A regular meeting of the City Council of the City of Dublin was held on
Monday, August 8, 1983 in the meeting room of the Dublin Library. The
meeting was called to order at 7:30 p.m. by Mayor Snyder
ROLL CALL
PRESENT: Councilmembers Burton, Hegarty, Jeffery, and Mayor Snyder.
Councilmember Moffatt was absent.
PLEDGE OF ALLEGIANCE
The Mayor led the Council, Staff and those present in the pledge of
allegiance to the flag.
CONSENT CALENDAR
On motion of Cm. Jeffery, seconded by Cm. Burton, and by unanimous vote, the
Council approved the Warrant Register in the amount of $168,477.94; Financial
Report for Period Ending June 30, 1983 (Pro-Forma); Agreed to discuss
assumption of the Dublin San Ramon Services District's aquatics program at a
future joint meeting; Agreed to refer letter from Murray School District re
disposal of Fallon School Site to Park & Recreation Advisory Committee for
consideration of desirability of this site for park and recreation use.
VEHICLE STORAGE IN FRONT YARD
Mr. Roland Grison, 7177 Rosita Court, addressed the Council related to a
letter he had received from the County of Alameda, Building Inspection
Department regarding a zoning investigation they were acting upon, based upon
a complaint of the storage of a vehicle he is restoring in his driveway. Mr.
Grison stated he was very confused regarding the rules, and was seeking
clarification. Mr. Grison did not feel he was in violation of any zoning
regulation.
Mr. Tong, explained that the zoning ordinance prohibits the storage of
inoperable vehicles or auto repair in the front yard.
Mr. Grison stated he is not repairing a vehicle, he is restoring a vehicle.
It is neat and clean, and he didn't feel he was creating any mess or hazard.
Cm. Burton questioned how Mr. Grison had received letter from the County.
Mr. Tong indicated that an official complaint was filed and the Zoning
Investigator was sent to the site to investigate the alledged violation. Mr.
Grison stated he must appear on the llth of August in Hayward.

Cm. Hegarty expressed concern that Mr. Grison would have to go to Hayward,
but also felt he would like to see our town cleaned up. He felt the
ordinance is basically a good one, but there are probably a long list of
items that the City could get very picky on as far as enforcing. Cm. Hegarty
indicated he was not troubled by a site inspection of this project, but what
he saw in many other parts of town did bother him. Cm. Hegarty felt that if
Mr. Grison could assure he would do his best to get the car restored as soon
as possible, the situation could be tolerated.
Mr. Tong suggested a possible solution would be to move the frame into his
garage. Mr. Grison indicated that at the present time, his wife is doing
furniture repair and upholstery work in the garage. She will be gone until
the end of the month, and Mr. Grison indicated he needed time to work this
situation out.
Mayor Snyder asked that action be delayed in order to review. Staff was
directed to discuss the particulars of the zoning ordinance and the consensus
of the Council was to continue action on this situation until September 12th.
Cm. Burton stated he was uncomfortable with the way zoning investigations
were being conducted. The City Manager explained that the alternative was to
hire a full time zoning.investigator, and strictly enforce the zoning
ordinance.
Mr. Jim Davis, 7178 Rosita Court stated he was annoyed that the County Zoning
Inspector has become involved in what appears to be a petty squabble among
neighbors. Mr. Davis questioned Mr. Tong's interpretation of the zoning
ordinance.
REQUEST FOR STOP SIGNS
VILLAGE PARKWAY @ WINEBERRY
Elizabeth Schmitt, 8358 Cypress Court, presented a petition signed by
neighbors requesting that stop signs be placed at the intersection of Village
Parkway and Wineberry. Because there are currently about 130 homes occupied
in this particular housing tract, with about 30-40 additional homes soon,
some means of traffic control is needed. Many children cross Village Parkway
in order to get to Murray School.
Staff was directed to investigate and report back at a future meeting.
INTRODUCTION OF BUILDING INSPECTION STAFF
Mr. Ambrose introduced the City's new Contract Building Official, Victor
Taugher and members of his Staff who will be assisting and working in the
City of Dublin.

Mr. Taugher introduced and gave brief background summaries on: Bob White,
full-time Building Inspector; Clark Keeney, part-time Building Inspector who
will be available as needed; Eugene Pester, Acting Building Official on an as
needed basis.
The Council welcomed Mr. Taugher and his Staff to the City of Dublin.
COUNTYWIDE PARAMEDIC PROGRAM
In November 1982, the voters of Alameda County approved a ballot measure
advising the Alameda County Board of Supervisors to establish a paramedic
service countywide by means of a countywide assessment district. The
assessment to property owners was not to exceed $10 per year. Voters in the
City of Dublin voted in favor of the County paramedic program by 78%.
Since the passage of the advisory measure, the County Health Services Agency
has worked in the development of a plan to be implemented Countywide.
Following discussion, on motion of Cm. Burton, seconded by Cm. Jeffery, and
by unanimous vote, (Cm. Moffatt absent) the Council adopted:

CONSENTING TO THE INCLUSION OF THE TERRITORY OF THE
CITY OF DUBLIN IN THE FORMATION OF THE COUNTY SERVICE AREA
OF PARAMEDIC EMERGENCY MEDICAL SERVICES
PARKING RESTRICTIONS ON SILVERGATE DRIVE
At its meeting of July 11, 1983, the City Council introduced an ordinance
establishing a no parking zone on the northerly curbline between Dublin Green
Drive and San Ramon Road, and westerly of Dublin Green Drive for a length of
100 feet. This proposed no parking zone will eliminate approximately six (6)
existing on-street parking spaces on Silvergate Drive. However, visibility
for motorists entering the intersection of Silvergate Drive and Dublin Green
Drive will be significantly improved.
On motion of Cm. Jeffery, seconded by Cm. Hegarty, and by unanimous vote (Cm.
Moffatt absent), the Council waived the reading and adopted:

1983-84 ANIMAL SHELTER & FIELD SERVICE AGREEMENTS
The City Manager presented the Staff report, giving history of those services
provided to the City of Dublin.
The total net cost will be approximately $26,300. Modifications with
relation to insurance indemnification was discussed.
Following discussion, on motion of Cm. Burton, seconded by Cm. Hegarty, and
by unanimous vote (Cm. Moffatt absent), the Council approved agreements with
modifications recommended by Staff and authorized a budget transfer from
Contingent Reserve to Animal 'Control Account in the amount of $941.
PUBLIC HEARING
WINNING ACTION INVESTMENTS APPEAL
On July 5, 1983, the Planning Commission reviewed an application for
Tentative Parcel Map 4008, submitted by Mr. Fred L. Houston of Winning Action
Investments, Inc. The developer proposed to subdivide a 4.7 acre parcel into
three parcels. The site is located on the east side of Dougherty Road,
approximately 800 feet north of Scarlett Court. The site currently contains
an office building, truck stop, and truck repair business. The developer has
indicated a desire to add a warehouse and cafe to the proposed parcels. The
Planning Commission approved (4-0) Tentative Parcel Map 4008, subject to
conditions. The developer and his consultant engineer, Mr. Ron Archer, have
appealed some of the conditions of approval.
The issues were 1) access: The developer wishes to provide access by a
private easement, rather than a public roadway. 2) drainage: The developer
wishes to modify condition which requires the developer to either obtain a
drainage release from the railroad, or develop an alternative, approved by
the City Engineer. The deVeloper wishes to simply request a drainage release
from the railroad. 3) street trees: The developer wishes to plant street
trees only along Dougherty Road, rather than also along the southerly street
frontages.
Mayor Snyder opened the public hearing.
Mr. Fred Houston, Appellant addressed the Council. He explained that the
subject property was 6117 Dougherty Road, approximately 440 yards from the
intersection of Dougherty Road and Dublin Valley. Just north is a triangle
shaped property, containing a lumber company. To the south is Borcher
Brothers and the Gelderman property, which has been for sale for 20 years,
ever since Dublin was developed. Across the street is the bowling alley.
Mr. Houston explained that they operate a maintenance truck stop, and it was
the first property to be developed in this area in 1969. The property has
been active as a truck depot ever since that time. He has owned the property
since 1979. They do not plan to change the use of their property; they have
a 10 year lease on the property. They wish to make the property better and

more active, and mostly for a better business venture. This property has a
lot of problems caused by railroads, by Counties, etc.
Mr. Houston explained his reasons for wanting a parcel split. They must
split the property to build on Parcel C and to obtain financing. They wish
to completely light and asphalt the property and they have a petroleum
company out of Concord that wishes to come in and put in a keycard type of 24
hour gas station.
Mr. Houston explained that this parcel of land is underwater 5 months of the
year. They have a serious drainage problem.
Mr. Houston felt that the conditions as set forth by the Planning Commission
were too restrictive and unrealistic. They leave them with no legal way to
move.
Mr. Houston explained that they have large semi trucks that enter the
property, make a loop and fuel up or back in and park. The nearest other
truck stops of this type are one on the other side of Vallejo and one in San
Jose, Oakland and one on Highway 5. They are requesting a private street in
order to avoid having to put in curbs and gutters and trees, as the big
semi's will knock over the trees and damage the curbs. They would propose to
put in the indented type of curb to get their drainage.
On motion of Cm. Burton, seconded by Cm. Jeffery, and by unanimous vote (Cm.
Moffatt absent), the Council adopted:

Various ways to alleviate the drainage problems were discussed.
On motion of Cm. Burton, seconded by Cm. Hegarty, and by unanimous vote (Cm.
Moffatt absent), the Council agreed that:
1) street will be public, with no curb, gutter, sidewalk, but with rolled
curb;
2) trees will be clustered; and
3) drainage to be worked out with City Engineer
RECESS
A short recess was called. The meeting reconvened at 9:55 p.m. with all
Councilmembers except Cm. Moffatt present.

DUBLIN BOULEVARD @ REGIONAL STREET
ORDINANCE ESTABLISHING PASSENGER LOADING ZONE
The Superintendent of Postal Operations, U. S. Post Office has requested that
a stretch of white curb be painted in front of Homestead Savings on the
northeast corner of Dublin Boulevard at Regional Street, in order to put a
mailbox at this site on the street, thus allowing people to drive up and
deposit mail into the mailbox.
On motion of Cm. Burton, seconded by Cm. Jeffery, and by unanimous vote (Cm.
Moffatt absent), the Council waived the reading and introduced the ordinance.
SPEED STUDIES
DAVONA DRIVE, SIERRA COURT & LANE, STARWARD DRIVE AND TRINITY COURT
Chris Kinzel presented the Staff report and explained that it was Staff's
position that certain modifications will reduce confusion for motorists in
areas studied and provide a more realistic speed limit where warranted.
On motion of Cm. Burton, seconded by Cin. Hegarty, and by unanimous vote (Cm.
Moffatt absent), the Council agreed to 1) waive reading and introduce
ordinance establishing speed limits on Sierra Court and Sierra Lane, and 2)
authorized installation of additional 25 mph sign for northbound traffic on
Starward at Gunshot, and 25 mph signs on Sierra Court, north of Trinity Court
and on Trinity Court.
With respect to the speeding in the vicinity of Davona Drive, it was Staff's
position that radar enforcement would be the only efective tool in reducing
speeding on that street. If the City is successful in its application to the
State Office of Traffic Safety for a citywide traffic study, Staff will be
able to address the utilization of a radar in a more comprehensive manner.
RIDGELANDS REGIONAL PARK PROPOSAL
Betty Dawson, Pleasanton, made presentation to the City Council with respect
to a petition requesting that the East Bay Regional Park District initiate a
Regional Ridgeland Park Feasibility Study in the area generally known as
Devaney Canyon, Tehan Falls-Main Ridge, Pleasanton Ridge, and Sunol Ridge.
The study should include local citizen participation, public hearings to
determine the size and nature of a po.ssible regional ridgeland park, and the
amount of a local bond issue needed to accomplish the recommended proposal.
The study could result in a local ballot measure requiring 2/3 voter approval
for land acquisition and special tax financing.
Ms. Dawson explained that the study should take approximately 6-12 weeks.
Cm. Jeffery questioned the bond issue being local only.

Cm. Burton asked who would pay for the study. It was explained that the
money was already in the park district coffers to pay for this study. If the
money isn't spent on the study, then it will be used for other park district
purposes.
Mayor Snyder clarified that they did not need the permission of the Council
to conduct this study, but this presentation was for information only.
OTHER BUSINESS
Slurry Seal
Cm. Jeffery stated that in several places, the slurry seal that was recently
done is unsatisfactory, namely on Amador Valley Boulevard. The City Manager
indicated that certain areas, Amador Valley Boulevard and Circle Way, will
have to be redone.
AB 1428
Mayor Snyder indicated he had received communications advising that it is
absolutely essential that elected offiCials from each City contact their
Legislators by August 15th and describe the impacts on their community
resulting from pending proposals. Mayor Snyder suggested adapting a recent
letter that was sent to Cortese.
Police Cars
The City Manager indicated that the new police cars are being painted and
equipped and should be on the streets soon.
RECESS TO EXECUTIVE SESSION
At 10:55 p.m., the Council recessed to closed session for discussion of
personnel related matters.
RECONVENE TO PUBLIC MEETING
At 11:18 p.m., the public meeting was reconvened and the Council adopted the
