridors, including
1-580; and
WHEREAS, the City also desires to enter into a multi-jurisdictional agreement in the form of a
Project Charter for the "Phase I" 1-580 High Occupancy Vehicle (HOY) Lane Project in order to establish
an agreement regarding the design components of the "Phase I" 1-580 HOV Lane Project among the
CMA, Caltrans, Alameda County, LA VT A, and the Cities of Dublin, Livermore and Pleasanton; and
WHEREAS, the "Phase I" HOV Lane Project is consistent with the above referenced MOU to
work cooperatively toward improving the management and operations of the 1-580 corridor; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does
hereby approve the Memorandum of Understanding for 1-580 Intelligent Transportation System
Management/Traffic Operations System (ITS/TOS), and the Project Charter for "Phase I" 1-580 HOV
Lane Project.
BE IT FURTHER RESOLVED that the Public Works Director is authorized to execute the said
Memorandum of Understanding, hereto attached as Exhibit "A," and the Project Charter, hereto attached
as Exhibit "B."

1. PARTIES
This Memorandum ofDnderstanding (MOD) is entered into effective January 3, 2006 between the above
listed parties in recognition of the fact that the 1-580 Corridor, including major arterials in the Cities of
Dublin, Livermore, and Pleasanton (Cities), and Alameda County are important local and regional routes,
providing access to commercial and other activities in each of the jurisdictions it serves. Since the
corridor serves as local and regional routes, there is a need to provide efficient traffic operations across
jurisdictional boundaries, specifically during the construction ofthe 1-580 High Occupancy Vehicle
(HOV) widening project. Because of the importance ofthe 1-580 corridor to the local and regional
economies, each jurisdiction will retain the authority to control its own transportation systems, including
the operation of traffic signals and transit system.
2. PURPOSE
The purpose of this MOD is to acknowledge the agreement of all parties to this MOD to work
cooperatively toward improving the management and operation of the arterials and State Highway
freeway along the 1-580 corridor.
3. NATURE OF MOU
This MOD constitutes solely a guide to the respective intentions and policies of the parties involved. It iS,not
intended to authorize funding or project effort nor is it a legally binding contract. Funding commitments
providing for the deposit of funds for specific work phases or project effort committing machine or personnel
time will be covered by one or more separate cooperative agreements.
4. RESPONSIBILITIES
A. SMART Corridor Technical Advisory Committee (T AC): The T AC consists of staff members of
the agencies listed above. The TAC will be responsible for providing advice on the design,
implementation, and operation of the Intelligent Transportation and Traffic Operation Systems
along the 1-580 corridor and associated local roads. It will be the responsibility of each agency to
ensure that appropriate personnel attend the TAC meetings. The TAC will meet on an as-needed
basis to fulfill its responsibilities.

B. Cities. Alameda County. Caltrans. and LA VT A: The participating agencies that operate and
maintain traffic or transit systems have the following responsibilities:
I. Engineering review,
2. Operations and maintenance of traffic systems within the agency's own jurisdiction,
3. Reviews of traffic signal system, timing plans and participation in its development,
4. Construction management (when applicable),
5. Cooperate with all MOD participating agencies to develop traffic operations strategies to
move traffic efficiently in the corridor,
6. Implementing timing plans and reviewing changes when updates are implemented,
7. Sharing the use of interconnect cable and communications equipment (where available) with
nearby jurisdictions to provide cost-effective signal system communications,
8. Notify nearby jurisdictions when service interruptions occur that could affect system
operations.
9. Responding to emergency traffic conditions within each party's jurisdiction, or as agreed upon
by a joint response plan.
10. Operation of the transit system.
C. CMA: The CMA would provide coordination for the following activities:
I. County-wide planning,
2. Pursuing funding for future phases,
3. Pursuing funding for Operations and Management (O&M),
4. Grant management,
5. Partnership agreement development with participating agencies,
6. Developing necessary agreements,
7. Managing the delivery of capital project elements of the program,
8. Program administration and management,
9. Overall design, engineering, contract administration,
10. Coordinating the TAC meetings.
D. Roles of Others: MTC will assist with corridor programming and funding issues.
5. OTHER AGREEMENTS
Other transportation related agreements (maintenance or otherwise) are not modified or affected by this
MOD and will remain effective between the signatory agencies.
6. TERM
This MOD is in effect as ofJanuary 3,2006 and will terminate on December 31,2010, unless the term is
modified by parties to this MOD by way of an amendment.

Charter Purpose:
This Charter represents agreement on key elements of Project
Development (PS&E Phase) for the 1-580 HOV Lane Project, Phase
I (lA and IB) between the Alameda County Congestion
Management Agency (ACCMA), Caltrans, Alameda County Public
Works Agency, the cities of Livermore, Dublin, and Pleasanton and
the Livermore-Amador Valley Transit Authority (LAVTA). This is
a working document, and may be modified as appropriate, by written
agreement of all parties.
Background:
1-580 is the main east-west interregional freeway connecting 1-80
and US 101 in the Bay Area with 1-5 in the Central Valley. 1-580
serves as the only major transportation corridor providing a commute
route between San Francisco, Oakland, and San Jose (via 1-680) and
the Tri-Valley (Dublin, Pleasanton, and Livermore), and growing
Central Valley areas (Tracy, Stockton, and the 1-5 Corridor).
Additionally, 1-580 is a major route for the movement of goods and
freight into and out of the region, as well as significant recreational
travel throughout the year. 1-580 is classified as a "Lifeline Route",
facilitating movement between major staging areas and impacted
areas following major earthquakes and is the main access to the
Homeland Security Organization at Lawrence Livermore National
Laboratory.
The original four-lane divided highway from San Leandro eastward
opened in 1938 as part of US 50. In 1970, the widening of 1-580
from four lanes to eight lanes was completed between 1-680 and
Vasco Road. Caltrans, in a 1985 1-580 Route Concept Report,
identified the need to expand 1-580 between 1-680 and Greenville
Road from eight to ten lanes. Subsequently, in Caltrans' Draft 1-580
Transportation Corridor Concept Report (TCCR) for the year 2025,
Hbv lanes were planned for 1-580 between 1-238 and 1-205.
Additionally, 1-580 HOV lanes were recommended in the 1995 Tri-
Valley Transportation Council's Action Plan and MTC's "Blueprint
for the 21" Century" includes commitment for HOV lanes on 1-580.
The 1-580 HOV lanes are listed in the MTC 1997 HOV Master Plan
Update. In May 2000, the 1-580 HOV lane project was included in
the Transportation Congestion Relief Program (TCRP) and received
funding through AB 2928 (Torlakson) in July, 2000.
This HOV lane project is listed on the Governor's List of High
Priority Projects, and in the Countywide and Regional Transportation
Plans.

Background Continued
In 2000, ACTIA's Measure B was approved by Alameda County
voters, dedicating sales tax revenue to an auxiliary lane .project on 1-
580 between Tassajara Road and Airway Boulevard. In March,
2004, Regional Measure 2 (RM2) was approved by Bay Area voters,
dedicating new toll bridge revenue to specific projects, including the
1-580 HOY lane project. The 1-580 HOY lane project has also
received SAFETEA-LU funding.
A Project Study Report (Project Development Support) (PSR (PDS))
was prepared for eastbound and westbound HOV lanes on 1-580
from Vasco Road (KP 15.6/PM 9.6) to Tassajara Road (KP 28.9/PM
17.9) in Alameda County for a distance of approximately 13 Ian (8
miles), and was approved by Caltrans on June 29,2001. This project
is a variation from Alternative I (Minimum Project Alternative,
MP A) of the PSR (PDS) in which only the eastbound direction is
being proposed, and extends the westerly limit to Hacienda Drive
and the easterly limit to the Greenville Overhead.
In late January 2002, the State and the ACCMA executed a
Cooperative Agreement (District Agreement No. 4-1871-C)
authorizing the ACCMA to assist the State in the preliminary project
development design and environmental clearance of improvements
of eastbound and westbound HOV lanes on 1-580 from west of
Tassajara Road in Pleasanton to east of Vasco Road in Livermore in
order to bring about the earliest possible construction of the project.
The project, now under sponsorship of the ACCMA, will provide for
both eastBound and westbound HOV lanes along 1-580 from the
Greenville Overhead in Livermore to westerly of the Hacienda Drive
Interchange in Pleasanton. The project is proposed to be constructed
in several phases, with the first phase consisting of an eastbound
only HOV lane between the Greenville Overhead in Livermore and
the Hacienda Drive interchange in Pleasanton. This first phase
project is the subject of this Project Charter. Funding for this first
phase will be provided by Regional Measure 2 (RM-2), TCRP, STIP,
Measure B and SAFETEA-LU funds.
Environmental studies were initiated in January 2002 for
improvement of both eastbound and westbound HOV lanes on 1-580
between westerly of Tassajara Road/Santa Rita Road to easterly of
Vasco Road. During 2004, the ACCMA and Caltrans decided to
deliver the overall project in phases in order to provide needed
benefits to the public in the shortest time frame possible.
Environmental documentation for the Phase I improvements,
eastbound only, will be available for public review in late 2005 or
early 2006.

Background Continued
Final certification of the Phase I environmental document is
expected in August 2006. The ACCMA will be responsible for
performing an appropriate public hearing process for this proj ect.
Project Development for Phase I, including the preparation of Plans,
Specifications, and Estimates (PS&E), is proceeding "at-risk"
concurrent with the P A&ED preparation and approval. Project
advertisement is currently scheduled for Fall 2006, with construction
cost estimated at $55,000,000.
Programming
TCRP funding (Paragraph No. 31) provided $25 million for this
phase I project, and will be complemented with Regional Measure 2
(RM2) funds. Construction funding, including construction
management, has been committed through TCRP, RM2, STIP,
Federal Demonstration (SAFETEA-LU) and Measure B funds.
Project Purpose:
The purpose of this project is to reduce congestion by encouraging
mass transit and HOY usage, support regional air quality attainment
goals and improve safety for motorists, CHP and Caltrans
maintenance workers.
Construction of the proposed 1-580 HOY lanes will provide
significant relief to peak hour commuters who carpool and to mixed-
flow traffic during non-commute hours. Phase I of this project (the
subject of this Project Charter) will construct an eastbound-only
HOY lane between the Hacienda Drive interchange in Pleasanton to
easterly of the Greenville Overhead in Livermore.
Project Phase Objectives:
Cost - The ACCMA, Caltrans, the Alameda County Public Works
Agency, the cities of Dublin, Livermore, and Pleasanton, and
LA YT A agree that each agency will diligently endeavor to contain
costs associated with both the preparation of all the required project
plans and specifications, and the subsequent construction project.
Each agency commits to work in partnership to refrain from project
additives that will exceed the approved design and construction
budgets of $5 M and $55 M respectively. These budgets represent
the total dollar allocations for both Phase IA and Phase IE. The
distribution of these budgets between the two Phases is yet to be
determined.
Where feasible without undue detriment to project delivery,
additional corridor andlor local improvements may be added if
commensurate funding is provided by therequesting agency.

Schedule - All signatures to this Charter will work cooperatively to
ensure that Final Plans, Specifications, and Estimates (PS&E) for
Phase I A are approved by Caltrans pistrict 4 no later than May 30,
2006. Additionally, all signatures agree to work cooperatively to
ensure that Phase IB PS&E are approved by Caltrans District 4 no
later than June 30, 2006, and to certified by Caltrans OE as RTL no
later than March I, 2007 (depending on the administering agency
