HomeMy WebLinkAboutReso 18-06 Village Green SDR RESOLUTION NO. 18 - 06 A RESOLUTION OF THE CITY COUNClL OF THE CITY OF DUBLIN * * * * * * * * * * * * * * * APPROVING PA 03-058 VILLAGE GREEN SITE DEVELOPMENT REVIEW AMENDMENT TO DUBLIN TRANSIT CENTER SITE B-2 (AVALON BAY COMMUNITIES) SITE DEVELOPMENT REVIEW LOCATED SOUTH OF SITE B BETWEEN IRON HORSE PARKWAY AND DEMARCUS BOULEVARD (APN 986-0001-011-00) WHEREAS, the Applicant, Avalon Bay Communities, Inc., has requested an amendment to the approved Site Development Review for P A 03-058, Dublin Transit Center Site B-2, for the construction of a:l:l acre open space area, located on the southern portion of Dublin Transit Center Site B between Iron Horse Parkway and DeMarcus Boulevard, within the Eastern Dublin Specific Plan area; and WHEREAS, the Applicant has submitted a complete application for a Site Development Review Amendment for said project which is available and on file in the Planning Division; and WHEREAS, the Applicant has also submitted Project Plans dated received by the Planning Division on February 9,2006; and WHEREAS, on January 4, 2005 the City Council approved Resolution 02-05 approving Site Development Review for Dublin Transit Center Site B-2 (Avalon Bay Communities) and excluded the Village Green from the project approvals; and, WHEREAS, the City Council directed Staff to work with the Applicant to further define how the Village Green would be used and by whom; and WHEREAS, at the June 21, 2005 City Council meeting Staff presented three alternative designs for the Village Green for the Council to review; and WHEREAS, the Council chose alternative two and directed Staff to return to the City Council with a Site Development Review for review and approval; and WHEREAS, the process for amending an approved Site Development Review is the same as the process for approving a Site Development Review except that the decision-maker for a Site Development Review Amendment shall be the same decision-maker that ultimately approved the Site Development Review, in this case the City Council; and WHEREAS, the California Environmental Quality Act (CEQA), together with State guidelines and City environmental regulations require that certain projects be reviewed for environmental impacts and that environmental documents be prepared; and WHEREAS, Pursuant to the California Environmental Quality Act, Staff has recommended that the project be found exempt from CEQA pursuant to Government Code Section 65457 which exempts Reso #18-06, adopted 2/21/06 Page 1 of9 residential projects that are consistent with a specific plan from further environmental review. The Village Green is a portion of a residential project which was previously determined to be consistent with the Eastern Dublin Specific Plan. Additionally, the Project is within the scope of the Final Environmental Impact Report for the Dublin Transit Center General Plan Amendment, Eastern Dublin Specific Plan Amendment, Stage I Planned Development Zoning, Tentative Parcel Map, and Development Agreement (SCH 2001120395) which was certified by City Council Resolution No. 215-02 dated November 19, 2002. This recommendation is based on a determination that there are no supplemental impacts that would require preparation ofa Supplemental Environmental Impact Report.; and WHEREAS, a Staff Report was submitted to the City Council on February 21, 2006 recommending approval of said application; and, WHEREAS, the City Council did hold a public hearing on said application; and, WHEREAS, proper notice of said hearing was given in all respects as required by law; and, WHEREAS, the City Council deliberated on said application and made a motion to approve the Site Development Review Amendment request; and, WHEREAS, the City Council did hear and use their independent judgment and considered all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE City Council of the City of Dublin does hereby make the following findings and determinations regarding the proposed Site Development Review Amendment: A. The proposed project, as conditioned is consistent with the purpose and intent of Chapter 8.104 Site Development Review of the Dublin Zoning Ordinance in that: 1) as required by Section 8.104.020.A the proposed project will be compatible with the Dublin Transit Center master plan because the project has been designed to provide a pedestrian friendly, open space amenity adjacent to approved high- density, transit-oriented, residential developments within close proximity to the DublinIPleasanton BART Station; 2) as required by Section 8.104.020.B & C the proposed project addresses landscape design, vehicular and pedestrian access and on-site circulation, parking and traffic impacts in that the project complies with the Stage 1 Development Plan adopted for the Dublin Transit Center and the adopted Stage 2 Planned Development Zoning regulations, requirements, and performance standards for Dublin Transit Center Site B-2; and 3) as required by Section 8.104.020.D & E the proposed project will stabilize property values and promote the general welfare by providing an attractive and functional open space amenity available to residents and users of the Dublin Transit Center. B. The proposed Project, as conditioned, complies with the policies of the General Plan and the Eastern Dublin Specific Plan, the development regulations and performance standards adopted as part of the Stage 1 Development Plan for the Dublin Transit Center and Stage 2 Development Plan for Site B-2 and with all other requirements of the Zoning Ordinance because: 1) The proposed project complies with the policies of the General Plan in that the Eastern Extended Planning Area of which the Dublin Transit Center is a part encourages the development of a balanced mixed use community well integrated with urban systems and providing a safe, comfortable and attractive environment for living and working. The proposed project provides a multi-purpose open space area adjacent to a high- Reso #18-06, adopted 2/21/06 Page 2 of9 density, mixed-use (residential and commercial) development within close proxlImty to the Dublin/Pleasanton BART station; 2) the proposed project complies with the policies of the Eastern Dublin Specific Plan because the Plan states that the Transit Center area should have a mix of uses and should have a pedestrian friendly environment which the proposed project achieves by providing an open space amenity with pedestrian friendly pathways throughout, traffic calming roadways with parallel parking on either side all within close proximity to high-density, mixed-use developments which all users of the Dublin Transit Center may benefit from; and 3) the proposed project complies with the development regulations and performance standards adopted for the Dublin Transit Center project area because the proposed I acre open space area is compatible with the approved uses for the site and the overall design of the project is consistent with the design standards set forth in the Stage 1 Development Plan for the Dublin Transit Center. C. The proposed Proj ect, as conditioned, will not adversely affect the health or safety of persons residing or working in the vicinity, or be detrimental to the public health, safety and welfare because: 1) there will not be any significant environmental impacts associated with the project and the project has been conditioned to comply with all mitigation measures adopted as part of the Dublin Transit Center EIR; 2) the proposed project will result in an open space amenity with attractive landscaping, pedestrian pathways, future public art, shaded seating areas, and a children's play area and is compatible with existing and future development in the area as identified in the Dublin Transit Center master plan; 3) the site layout and design of the open space area is complimentary to the site layout and design of adjacent buildings in the neighborhood; and 4) as conditioned, the open space area will be operated in such a manner as to reduce impacts on the surrounding neighborhood. D. The site development for the proposed project has been designed to provide a desirable environment for the development with regard to its site layout, structures, vehicular access, circulation and parking, setbacks, height, walls, public safety, and similar elements because: 1) the Project has been designed at a pedestrian scale by providing 8-foot wide sidewalks throughout the Project area; 2) the Project includes a tree lined edge, shade trees throughout, seating platforms, low seat walls and benches, and trellises to provide shaded seating areas for users of the Village Green; 3) vehicular access to the Village Green has been designed as a one-way, circular private road with on-street, parallel parking on both sides of the street to further enhance the pedestrian experience by slowing vehicular traffic and providing a buffer between pedestrians and moving vehicles; 4) low shrubs around the perimeter of the Village Green create a defined edge while allowing for surveillance through the Village Green; and 5) pedestrian scale lighting along the pathways through the Village Green provide added security through illumination. E. The subject site is physically suitable for a 1 acre open space area with features such as trellises, future public art, a children's play area, low seat walls and seating platforms in that: 1) the Stage 1 Development Plan for the Dublin Transit Center identified the project area as open space; 2) the project area is centrally located among high density, mixed-use residential developments with ground floor retail providing residents, businesses and the general public the opportunity to engage in passive or active recreation and other outdoor activities such as farmers markets or art shows; and 3) the Project area is encumbered with underground utilities which precludes the development of buildings. F. There are no impacts to views because: 1) the project would be located on a site that is relatively flat and will be surrounded by 4-7 story residential and campus office buildings to the north, south, west and east, respectively. Reso # 18.Q6, adopted 2/21/06 Page 3 of9 G. There are no impacts to slopes or existing topographic features because: 1) the existing site is relatively flat. H. The character, scale and quality of the design is compatibility with the development's design concept or theme and the character of adjacent buildings and uses because: 1) the Village Green has been designed as an open grassy area which provides opportunities for peaceful gathering and passive recreational activities with easy and convenient pedestrian access to future high density residential and campus office buildings; 2) a large pedestrian plaza on the east end of the Village Green and a central pedestrian promenade in the center of the Village Green provide areas for formal or informal gatherings; and 3) a smaller pedestrian plaza with seating platforms and a children's play area on the west end of the Village Green provide more intimate gathering spaces geared towards the residents of the Dublin Transit Center. 1. Landscape considerations, including the location, type, size, color, texture and coverage of plant materials, provisions and similar elements will ensure visual relief and an attractive environment for the public because: 1) the Village Green will include a tree lined edge around the perimeter of the open space area as required by the Stage I Development Plan for the Dublin Transit Center; 2) a large pedestrian plaza with decorative paving, accent trees, seating opportunities, and a specimen tree as a central focal point will be provided at the east end of the open space area and will provide opportunities for outdoor seating and events; 3) a strong central promenade in the center of the Village Green will physically and visually connect the Village Green to the BART station entrance allowing easy, pedestrian friendly access to and from the BART station as required by the Stage I Development Plan for the Dublin Transit Center; 4) the strong central promenade will be enhanced with decorative paving, shade trees, low seat walls, and accent trees with opportunities for public art in the center of the promenade; 5) a smaller and more intimate plaza area and a children's play area will be provided on the west end of the Village Green and has been designed to provide a peaceful refuge for the residents of the Transit Center by being placed farther from the commercial and campus office uses; and 6) a combination of shade trees, trellises, accent trees, low shrubs and groundcover will provide an attractive environment for all users of the Transit Center. 1. The approval of the Site Development Review is consistent with the Dublin General Plan and Eastern Dublin Specific Plan as stated above in Finding B. BE IT FURTHER RESOLVED that the City Council does hereby approve the Village Green Site Development Review Amendment PA 03-058, Dublin Transit Center Site B-2 (Avalon Bay Communities) for the construction of a 1 acre open space area located south of Site B between Iron Horse Parkway and DeMarcus Boulevard, as generally depicted in the written statement and project plans prepared by GGLO, dated February 9,2006, labeled Exhibit A to Attachment 7 of the February 21,2006 City Council Agenda Statement, stamped approved, and on file with the Community Development Department, subject to the following conditions: CONDITIONS OF APPROVAL Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Division review and approval. RESPON. WHEN NO. CONDmON TEXT REQ'D SOURCE AGENCY Prior to: PLANNING DIVISION - GENERAL 1. Approval. This Site Development Review approval for PL On-going Planning the Village Green (hereafter referred to as the Village Green/Campbell Green) is an amendment to the Dublin Transit Center Site B-2 Site Development Review approval, PA 03-058, City Council Resolution 02-05. All conditions of approval contained in City Council Resolution 02-05 are hereby incorporated by reference. Where conflicts between these conditions and those contained in City Council Resolution 02-05 occur, these conditions shall prevail. This approval establishes the detailed design concepts and regulations for that portion of the Site B-2 project known as the Village Green/Campbell Green. Development pursuant to this Site Development Review approval shall conform to the "Project Plans" submitted by GGLO dated received February 9, 2006, on file in the Community Development Department, and other plans, text, and diagrams relating to this Site Development Review, unless modified by the Conditions of Approval contained herein. 2. Permit Expiration. Construction or use shall PL One year from DMC commence within one (1) year of permit approval or the permit 8.96.020. permit shall lapse and become null and void. approval D 3. Time Extension. Permit Validity. Controlling Activities. Mitigation Monitoring Program. The Applicant! In constructing improvements on BART property, the ApplicantlDeveloper shall schedule the work to be completed on the weekend in order to minimize potential temporary disruptions to existing BART parking. When Required: The Village Green/Campbell Green shall be under construction prior to Occupancy of Building 1 on Site B-1. The Village Green/Campbell Green shall be completed. as shown on Sheet L-2a, prior to Occupancy of Building 2 on Site B-1 and prior to Occunancv of the residential building on Site B-2. 24.
