HomeMy WebLinkAboutReso 22-06 Federal Surface Trans Program RESOLUTION NO. 22 - 06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * * * * * * * * * AUTHORIZING THE FILING OF AN APPLICATION FOR FEDERAL SURFACE TRANSPORTATION PROGRAM FUNDING FOR ANNUAL STREET OVERLAY PROGRAM, COMMITTING THE NECESSARY NON-FEDERAL MATCH FOR THE PROJECT, AND STATING THE ASSURANCE OF THE CITY OF DUBLIN TO COMPLETE THE PROJECT WHEREAS, the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) (public Law 109-59, August 10, 2005) continues the Surface Transportation Program (STP) (23 U.S.C. 9 133) and the Congestion Mitigation and Air Quality Improvement Program (CMAQ) (23 U.S.C. 9 149); and WHEREAS, the SAFETEA-LU legislation will guide STP, CMAQ, and TE programming until a SAFETEA-LU bill is authorized; and WHEREAS, pursuant to SAFETEA-LU, and the regulations promulgated thereunder, eligible project sponsors wishing to receive STP or CMAQ grants for a project shall submit an application first with the appropriate metropolitan transportation planning organization (MPO) for review and inclusion in the MPO's Transportation Improvement Program (TIP); and WHEREAS, the MTC is the MPO for the San Francisco Bay region; and WHEREAS, The City of Dublin is an eligible project sponsor for STP or CMAQ funds; and WHEREAS, The City of Dublin wishes to submit an application to the MTC for funds from the STP in fiscal years 2006-07, 2007-08, and 2008-09 for the following project: Annual Street Overlay Program - Remove and replace failed asphalt concrete (AC) pavement areas, overlay a minimum 1 y," of AC and/or re-stripe pavement striping and markings on Dublin Boulevard (between Sierra Court and Dublin Court) and Dougherty Road (Between Amador Valley Boulevard and Scarlett Drive) WHEREAS, the MTC requires, as part of the application, a resolution stating the following: 1) The project sponsor will commit necessary local matching funds of at least 11.47"10; and 2) The project sponsor understands that the STP and CMAQ funding is fixed at the programmed amount, and therefore any cost increase cannot be expected to be funded with STP or CMAQ funds; and 3) The project sponsor assures completion of the project as described in the application and, if approved, as programmed in the MTC's TIP; and 4) The project sponsor understands the funds must be obligated by June 30 of the year the project is programmed for in the TIP, or the project may be removed from the program; and 5) The project sponsor has a certified pavement management system (PMS); Reso #22-06, Adopted 317106, Item 4.4 Page 1 of2 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dublin that the Public Works Director is authorized to execute and file an application for funding under the Surface Transportation Program of SAFE TEA in the amount of $241,000 for the Annual Street Overlay Program. BE IT FURTHER RESOLVED that the City Council of the City of Dublin, by adopting this resolution, does hereby state that: 1) The City of Dublin will provide $27,643 (11.47%) in non-federal matching funds; and 2) The City of Dublin understands that: a) the STP and CMAQ funding forthe project is fixed at $241,000. b) any cost increases must be funded by the City of Dublin from local matching funds. c) the City of Dublin does not expect any cost increases to be funded with STP or CMAQ funds. 3) The City of Dublin's Annual Street Overlay Program will be built as described in this resolution and, if approved, for the amount shown in the MTC' s TIP with obligation occurring within the timeframe established below. 4) Program funds are expected to be obligated by June 30 ofthe year the project is programmed for in the TIP. BE IT FURTHER RESOLVED that the City of Dublin provides the following assurances: 1) The City of Dublin is an eligible sponsor of projects in the STP. 2) The City of Dublin is authorized to submit an application for STP funds for the Annual Street Overlay Program. 3) There is no legal impediment to the City of Dublin making applications for Local Streets and Roads Shortfall Program funds. 4) There is no pending or threatened litigation which might in any way adversely affect the proposed project, or the ability of the City of Dublin to deliver such project BE IT FURTHER RESOLVED that a copy of this resolution will be transmitted to the MTC in conjunction with the filing of the application, and the MTC is requested to support the application for the project described in the resolution and to program the project, if approved, in MTC's TIP.
