RECOMMENDATION~
FINANCIAL STATEMENT:
Adopt Resolution Accepting Final Map
Tract No. 5072 and Resolution Accepting
Deposit In-Lieu of Parkland
None at this time. Staff's time is
being paid by developer for processing
and inspection. After acceptance of
improvements and annexation, City will
assume maintenance responsibility of
Owls Court, Homestead Court and Rolling
Hills Drive.
DESCRIPTION: Tract 5072 divides a portion of the
property known previouSly as the Nielsen Ranch (Tentative Map
4859) into 26 single family lots.
Since this tract lies in both the City of Dublin and the
unincorporated area of Alameda County, both agencies are
approving the Final Map.
Improvement plans and the Final Map for Tract 5072 have been
reviewed by both the City and Alameda County and found to be in
conformance with the Tentative Map and conditions approved by
Alameda County and the City of Dublin.
Subdivision agreements and bonds have been submitted to the
County. The City has performed most of the processing and is to
collect the fees.
The developer has inidicated his desire to annex to the City of
Dublin after the Final Map is recorded.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

ACCEPTANCE OF FINAL MAP TRACT NO. 5072
WHEREAS, the Final Map of Tract No. 5072 in the
incorporated territory of the City of Dublin and the
unincorporated territory of Alameda County, State of California
has been presented to this City Council for approval, all in
accordance with the provisions of the Subdivision Map Act of the
State of California and the Ordinance Code of the County of
Alameda, as adopted by the City of Dublin; and
WHEREAS, the Developer, Hatfield DevelopmentjInvestec
has executed and filed with the County of Alameda a contract to
improve Tract No. 5072 in accordance with the Final Map of said
Tract No. 5072, the Tract Improvement Plans and the specifications
attached thereto; and
WHEREAS, said contract is secured by bonds in the
amount of $437,000 which, by their terms, are made to inure to the
County of Alameda conditioned upon the performance of said
contract; and
WHEREAS, said contract is secured by bonds in the
amount of $218,500 which, by their terms, are made to inure to the
benefi t of laborers and materialmen upon such work and
improvements, conditioned upon the payment of such laborers and
materialmen for labor performed or material furnished under the
terms of said contract.
NOW, THEREFORE, BE IT RESOLVED that said contract and
bonds be and they are hereby approved; and
BE IT FURTHER RESOLVED that the Final Map of Tract No.
5072 be and the same is hereby approved; and that Homestead Court
within the city limits of Dublin as shown on said map, be and is
hereby accepted on behalf of the public as a public highway
subject to improvement in conformity with the terms of the Offer
of Dedication and that those easements designated as "Storm Drain
Easement", or "S.D.E.", IISanitary Sewer Easement", or IIS.S.E.",
"Water Line Easement", or "W.L.E.", and "Public Utility Easement",
or "P.U.E.", as offered for dedication to public use in conformity
with the terms of dedication, be and they are hereby rejected; and
that the Clerk of this City Council be and is hereby directed to
transmit said map to Alameda County Board of Supervisors for their
approval.
PASSED, APPROVED AND ADOPTED this 28th day of October,
1985.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPT DEPOSIT IN LIEU PARKLAND - TRACT 5072
WHEREAS, pursuant to Section 8-7.1 of the Subdivision
Ordinance of Alameda County, as adopted by the City of Dublin, and
Dublin City Council Resolution #74-83 each residential use shall,
as a condition to the approval of a Final Subdivision Map,
dedicate or reserve lands, pay fees in lieu thereof, or a
combination of both, for park and/or recreational purposes; and
WHEREAS, in its action on the Tentative Map of the
subject tract, the Planning Commission of the City of Dublin did
determine in accordance with Section 8-7.1 of the aforesaid
Subdivision Ordinance that a fee in lie~ of land dedication for
park and recreational facilities is to be paid, and said fee to be
used for the development of park and recreational facilities
within a period of five years from the date of adoption of this
resolution to serve the residents of the subject tract; and
WHEREAS, the Developer has placed in
delivered to the City upon Final Map Recordation
amount as prescribed in accordance with Section
aforesaid Subdivison Ordinance #74-83; furnished
developer and identified as follows:

Subdivision Ordinance and Dublin Resolution of #74-83; and
PASSED, APPROVED AND ADOPTED this 28th day of October,
1985.
