PROJECT DESCRIPTION:
The Applicants, David Sanchez and Reinie Tagliapietra, are requesting approval of a Conditional Use Permit, Site
Development Review, and a setback Variance to legalize the operation of a towing service/vehicle impound yard
and for the installation of associated signage at 5787 Scarlett Court. The towing service/vehicle impound yard is
operating on the same property occupied by B&S Hacienda Auto Body and Repair Shop.
The property is located in the M-I, Light Industrial Zone. Surrounding uses include 84 Lumber to the east, Dublin
Auto Mall and Dublin Security Storage to the west, and BART to the north.
ANALYSIS:
A Conditional Use Permit is required in order to operate a vehicle towing service/impound yard in the M-I Zoning
District. The Conditional Use Permit process allows the City to place conditions of approval on the project to
ensure that the operation of the proposed use is compatible with the surrounding uses. The project has been
reviewed for issues related to operating characteristics, parking, and project design. Conditions of approval have
been proposed where appropriate to ensure compatibility.
The property at 5787 Scarlett Court is a triangular shaped flag lot, measuring approximately 79,474 square feet
(0101.82 acres). In 1992, a Site Development Review and Conditional Use Permit (PA 92-016, 92-017) were

approved for an auto body repair shop and vehicle storage lot. The site has been used continuously for auto repair
since the 1992 approval.
The vehicle towing service/impound yard is located on the east side of the auto repair shop in the area that was
previously used for vehicle storage. The facility includes a 322 square foot-modular building which serves as the
office and dispatch. The modular office is currently located 5 feet from the property line.
Operating Characteristics:
Tag's Towing is a vehicle towing service and impound yard that provides service for local law enforcement
agencies. They also operate a larger facility in Livermore where they store severely damaged vehicles. The
location on Scarlett Court has 3 employees and will dispatch 2 tow trucks from the site. The vehicles are typically
stored no more than 50 days and, as conditioned, shall never exceed 60 days. The hours of operation are Monday -
Friday, 8:30 a.m. to 5:30 p.m.
Site Development Review:
The modular office is typical of the trailers that are used on construction sites as offices. The modular office
measures 10 feet wide x 32 feet, 2 inches long, for a total of approximately 322 square feet. The office will include
a metal handicapped accessible ramp and parking space. As conditioned, the modular office will be required to
meet all current building codes and ordinances.
The landscaping on the site is proposed to remain, and Staff has recommended condition of approval #12, which
will require that the landscaping and irrigation be in accordance with the existing landscape plan submitted (see
project plans - sheet L-I) prior to final inspection. In accordance with the City of Dublin Zoning Ordinance, the
vehicle impound yard must be located behind a view obscuring fence. Condition of approval #11 requires that
vinyl or redwood slats be added to the existing chain link fence to create a view obscuring fence. It is the opinion
of Staff that the combination of landscaping and view obscuring fence will provide adequate screening of the site
from adjacent properties.
Variance:
A variance is required in order for the modular office to be located 5 feet from the property line, which is within the
IO-foot front yard setback. The lot is an irregular shaped flag lot with no street frontage other than the driveway to
enter the property. The modular office is located along the southern property line, which is an interior lot line,
located between 5787 and 5777 Scarlett Court (84 Lumber). Although the property line is not adjacent to any street
and functions as a side yard, it is considered the front property line, pursuant to the City of Dublin Zoning
Ordinance, Section 8.36.040 (I) (a), Figure 36-1 and Section 8.36.080 (A) (1). If the southern property line were
actually considered a side yard property line, pursuant to Section 8.36.050 (3) - Compensating Provision of Side
Yard, it would be allowed a 5-foot setback and a variance would not be required.
Parking:
The City of Dublin Zoning Ordinance contains off-street parking regulations by use. An impound yard is required
to provide I parking space per 250 square feet of office, plus I space per company vehicle. As previously stated,
the office is 322 square feet and there will be 2 tow trucks on site. Therefore, 3 parking spaces will be required.
The applicant proposes 3 employee parking spaces, 3 visitor spaces and I handicapped accessible space, none of
which will affect the required parking for the existing auto repair shop.
Signage:
Four new signs are proposed as part of the application (see project plans - Sheets Al.O and A3.0). In accordance
with Section 8.84.140 (A) of the City of Dublin Sign Regulations, signs A and C qualitY as directional signs, which
are exempt from obtaining a sign permit. Pursuant to Section 8.84.050 (H), sign B is an Identification Sign in
which one sign is permitted, subject to Zoning Clearance. Sign D is a wall sign, pursuant to Section 8.84.110, and
requires a building permit only.

Conditional Use Permit Findings
In order for the Planning Commission to approve a request for a Conditional Use Permit for a vehicle towing
service, the Planning Commission must make all of the following findings:
A. The proposed use and related structures are compatible with other land uses, transportation and
service facilities in the vicinity.
B. The proposed use will not adversely affect the health or safety of persons residing or working in
the vicinity, or be detrimental to the public health, safety and welfare and will not be injurious
to property or improvements in the neighborhood.
C. There are adequate provisions for public access, water, sanitation, and public utilities and
services to ensure that the proposed use and related structures would not be detrimental to the
public health, safety, and welfare.
D. The subject site is physically suitable for the type, density and intensity of the use and related
structures being proposed.
E. The proposed use will not be contrary to the specific intent clauses, development regulations, or
performance standards established for the zoning district in which it is located.
F. The proposed use is consistent with the Dublin General Plan and with any applicable Specific
Plans.
Site Development Review Findings:
In order for the Planning Commission to approve a request for a Site Development for a vehicle towing service, the
Planning Commission must make all of the following findings:
A. Approval ofthis application is consistent with the purpose and intent of this Chapter.
B. Any approval complies with the policies of the General Plan, with any applicable Specific Plans, with
the development regulations or performance standards established for the zoning district in which it is
located, and with all other requirements of the Zoning Ordinance.
C. The approval will not adversely affect the health or safety of persons residing or working in the
vicinity, or be detrimental to the public health, safety and general welfare.
D. The approved site development, including site layout, structures, vehicular access, circulation and
parking, setbacks, height, walls, public safety, and similar elements, has been designed to provide a
desirable environment for the development.
E. The subject site is physically suitable for the type and intensity of the approved development.
F. Impacts to views are addressed.
G. Impacts to existing slopes and topographic features are addressed.
H. Architectural considerations, including the character, scale and quality of the design, the architectural
relationship with the site and other buildings, building materials and colors, screening of exterior
appurtenances exterior lighting, and similar elements have been incorporated into the project and as
conditions of approval in order to insure compatibility of this development with the development's
design concept or theme and the character of adjacent buildings, neighborhoods, and uses.

1. Landscape considerations, including the location, type, size, color, texture and coverage of plant
materials, provisions and similar elements have been considered to ensure visual relief and an attractive
environment for the public.
J. The approval of this Site Development Review is consistent with the Dublin General Plan and with any
applicable Specific Plans.
Variance Findings:
In order for the Planning Commission to approve a request for a Variance to allow the office trailer to be located
within the required setback, the Planning Commission must make all of the following findings:
A. There are special circumstances applicable to the property including size, shape, topography, location or
surroundings; such that the strict application of the requirements of the Zoning Ordinance deprives the
property of privileges enjoyed by other property in the vicinity and under identical zoning classification.
B. The granting of the Variance is subject to such conditions that will ensure that the adjustment shall not
constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity
and under the identical zoning classification.
C. The granting of the Variance will not be detrimental to persons in the vicinity or to the public health, safety
and welfare.
D. The granting of the Variance is consistent with the purpose and intent of the applicable zoning district.
E. The granting of the Variance is consistent with the Dublin General Plan and with any applicable Specific
Plan.
CONCLUSION:
This application has been reviewed by the applicable City departments and agencies, and their comments have been
incorporated into the Conditions of Approval for the project. The proposed project, as conditioned, is consistent
with the Dublin General Plan and the Zoning Districts in which the project site is located and represents an
appropriate project for the site.
ENVIRONMENTAL REVIEW:
The application has been reviewed in accordance with the provisions of the California Environmental Quality Act
(CEQA) and was found to be Categorically Exempt under Section 15303, New Construction of Small Structures, as
the use includes a new 322 square foot modular office.
RECOMMENDATION:
Staff recommends that the Planning Commission (1) Receive Staff presentation, (2) Open Public Hearing, (3) Take
testimony from the Applicant and the public, (4) Close the public hearing and deliberate, and (5) Adopt a Resolution
(Attachment I) approving Conditional Use Permit, Variance, and Site Development Review for PA 05-032 Tag's
Towing.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING A SITE DEVELOPMENT REVIEW AND CONDITIONAL USE PERMIT FOR VEHICLE
TOWING SERVICE (IMPOUND YARD) VARIANCE AND SIGN DEVELOPMENT REVIEW FOR
SIGNAGE AT 5787 SCARLETT COURT (B&S HACIENDA AUTO BODY REPAIR AND TAG'S
TOWING)

WHEREAS, David Sanchez and Reinie Tagliapietra, on behalf of Tag's Towing, are requesting the
approval of a Conditional Use Permit, Variance and Site Development Review to allow for the operation of a
vehicle towing service; and a Variance and Sign/Site Development Review for signage and a modular building at
5787 Scarlett Court; and
WHEREAS, a complete application for the above noted entitlement request is available and on file in the
Community Development Department; and
WHEREAS, the Applicant has submitted project plans dated received February 14, 2006; and
WHEREAS, the California Environmental Quality Act (CEQA), together with the State guidelines and City
environmental regulations require that certain projects be reviewed for environmental impact and that environmental
documents be prepared; and
WHEREAS, the application has been reviewed in accordance with the provisions of the California
Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15303, New
Construction of Small Structures, as the use includes a new 322 square-foot modular office; and
WHEREAS, a Staff Report was submitted recommending that the application for a Conditional Use Permit
be conditionally approved; and
WHEREAS, the Planning Commission held a public hearing on said application on April 11, 2006; and
WHEREAS, proper notice of said public hearing was given in all respects as required by law; and
WHEREAS, the Planning Commission did hear and use its independent judgment and considered all said
reports, recommendations, and testimony herein above set forth.
NOW, THEREFORE, BE IT RESOLVED THAT the City of Dublin Planning Commission does hereby
make the following findings and determinations regarding said proposed Conditional Use Permit:
A. The proposed vehicle Impound Yard, as conditioned, is compatible with other land uses, transportation and
service facilities in the vicinity, in that the area is zoned for light industrial uses, including
automobile/vehicle sales, service and retail.
B. The proposed use, as conditioned, will not adversely affect the health or safety of persons residing or
working in the vicinity, or be detrimental to the public health, safety and welfare, in that: I) all towed
vehicles will be stored at the rear of the property, behind the existing auto body shop; and 2) the vehicle
impound yard will be enclosed by a secure fence and gate.
C. The proposed use, as conditioned, will not be injurious to property or improvements in the neighborhood,
in that the towed and stored vehicles will be contained within a secure area on the applicant's property.

D. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure
that the proposed use and related structures would not be detrimental to the public health, safety, and
welfare, in that the conversion of a portion of the existing vehicle storage lot into a vehicle towing and
storage yard does not require a significant amount of additional public services.
E. The subject site is physically suitable for the type, density and intensity of the use being proposed, in that
the existing space was previously used for the storage of vehicles, which is a similar use.
F. The proposed use, as conditioned, will not be contrary to the specific intent clauses, development
regulations, or performance standards established for the zoning district in which it is located, in that: I) the
Zoning Ordinance allows salvage and wrecking yards as a conditional use in the Light Industrial Zoning
District; and 2) conditions of approval have been applied to the project to ensure on-going compatibility
with surrounding land uses.
G. The proposed use, as conditioned, is consistent with the Dublin General Plan, which designates the land use
of the property as Business ParklIndustrial and Outdoor Storage.
NOW, THEREFORE, BE IT FURTHER RESOLVED THAT THE Planning Commission of the City
of Dublin does hereby make the following findings and determinations regarding said proposed Site Development
Review:
A. Approval of this application is consistent with the purpose and intent of this Chapter, in that: I) the
proposed modular office will be compatible with the existing industrial building on the site and with
buildings in the vicinity.
B. Any approval complies with the policies of the General Plan, with any applicable Specific Plans, with
the development regulations or performance standards established for the zoning district in which it is
located, and with all other requirements of the Zoning Ordinance.
C. The approval will not adversely affect the health or safety of persons residing or working in the
vicinity, or be detrimental to the public health, safety and general welfare in that: I) the vehicle
impound yard will not be visible from the street; and 2) will be enclosed with a secure gate and fence.
D. The approved site development, including site layout, structures, vehicular access, circulation and
parking, setbacks, height, walls, public safety and similar elements, has been designed to provide a
desirable environment for the development, in that: 1) as conditioned, the building will meet current
requirements of the Building Code with respect to safety; and 2) the site layout places the office close
to the front gate for convenient ingress and egress and to prevent clients from having to enter the
vehicle storage area.
E. The subject site is physically suitable for the type and intensity of the approved development, in that: I)
the site is not visible from the street; and 2) was previously used as a vehicle storage lot.
F. There will be no impact to views due to: I) the location of the modular office on the site; 2) the
configuration of the lot; and 3) the distance between the modular office and the existing buildings
located on adjacent properties.
G. There will be no impacts to existing slopes and topographic features, in that the proposed impound yard
will utilize a paved area that was previously improved for use as a vehicle storage lot.
H. Architectural considerations, including the character, scale and quality of the design, the architectural
relationship with the site and other buildings, building materials and colors, screening of exterior
appurtenances exterior lighting, and similar elements have been incorporated into the project and as
conditions of approval in order to insure compatibility of this development with the development's

design concept or theme and the character of adjacent buildings, neighborhoods, and uses. As
conditioned, vinyl or wood slats shall be installed on the existing chain link fence surrounding the
impound yard to create a view obscuring fence and the landscaping and irrigation system on the
property shall be maintained to provide screening.

that: I) the property is located on a triangular shaped flag-lot with no street frontage or visibility; 2) the
front property line, as defined in Section 8.36.040 of the Zoning Ordinance, does not abut an right-of-way
like a typical front property line and functions more as a side yard.
B. The granting of the Variance is subject to such conditions that will assure that the adjustment shall not
constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity
and under the identical zoning classification, in that: I) the lot is an irregularly shaped flag lot; and 2) the
lot is not visible from the street; and 3) the lot has an unusual configuration due to the irregular shape.
C. The granting of the Variance will not be detrimental to persons in the vicinity or to the public health, safety
and welfare, in that: I) the property is not visible from the street; 2) the property is located in the M-I
(Light Industrial Zone) and is surrounded by other industrial uses; and 3) a 5-foot setback, measured from
the modular office to the property line, will remain.
D. The granting of the Variance is consistent with the purpose and intent of the applicable zoning district in
that a vehicle impound yard is allowed as a conditionally permitted use in the M-I (Light Industrial)
Zoning District.
E. The granting of the Variance is consistent with the Dublin General Plan and with any applicable Specific
Plan.

CONDITIONS OF APPROVAL:
Unless stated otherwise. all Conditions of Approval shall be complied with prior to the issuance of building permits
or establishment of use. and shall be subiect to Plannin" Department review and approval. The following codes
represent those departments/agencies responsible for monitorin" compliance of the conditions of approval: rPLI

GENERAL - CONDITIONAL USE PERMIT
1. Approval. This Conditional Use Permit approval for P A 05- PL On-going Planning
032 allows vehicle towing and storage occupymg
approximately 18,658 square feet of the existing parcel
located at 5787 Scarlett Court and further identified as APN
941-0550-028. The project shall generally conform with the
project plans drawn Van Hulle Associates received February
14, 2006, on file m the Community Development
Department, and other plans, text, and diagrams relating to
this Site Development Review and Conditional Use Permit,
unless modified by the Conditions of Approval contained
herein.
2. Permit Expiration. Approved use shall commence within PL On-going DMC
one (1) year of CUP approval, or the CUP shall lapse and 8.96.020.D
become null and void. Commencement of use means the
actual use pursuant to the permit approval, or, demonstrating
substantial progress toward commencing such use. If there is
a dispute as to whether the Permit has expired, the City may
hold a noticed public hearing to determine the matter. Such a
determination may be processed concurrently with revocation
proceedings in appropriate circumstances. If a CUP expires,
a new application must be made and processed according to
the reQuirements of the Dublin Zoning Ordinance.
3. Continued Use. This Conditional Use Permit approval shall PL On-going Planning
become null and void in the event the approved uses cease to
operate for a one-year period.
4. Time Extension. The original approving decision-maker PL On-going DMC
may, upon the Applicant's written request for an extension of 8.96.020.E
approval prior to expiration, and upon the determination that
any Conditions of Approval rernain adequate to assure that
applicable findings of approval will continue to be met, grant
a time extension of approval for a period not to exceed six (6)
months. All time extension requests shall be noticed and a
public hearing or public meeting shall be held as required by
the particular permit.
5. Annual Review. On an annual basis, this Conditional Use PL,PO On-going Planning
Permit approval may be subject to a review by the Planning
Manager to determine compliance with the Conditions of
Approval.
6. Revocation. This permit shall be revocable for cause m PL On-going DMC
accordance with Dublin Zoning Ordinance Section 8.96.020.1
8.96.020.1, Revocation. Any violation of the terms of the
terms and conditions of this permit may be subject to the
issuance of a citation.

PROJECT SPECIFIC - CONDITIONAL USE PERMIT

9. Service. No service work or repairs shall be conducted PL On-going Planning

for more than 60 days.
11. Screening. Vinyl or wood slats shall be installed on the PL Final Planning
existing chain link fence surrounding the impound yard to Inspection/On-
create a view obscuring fence. going
12. Landscaping. The landscaping and irrigation system shall PL Final Planning
be in accordance to the landscape plan submitted by the Inspection/On-
applicant. The landscaping and irrigation system on the gomg

13. Window Signage. Signs, advertisements, and other displays PL On-going DMC

building permit, the final design shall be submitted to the
Community Development Department for review and

17. Variance. The setback variance is for the 10' wide x 32'-2" PL On-going Planning
long modular building only. Any future physical expansion
of the office shall not encroach further into the setback
without the approval of a new variance application.
BUILDING DIVISION
18. Building Codes and Ordinances. All project construction B Through Building
shall conform to all building codes and ordinances in effect completion
at the time of building permit.
19. Building Permits. To apply for building permits, the B Issuance of Building
Applicant shall submit eight (8) sets of construction plans to Building Permits
the Building Division for plan check. Each set of plans shall
have attached an annotated copy of these Conditions of
Approval. The notations shall clearly indicate how all
Conditions of Approval will or have been complied with.
Construction plans will not be accepted without the
annotated resolutions attached to each set of plans. The
applicant/developer will be responsible for obtaining the
approvals of all participation non-City agencies prior to the

pads or other non-movable materials to be approved by the
Building Official and Director of Community Development.
Air conditioning units shall be located such that each dwelling
unit has one side that is used for their pedestrian access and
egress that has an unobstructed width of not less than 36
inches. Air conditioning units shall be located in accordance
with the PD text.

23. Trash Enclosure. Provide further detail for proposed new B Issuance of Building
trash enclosure. This would include: elevations, structural Building Permit

PUBLIC WORKS
25. Clarifications and Changes to the Conditions. In the PW Prior to approval Public
event that there needs to be clarification to these Conditions of Improvement Works
of Approval, the Directors of Community Development and Plans
Public Works have the authority to claritY the intent of these
Conditions of Approval to the Applicant/Developer by a
written document signed by the Directors of Community
Development and Public Works and placed in the project
file. The Directors also have the authority to make minor
modifications to these conditions without going to a public
hearing III order for the Developer to fulfill needed
improvements or mitigations resulting from impacts of this
proiect.
26. Standard Public Works Conditions of Approval. PW Prior to approval Public
Applicant/Developer shall comply with all applicable City of of Improvement Works
Dublin Public Works Standard Conditions of Approval. In Plans
the event of a conflict between the Public Works Standard
Conditions of Approval and these Conditions, these
Conditions shall prevail.

Administrator, or any other department, committee, or
agency of the City to the extend such actions are brought
within the time period required by Government Code

notifying the Developer of any said claim, action, or
proceeding and the City's full cooperation in the defense of

28. Conditions of Approval. A copy of the Conditions of PW With each Public
Approval which has been annotated how each condition is subrnittal of Works
satisfied shall be included with the submittals to the Public Improvement
Works Department for the review of the Parcel Map and Plans
improvement plans. The notations shall clearly indicate
how all Conditions of Approval will be complied with, and
where they are located on the plans. Submittals will not be
accepted without the annotated conditions.
29. Improvement Agreement and Security. Pursuant to PW Prior to Issuance Public
97.16.620 of the Municipal Code, the Applicant shall obtain of Works
a Grading/Sitework Permit from the Public Works Grading/Sitework
Department for the installation of required site Permit
improvements. As a condition of issuance of said permit,
Improvement Security shall be posted in the form of cash, a
certified or cashiers check, a letter of credit, or a permit bond
executed by the applicant and a corporate surety authorized
to do business in California. The amount of the security will
be based on the estimated cost of the site work (excluding
the building). The applicant shall provide an estimate of
these costs for City review with the first plan submittal.
30. Improvement and Grading Plans. All improvement, PW Prior to issuance Public
drainage, utility and grading plans submitted to the Public of Works
Works Department for review/approval shall be prepared in Grading/Sitework
accordance with the approved SDR, these Conditions of Permit
Approval, and the City of Dublin Municipal Code including
Chapter 7.16 (Grading Ordinance). When submitting plans
for review/approval, the ApplicantlDeveloper shall also fill-
out and subrnit a City of Dublin Improvement Plan Review
Checklist (8y," x II" pages). All of these reference
documents are available from the Public Works Department
(call telephone 925-833-6630 for more information).
A detailed Erosion Control Plans shall be included with the
Plans. The plans shall include detailed design, location, and
maintenance criteria of all erosion and sedimentation control
measures. Detailed Engineer's Estimate of improvement
costs shall be submitted with the plans.
31. Gradin2lSitework Permit. All improvement work must be PW Prior to issuance Public

the Applicant/Developer will be responsible for any adopted
increases to the fee amount.
32. Erosion Control during Constrnction. Prior to issuance
Applicant/Developer shall include an Erosion and Sediment of
Control Plan with the Grading and Improvement plans for Grading/Sitework
review and approval by the City Engineer and/or Public Permit and during
Works Director. Said plan shall be designed, implemented, construction.
and continually maintained pursuant to the City's NPDES
permit between October 1" and April 15th or beyond these
dates if dictated by rainy weather, or as otherwise directed
by the City Engineer and/or Public Works Director.
All grading, construction, and development activities within
the City of Dublin rnust comply with the provisions of the
Clean Water Act. Proper erosion control measures must be
installed at development sites within the City during
construction, and all activities shall adhere to Best
Mana"ement Practices.
33. Water Quality/Best Management Practices. Pursuant to PW Prior to issuance Public
the Alameda Countywide National Pollution Discharges of Works
Elimination Permit (NPDES) No. CAS0029831 with the Grading/Sitework
California Regional Water Quality Control Board Permit
(RWQCB), the applicant shall design and operate the site in
a manner consistent with Start at the Source publication, and
according to Best Management Practices to minimize storm
water pollution. All trash dumpsters and compactors which
are not sealed shall have roofs to prevent contaminants from
washing into the storm drain system. All storm drain inlets
serving vehicle parking shall be stenciled "No Dumping -
Drains to Bay" using an approved stencil available from the
Alameda Countywide Clean Water PrOl!fam.
34. Parking Lot Lights. The Applicant/Developer shall PW Prior to issuance Public
provide photometric calculation for the existing parking lit of Occupancy Works
and around the building that demonstrates a minimum foot- Permit(s)
candle lighting level of not less than 1.0 at the ground
surface for the adjacent parking area; if this cannot be
verified provide additional lighting where necessary.
35. Disabled Parking. All disabled parking stalls shall meet PW Prior to issuance Public

at each loading zone. Curb ramps cannot encroach within Permit(s)

posted on-site along all curbs that are longer

required by the Fire Marshall.
3) RIOOB (disabled parking regulations sign) shall
be installed at each of the driveway entrance to
the site with amended text to read ". ..may be
reclaimed at DUBLIN POLICE or by
telephoning 833-6670."
4) Handicapped parking signs and legends per
State Title 24 requirements.
5) The word "Compact" shall be stenciled on the
pavement surface within each compact parking
space.
6) Any other signs and marking deemed reasonably
necessary by the City Engineer and/or Public
Works Director during final design and/or
construction.
39. Construction Hours. Construction and grading operations PW During Public
shall be limited to weekdays (Monday through Friday) and Construction Works
non-City holidays between the hours of7:30 a.m. and 5:30
p.m. The Applicant/Developer may request permission to
work on Saturdays and/or holidays between the hours of 8:30
a.m. and 5 :00 p.m. by submitting a request form to the City
Engineer no later than 5:00 p.m. the prior Wednesday.
Overtime inspection rates will apply for all Saturday and/or
holiday work.
40. Damage/Repairs. The Applicant/Developer shall be PW Prior to issuance Public

Occupancy Permit, the physical condition of the project site of Occupancy Works
shall meet minimum health and safety standards including, Permit
but not limited to the following:
I) The walkways providing access to the building
shall be complete, as determined by the City
Engineer, to allow for safe, unobstructed
pedestrian and vehicle access to and from the
site.
2) All traffic control devices providing access to
the site shall be in place and fully functional.
3) All address numbers for street providing access
to the building site shall be in place and visible.
4) Lighting for the site shall be adequate for safety
and security. Exterior lighting shall be provided
as required by Dublin Police.
5) All construction equipment, materials, or on-
going work shall be separated from the public
by use of fencing, barricades, caution ribbon, or
other means approved by the City Engineer.
6) All fire hydrants shall be operable and easily
accessible to City and ACFD personnel.
7) All site features designed to serve the disabled
(i.e. H/C parking stalls, accessible walkways,
signage) shall be installed and fully functional.
43. Trash Enclosure/Garbage Area. The proposed trash PW Prior to issuance Public
enclosure shall be architecturally designed to be compatible of Building Works
with the building. The enclosure shall have a roof Permit
constructed of materials that area architecturally compatible
with the building. The doors must be designed with self-
closing gates that can be locked closed and can also be held
open with pin locks during loading. All trash bins used for
this site shall be maintained within the trash bin enclosure(s)
at all times. An area drain shall be installed within the trash
enclosure with a connection to the sanitary sewer system. In
addition, a hose bib shall be provided for convenient wash-
down of the trash enclosure.
44. Refuse Collection. The Applicant/Developer shall provide PW Prior to issuance Public
designated refuse collection areas for the project, subject to of Building Works
approval by the appropriate solid waste collection company Permit
prior to approval of improvement plans. All refuse
collection areas shall be screened from public view and shall
have roofs to protect against rainwater intrusion and floor
drains connected to the sanitary sewer system to collect
runoff from periodic washdown.
The refuse collection service provider shall be consulted to

ensure that adequate space is provided to accommodate
collection and sorting of putrescible solid waste as well as
source-separated recyclable materials generated by this
project.
45. Required Permits. An encroachment permit from the PW Various Times Public
Public Works Department may be required for any work and Prior to Works
done within the public right-of-way. Developer shall obtain issuance of
all permits required by other agencies, including, but not Building Permit
limited to Alameda County Flood Control and Water
Conservation District Zone 7, California Department ofFish
and Game, Army Corps of Engineers, Regional Water
Quality Control Board, Caltrans and provide copies of the
permits to the Public Works Department.
46. Fees. The Developer shall pay all applicable fees in effect at PW Prior to issuance Public
the time of building permit issuance, including, but not of Building Works
limited to: Planning fees; Building fees; Dublin San Ramon Permit
Services District fees; Public Facilities fees; City of Dublin
Fire fees; Noise Mitigation fees; Inclusionary Housing In-
Lieu fees; Alameda County Flood and Water Conservation
District (Zone 7) Drainage and Water Connection fees; and
any other fees as noted in the Development Agreement.
FIRE PREVENTION DMSION
47. Hazardous Materials. If hazardous materials are used or F Issuance of Fire
stored on the site, they shall comply with the CFC articles 79 Building Permit

53. Fire Lane. Fire apparatus roadways shall have a minimum F On-going CFC 2001,
unobstructed width of 20 feet and an unobstructed, vertical Section
clearance of not less than 13 feet 6 inches. Roadways under 902.2.2.1
36 feet wide shall be posted with signs or shall have red curbs
painted with labels on one side; roadways under 28 feet wide
shall be posted with signs or shall have red curbs painted with
labels on both sides of the street as follows: "NO STOPPING,
FIRE LANE - CVC 22500.1".
POLICE DEPARTMENT
54. Security. The applicant shall comply with all applicable City PO On-going Police
of Dublin Non Residential Security Ordinance requirements.

33. Prior to the Issuance of any building permit, complete DSRSD Issuance of DSRSD
improvement plans shall be submitted to DSRSD that conform Building permit
to the requirements of Dublin San Ramon Services District
Code, the DSRSD "Standard Procedures, Specifications and
Drawings for Design and Installation of Water and Wastewater
Facilities", all applicable DSRSD Master Plans and all DSRSD
policies.
34. Prior to issuance by the City of any Building Permit or DSRSD Issuance of DSRSD
Construction Permit by the Dublin San Ramon Services Building permit
District, whichever comes first, all utility connection fees
including DSRSD and Zone 7, plan checking fees, inspection
fees, connection fees, and fees associated with a wastewater
discharge permit shall be paid to DSRSD in accordance with
the rates and schedules established in the DSRSD Code.
35. No sewer line or waterline construction shall be permitted DSRSD On-going DSRSD
unless the proper utility construction permit has been issued by
DSRSD. A construction permit will only be issued after all of
the items in Condition No. 34 (above) have been satisfied.
36. The applicant shall hold DSRSD, its Board of Directors, DSRSD Issuance of DSRSD
commissions, employees, and agents of DSRSD harmless and Building Permit
indemnify and defend the same from any litigation, claims, or
fines resulting from the construction and completion of the
proi ect

We need to request a setback variance. The irregular shape of the property
and location to utilities is the reason for a 5 foot setback. We are not located
off any street. We are surrounded by business lots. A drainage canal on one
side. The side where we can best access to power and water is the fence
line of 84 Lumber. They store stacks of lumber along that fence line. If we
use the 10' setback the structure will be IN the driveway.
