FINANCIAL STATEMENT:
$104,625 to $124,884 income to the
General Fund
DESCRIPTION: On October 8, 1984, the City Council set
a hearing on the sale of 0.6371+ acres (27,752 + square feet) of
City property along San Ramon Road south of Silvergate Drive. A
written protest to the sale by Patience Rogge is on file with the
City. Prior to the sale taking place, the City Council needs to
hear all written and oral protests. The City council must
overrule the protests by at least a four-fifths vote before
proceeding. If the City Council does not overrule the protests,
the sale cannot proceed until six months have passed or a special
election is held.
As part of the negotiation process, the City and applicant had an
appraisal of the property as of January 31, 1984, prepared by
Melvin P. Nelson, Real Estate Appraiser. The appraisal found an
estimated fair market value of $4.50 per square foot, or a total
of $124,884 (27,752 sq. ft. @ $4.50 per sq. ft.). The value was
based on 1) comparison with other multifamily sales in the area,
and 2) the addition of 16 units made possible by the property.
Barratt San Jose has offered a price of $3.77 per square foot, or
a total of $104,625 (27,752 sq. ft. @ $3.77 per sq. ft.). The
offer is based on 1) the price Barratt San Jose paid for the
adjacent private property in May, 1983, and 2) the perception
that the property gains value only if added to the Barratt
project.
Two additional points need to be considered: 1) There is no
certainty in fair market value. The appraisal gives one
professional estimate. .Other professional estimates may differ.
2) In order for the project to proceed as approved, the applicant
must acquire the property.
Considering the various factors affecting the value of the
property, Staff finds that the City Council may wish to consider
the price of $4.135 per square foot for a total price of $114,755
as a reasonable compromise.
Staff recommends that the City
market value of the property,
adopt the Resolution approving
to execute the agreement.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

APPROVING SALE OF CITY PROPERTY TO BARRATT SAN JOSE AND
AUTHORIZING MAYOR TO EXECUTE THE AGREEMENT
WHEREAS, Barratt San Jose has requested the City to
enter into negotiations to sell 0.6371+ acres of City property
adjacent to San Ramon Road South of Silvergate Drive in
conjunction with an 84 unit Planned Development on the adjacent to
the subject property; and
WHEREAS, the property in question ("subject property")
is located on San Ramon Road. It consists of approximately
0.6371+ acres and is more particularly described in Exhibit A
attached hereto; and
WHEREAS, the subject property consist of a 55+ foot
wide strip, 630+ feet in length along San Ramon Boulevard. The
subject property is part of the public right-of-way but is not
presently used for public right-of-way purposes. There is no
present intention to widen San Ramon Boulevard; there is no
foreseeable use for the subject property; and
WHEREAS, on December 12, 1983, the City Council
directed Staff to enter into negotiations for the sale of the City
property, and gave the applicant permission to incorporate City
right-of-way in a revised proposal; and
WHEREAS, on July 23, 1984, the City Council established
that the subject property was surplus land and directed staff to
notify the appropriate agencies of the City's offer to sell the
property; and
WHEREAS, on October 8, 1984, the City Council found that
other agencies were not interested in purchasing the subject
property; and the City Council stated its intention to sell the
subject property and set a hearing on the matter; and
WHEREAS, on October 22, 1984, the City Council held a
public hearing, received all protests and overruled the protests
by at least a four-fifths vote.
NOW, THEREFORE, BE IT RESOLVED that the Dublin City
Council approves the sale of subject City property to Barratt San
Jose for the following price:

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

STATING INTENTION TO SELL CITY PROPERTY AND SETTING HEARING
WHEREAS, Barratt San Jose has requested the City to
enter into negotiations to sell 0.6371~ acres of City property
adjacent to San Ramon Road South of Silvergate Drive in
conjunction with an 84 unit Planned Development on the adjacent to
the subject property; and
WHEREAS, the property in question ("subject property")
is located on San Ramon Road. It consists of approximately
0.6371+ acres and is more particularly described in Exhibit A
attached hereto; and
WHEREAS, the subject property consist of a 55+ foot
wide strip, 630+ feet in length along San-Ramon Boulevard. The
subject property is part of the public right-of-way but is not
presently used for public right-of-way purposes. There is no
present intention to widen San Ramon Boulevard; there is no
foreseeable use for the subject property; and
WHEREAS, on December 12, 1983, the City Council
directed Staff to enter into negotiations for the sale of the City
property, and gave the applicant permission to incorporate City
right-of-way in a revised proposal; and
WHEREAS, on July 23, 1984, the City Council established
that the subject property was surplus land and directed staff to
notify the appropriate agencies of the City's offer to sell the
property.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City
council finds that it is in the public interest and convenience to
sell the subject property. The City Council intends to sell the
subject property and hereby fixes october 22, 1984, at 7:30 P.M.
in the Meeting Room, Dublin Library, 7606 Amador Valley Boulevard,
as the time for hearing protests to the proposed sale. Protests
may be written and filed with the City Clerk before the hearing,
or may be made orally at the hearing. At the hearing the Council
will hear all protests and shall take final action with respect to
the proposed sale of the subject property unless the item is
continued.
BE IT FURTHER RESOLVED that the City Council directs the
City Clerk to publish this resolution one time in the Tri-Valley
Herald. The City Clerk is fu~ther directed to post three copies
of this resolution on the subject property in conspicuous places
on or before October 12, 1984.

Ladies and Gentlemen:
Barratt Northern California hereby offers to purchase the property owned by the City
of Dublin lying between the fully extended right of way of San Ramon Road and the
property owned by Barratt Northern California bordered by San Ramon Road,
Silver gate Drive and Martin Canyon Creek.
We offer the price of $3.77 per square foot of property. This is the same amount as
we paid for the balance of the property. We feel this represents a fair return to the
City for property that has value for sale only if it becomes a portion of Barratt's
project. We therefore offer the same amount as we purchased the balance of the
property for in the open market.
