1.0 INTRODUCTION
At the request of Standard Pacific Homes, Olberding Environmental, Inc. conducted a biological
resources analysis asscssing the presence of potential habitat suitable for use by the California tiger
salamander (Ambystorna tlgrlnum californlense [CTS]) at the Mission Peak Property ("The
Property"), located outside the City bOlllldary of Dublin. within Alameda County, Califol11ia.
This report documents the methods, results. and conclusions of the reconnaissance-level biological
analysis assessing potential CTS habitat and migration balTiers within and immediately surrounding
the Property. As pat1 of the analysis effort. the Property was surveyed for potential breeding and
aestivation habitat suitable for the tcrrestrial and aquatic life stagcs of the CTS. The Propel1y and
surrounding areas in the immediate vicinity were also examined for structures (e.g., roads. large
drainages etc.) that might constitute potential barriers to CTS mie,rration betwecn brecding and
aestivation habitat.
I'inally, this biological resources analysis also includes a review of previously prepared biological
reports/infC1l111ation, pertinent litcrature on the CTS. and a review of information related to the CTS
habitat characteristics. Relevant background information includes the California Natural Divcrsity
Dat~ Base (CNDDB), as well as previous field investigations conducted within the area.

2.0 PROJECT SITE LOCATION
The Mission Peak Propcrty is locatcd on the east side ofTassajara Road, north of the city of Dublin.
The Property is approximately 2.5 miles north ofthe Highway 580 and Tassajara Road interchange.
The site is situated at thc first bend in the road way whcre it curves cast to cross over the East Fork
ofTassajara Creek (East Fork). The Property is located in Alameda Connty,just south ofthe Contra
Costa/Alameda County line. Tassajara Road forms the westel11 boundary of the site, and
undeveloped lands occur to the east. The East Fork crosses through the northwest end of the
Property. Attachment 1, Figure 1 depicts the regional location of the Property in Alameda County.

3.0 PROPERTY DESCRIPTION
The landscape within thc Property consists of a rolling telTain with the steep to moderately steep
topography that characterizes thc upper Tassajara Creek watershed. Site elevations range from 883
feet at the top ofthc ridge linc at the easter-n comer of the Property, to 492 fcet in the relatively level
area along thc northwestcrn part of the Property. Within the Property. drainage flows generally in
an east to west direction with surface f10ws discharging into the East Fork ofTassajara Creek. which
f10ws northeast to southwest along the northwestcm property boundary.
An unpaved gravel access road into the Property leads north toward a constructed pond; a second
pond occurs further up gradient and northeast at the point of convergence of two chaJUlels with
intermittent f1ow. One of the channels is fed by two seeps that provide water to the system aftcr
stO!1n water nmoff has ceased. Downstream from the upper stock pond, a single chamlel emerges
continuing down hill for several hundred feet before disappearing into an alluvial fan. A second
coustmcted pond is positioned adjacent to the East Fork of Tassajara Creek. The lower pond has
been constructed as part of a recent mitigation measure. This pond consists of a constmcted berm
and spillway placed across the drainage. Both ponds have been fenced to exclude cattle grazing and
are surrounded by thick emergent wetland vegetation.
There is cUITent1y no development on the Property. The land is used for cattle pasture which leaves
little or no vcgetation in some areas where over grazing occurs. The lands to the north. east and
south are similarly used for pasture and are separated from the Property by barb wire fences. The
landscape supports non-native annual grassland throughout the site and patches of native perennial
grassland habitat are found on the north facing slopes. Within the Property, the east bank of
Tassajara Creek supports abundant riparian vegetation including arroyo willow (Salix lasiolepis) and
valley oak (Quercus lobata), which are found along thc active portion ofthe channel and up to the
top of the bank. ElderbelTY (Sambucus mexicana) and coyote brush (Baecharis pilularis) arc also
prescnt as sccondary species in the corridor and arc the only understory components along the
channel. Several mature blue gum (Eucalyptus globulus) occur on the top of the east bank and
within the channel.
One residence is locatcd west of Tassaj ara Road, across from the property, and one residcnce is
found on the land to the south ofthe parcel. This area supports sparsc riparian vegetation which has
been impacted by grazing cattle resulting in a lack of under story vegetation.
4.0 REGULATORY SETTING
The CTS is on the California Department of Fish and Game (CDFG) list 0 f animal species of special
concern (CDPG 2003). Spccies of special concem are those whose breeding populations arc
declining; therefore, those species eonld face extilvation in thc future. The CTS is currcntly state-
listed as a species of special concern and is fcderally listed as endangered in Sonoma and Santa
Barbara Countics in Califomia.
Although the CTS has no legal status in Alameda County, the CDFG recommcnds considering this
species during analysis of proposed project impacts to protect declining populations and to avoid the
necd to list thcm as endangered in the future. Currcntly. the CTS is bcing revicwed for listing as
fedcrally threatened or endangcred. On May 23,d. 2003, the U.S. Fish and Wildli fe Service (USFWS)

publishcd in the Fedcral Register a proposal to list the CTS as a threatened species under the
Endangered Species Act. By court order, the USFWS has until May 15'h, 2004 to make a final
decision as to whether to list the species. Therefore, the federal status of the CTS is likely to be
resolvcd by May 2004.
5.0 REVIEW OF EXISTING REPORTS
Special-status specics reports werc accessed by searching the CNOOB d~:;;~" by the Livem10rc
and Tassajara 7.5 minute quadrangle maps representing the Propel1y. The CNDDB report was uscd
to focus special-status species analysis of the site prior to the field reconnaissance survey.
One CNDOB listing for thc CTS occurs on the Propel1y at the upper stock pond (2000 listing). Dr.
Mark Jennings is the biologist who identified CTS larvae at the upper stock portg)in surveys carricd
out between 2000 and 2002. Dr. Jennings indicated that no CTS larvae were foun'd in the lower pond
wherc Califomia red-legged frogs (Rana aurora draytonii) are known to occur due to the depth of
the pond and inabilityto adequately survey the fcature. However, it is possible that CTS could occur
at the lower stock pond (Jennings 2003).
CTS have been recorded at nearby locations including Tassajara Creek Regional Park, the area near
Brodcr Boulevard and Creekvicw Drive, and in a stock ponds OccuLTing southeast of the Property
near Fallon and Croak Roads (scc Attaehmcnt 1, Figure 5).
6.0 CALIFORNIA TIGER SALAMANDER SPECIES OVERVIEW
6.1 CTS Morphology
The CTS is a large terrcstrial salamander with adults attaining a total length of ovcr 8 inches (203
millimeters) [Stebbins 1951]. Dorsally the background color appears to be jet black, norn1ally with
an overlain pattern of white or yellow spots or bars (Stebbins 1985). Ventral surfaces are highly
variable in pattern, ranging from nearly uniform whitc or pale yellow to variegated whitc or pale
yellow and black (Jenning and Hayes, 1994). Juvenile salamanders are 1.7-2.8 inches (42-70
millimeters) from the top of the snout to the rcar of the vent and have the same coloration pattcrn
as adults. Salamanders that are recently metamol1Jhosed often havc a pale yellowish-brown or tan,
or greenish-colored dorsum with dark flecks and blotches (Jennings unpublished data). These
blotches soon fade to a white or yellow color after a few weeks. Larval salamanders range in size
from 0.4-6.6 inches (11-150 millimeters) in totallcngth with a palc yellowish-brown or dark-colored
dorsum (Anderson 1968). Extemal gills and legs are prominent features on all salamandcr larvae
over 2 weeks old (Storer 1925).

6.2 CTS Life History
Brecding of adult CTS has been observed from late November through February following the onset
ofwanll rains (Storer 1925, BatTY and Shaffer 1994). Based on observations made during the 1990s,
salamanders often do not breed during periods of aseasonally cold rains or during drought (whether
breeding ponds are filled with water or not) [Barry and Shaffer 1994; Jennings unpublished data].
Both males and females cngage in noctumal breeding migrations traveling up to 1 mile (1.6
kilometers) [Austin and ShatTer 1992] or more from subterranean retiJge sites (e.g., small mammal
bunows) [Loredo and others 1961] to breeding ponds or long-lasting rain pools (Anderson 1968).
Adult salamandcrs are possibly stimulated to move to breeding sites by the vibrations of rainwater
falling on the soil. as adult male salamanders have been observed (after preceding nights of rainfall)
wandering on the dry soil of rain pools that have not yet fillcd (Jelmings unpublished data).
Sites used for reproduction are typically natural pools that fill with rainwater and artificial stock
ponds; however, salamanders have also been observed to breed in springs, wells, artificial reservoirs.
quany ponds, man-made canals, and rarely. in the slack waters of oxbows in medium-sized streams
(Jennings unpublished data). Such sites mayor may not contain dense amounts of aquatic and
streamside vegctation. Thc highest numbers of larvac appear to occur in aquatic habitats that are
largely devoid of any vegetation and contain very turbid watcr. In such situations. salamander larvae
oftcn hide during thc day in the deeper portions of the pond or under debris (such as dead Russian
thistles [Salso/a tragus]) that blow into the pond (Jennings unpublished data). Since salamander
larvae arc very cryptic in coloration, they are often hard to observe in the turbid watcrs of breeding
habitats.
Anccdotal evidencc suggests that salamanders have a high degrec of site fidelity to their breeding
ponds and also to the small mammal bunows they use for rcfugia (Shaffer and others 1993; Jennings
unpublished data). For examplc, a gravid, adult female CTS removed from a breeding pond and
transported to a newly crcated mitigation pond moved a straight-line distance of approximately 0.9
miles (1.4 kilometers) back to the original point of capturc over a 3-week period (Duke and others
1998).
Males generally preccde females during the breeding scason by 1-2 weeks (Shaffer and others 1993;
Loredo and others 1996). Following underwater courtship from one ormore males. females normally
dcposit thcir moderate-sized cggs (0.13-0.21 inches [3.6-5.9 millimeters] diameter) singly on
vegetation and othcr debris in thc shallow margins of rainwater pools (Storer 1925). Large females
may deposit up to 350 eggs per scason. although most fcmales only deposit 100-200 eggs (Jennings
unpublished data). Adult salamanders apparently leave breeding ponds soon after spawning (Storer
1925), although they may forage for up to a month in the general area if conditions continue to hc
moist (Barry and Shaffer 1994). Most salamanders soon relum to aestivation habitats in small
burrows whcre they spend approximately9-1 0 months undcrground until the next winterrains (Barry
and Shaffer 1994; Jennings unpublishcd data).

Embryos ofCTS hatch in approximately 14-28 days after being laid (Storer 1925) and the resulting
gilled aquatic larvae (0.41-0.43 inches [10.5-11 millimeters] in length) require a minimum of about
10-12 wceks to complete development through metamorphosis. At metamorphosis. young
salamanders havc attain a total length of about 2.6 inches (75 millimeters) [Anderson 1968. Feaver
1971]. Metamorphosis is apparently initiated by receding water levels in breeding ponds and most
larval salamanders do not mctamorphose until they are as large as possible (Feaver 1971). Although
the native brccding habitat for this species nOlmally dries each year and metamo'11hosis is paramount
under such conditions, there are a few observations oflarval salamanders overwintering in artificial
constructcd pcmlancnt ponds (Shafferpcrs com.). The overwintering oflarvae (especially to sexual
maturity) is common in many closely related spccies of mole salamanders (Ambystoma spp.) Found
in other parts of North America (Stebbins 1985, Petranka 1998).
6.3 CTS Prey alld Predators
CTS larvae are carnivorous and feed on just about any organism they can ovellJower- including
smallerconspecifics (Feave,- 1971). Larger larvae havc becn observed to fccd on the larvae of Pacific
trce frogs (flyla regilla), Califomia toads (Buro boreas halophilus) and Westcrn spadefoot toads
(Scaphiopus hammondii), as well as many aquatic invertebrates (Anderson 1968. Feaver 1971;
Jcnnings unpublished data). During aestivation, juveniles probably feed on the rich invertebratc
fauna that is normally associated with small mammal burrows and grow rapidly over the next scveral
months. Adult CTS apparently eat the same food organisms as juvenilc salamanders (Morcy and
Guinn 1992; Jennings unpublished data) and may live as long as 20+ years in the wild based on the
longcvity oC other closely related species in captivity (see Snider and Bowler 1992).
Predation to salamanders is probably minimal in underground refugia. Juveniles and adults are
known to be eaten by bullfrogs (Rana catesbeiana), garter snakes (Thalllnophis spp.), and probably
black-crowncd night herons (Nycticomx "ycticomx) and raccoons (Procyon lotor) when they arc
present on the surCace during the wet winter and spring months (Morey and Guinnl992; Jennings
unpublished data). Larvae arc eaten by a wide varictyofpredators including garter snakes, bullfrogs,
California red-legged fi'ogs, herons (Ardcidae), terns (Sterna spp.) And apparently fish when thc
latter arc introduccd into breeding ponds (Baldwin and Stanford 1987. ShaCfer and others 1993.
Fisher and Shaffer 1996; Jennings unpublished data).
6.4 Aestivatioll Habitat
Following metamorphosis (nol111ally from early May through July). juveniles cmigrate ell masse at
night Ii-om the drying breeding pond (Holland and others 1990; Jennings unpublished data).
Traveling distanccs of up to 1 mile (1.6 kilometers) or more from breeding sites juvenile
salamandcrs wander into small mammal burrows or deep cracks in the soil. which they use as refugia
during the hot summcr and fall months (ShalTer ] 993. Lorcdo and others 1996). Juvenilcs will also
wander into certain man-made structures such as wet basemcnts, wells, undcrground pipes, and
septic tank drains (Storcr 1925).

Mortality of juveniles can be high during this transition period due to the stress of metamorphosis
and the problems of finding a suitable refuge site before the sun comes up. For example. Holland and
others (1990) found almost an entire cohort ofCTS killed by unsuitable weather conditions when
they attempted to emigrate from their breeding pond during the late summer. Data suggests that most
individuals require 2 years to beeome sexually mature, but some individuals maybe slower to mature
during periods of drought or aseasonal rainfall (Shaffer and others 1993).
Juvenile and adult CTS normally use the burrows of California ground squirrels (Spermophilus
beecheyi) and Botta's pocket gophers (Thomomys bottae) as underground refugia (Storer 1925,
Jennings and Hayes 1994. Jennings 1996, Loredo and others 1996). Both juvenile and adult CTS
ha ve been known to settle into oCCLlpied and unoccupied Califomia ground squirrel burrows to
aestivate (Loredo and others 1996).
CTS have also been observcd in the burrows of California voles (Microtis californicus), blacktail
jackrabbits (Lepus californicus) and the deep cracks of clay soil which may extend up to 15-feet (4.6
meters) deep from the soil surface (Loredo and others, Jennings unpublished data). CTS may also
turn up in certain man-made structures (e.g., wet basements. wells, swimming pools, underground
pipes, and septic tank drains [Storer 1925, Pickwell 1947], sometimes many years after their local
breeding site has been destroyed (Jennings unpublished data). Juvenile and adult salamanders are
especially common in situations where piles of concrete. rock, or other rubble are mixed with dirt
and arc located ncar breeding sites (Jennings unpublished data). This is probably because such sites
are attractive to bUlTowing rodents that create extensive tunnel and burrow systems that are in turn
used by CTS.
7.0 METHODS
7.1 Assessment ofpotential CTS Aestivation Habitat
The site was surveyed for potential CTS aestivation habitat by walking transects up the hills in a
west to cast direction from Tassajara Road. Potential CTS aestivation habitat was classified as one
ofthrce types
Small mammal burrows.
Mounds of dirt 6-12 inches in diameter, which are composed of the tailings of burrowed
earth deposited by small mammals such as ground squirrels and moles.
Deep cracks in the ground.

7.2 Assessmellt of Potelltial CTS breedillg habitat
The site was inspected for the presence and condition of swales, intel111ittent channels, and shallow
depressions along seasonal drainages that could pond during the winter rains.
7.3 Assessmellt ofCTS barriers
Potcntial barriers to CTS dispersal into or out ofthe site were assessed by inspecting the areas within
and immediately sunounding the Property. The following are considered to be potential barriers to
overland movement ofCTS:
Roadways with heavy traffic volumcs are anticipated to create a dispersal barrier.
Large buildings are anticipated to act as partial barriers to CTS dispersal.
Walls and wooden fences that are in contact with thc ground surface could act as a
dispersal barrier. Wire mesh fencing is not considered to be a barrier.
The East Fork ofTassajara Creek and Tassajara Creek charmels may be a barrier during high
flow timcs following st0l111 events.
7.4 Methods of USFWS protocol sllrveys for presellce/absellce ofCTS
USFWS protocol CTS survey methods for assessing the presence/absence ofCTS are summarized
below. Sincc CTS have been identified at the Mission Peak Propcrty, fltrther protocol surveys may
not be necessary at this Propcliy to reconfil111 the prescnce 0 f CTS. Due to the presence of CTS on
thc nearby Mission Peak Property, it is likely that the USFWS will assume thc continued prcscnce
of CTS on the Property.
USFWS protocol requires that the presence/absence of CTS be assessed using pitfall trap arrays
arranged along the perimeter of the Propcrty. Each pitfall trap consists ofa bucket places into a pit
in the ground that is dug out so that the bucket is flush with the ground surface. Pitfall traps are
installed at a distance of approximately 30 fcet apart. The arrays are cOill1ected using silt fencing that
is placed between buckets to form a contiguous banier for CTS movement across the length and
breadth ofthe Property. Tn addition to perimeter trap lincs, transect trap lines are also included to
maximize the chance of capture. Fencing construction must be complete before thc onset ofthe first
wintcr rains, which stimulate adults to migrate to breeding ponds.

8.0RESUL TS
Olberding Environmental conducted a reconnaissance level survey of the Property on August 22"",
2003. The recollnaissance level surveycollsisted of walking throughout the Property and evaluating
the Property and adjacent lands for potential CTS aestivation, breeding habitat, as well as barriers
to CTS dispersal.
8.1 Presel/ce of CTS at or in the vicinity of the Property
The CNDDB records indicate a recent (2000) CTS sighting at the upper stock pond that occurs on
the Property (Attachment 1, Figure 4). CTS were also sighted in subsequent surveys on the Propetiy
conducted during 2001 and 2002 (Jennings 2003). The CNDDB identifies many other CTS records
elsewhere within the Livermore quadrangle (CNDDB 2003).
8.2 Assessment of Potential CTS Aestivation Habitat
The area bctween the two stock ponds and thc sun-ounding hillsides were cxamincd for the presence
of active and unused California ground squin-el bun-ows. Bun-ows wcre abundant along the hills on
cither side of the intermittent chmmels draining into the East Fork ofTassajara Creek. There was also
a high density of burrows along the swale between thc two ponds. Deep fissures in the ground were
also sightcd within this area. Based upon these observations, CTS aestivation habitat is likely to bc
abundant within this area of the project.
8.3 Assessment of Potential CTS breeding Habitat
The uppcr pond is likely to provide habitat for CTS breeding and for larval development if winter
rains provide adequate water to fill the pond for a minimum of 10-12 weeks. The lower pond may
also providc CTS brccding habitat.
8.4 Assessment of Barriers to CTS Movement
The East Fork ofTassajara Creek is considcred to be a seasonal ban-ier to CTS dispersal during times
of heavy seasonal flows (e.g., during the winter rains). CTS dispersal between the Propeliy and
adjacent potential habitat across the creek (e.g., in Tassajara Creek Regional Park) is unlikely to be
possible during those times of heavy flow.
The existing barbed wire and other fencing that occurs within and around the Property docs not
constitute a barricr to CTS migration. Tassajara Road is considered to bc a CTS barrier between the
Property and adjacent lands further west.

In summary, potential barriers to CTS dispersal were observed to the west (Tassaj ara Road), and
northwest (East Fork ofTassajara Creek) ofthe Property. No barriers werc observed to the east and
south of the Property.
9.0 CONCLUSIONS
Past CTS surveys havc been conducted within the Property. Sightings and existing habitat observed
seem to indicate that CTS continue to occur on thc Property. The existing literature and observations
on potential CTS habitat within thc Property imply that breeding and aestivation habitat are likely
to occur on site.
10.0 RECOMMENDATIONS
Based on the cxisting literature, CTS could probably utilize the habitat available on the Propc11y as
breeding and aestivation habitat, or as a conidor between existing breeding/aestivation habitat and
off-site aestivation habitat. It is thercfore recommended that the Client coordinate with the CDFG
conccrning the appropriate mitigation measures required for the development ofthe Property. Thcre
is also a potential that USFWS may formally list the CTS as fcderally threatened or endangered by
May 15''', 2004. If this listing occurs, dcvelopment of the Propcrtymay require coordination with the
USFWS in accordance with Section 7 of the Endangered Species Act. Through consultation and
negotiation between the CDFG and the USFWS appropriate mitigation measures would be
determined. These measures may include construction timing restrictions, salvage surveys, biological
monitoring, exclusion fencing, avoidance or sensitive areas or rcduction in projcct size and on-site
and/or off-site compensatory mitigation.
On-site mitigation measures may include the following strategies during the construction of the
developmcnt project:
Prcvention of CTS cntry prior to construction: Appropriate exclusionary barriers (e.g., silt
fcncing) could be installed along the pcrimeter of the development portion ofthe Property.
Exclusionary barriers should bc designcd such that they allow CTS to rnib'Tate out from
aestivation habitat to breeding ponds that occur outside the devclopment area ofthe Property.
These barriers would be constructed to allow the one-way passage of CTS out of the
development area, prcventing re-entry.
Fcnce construction timing: Exclusionary barriers could be installed prior to the onset of
winter rains which stimulatc CTS to movc to breeding ponds. Implementation of thc
mitigation measure would need to bc coordinated with the projcct biologist to insure proper
installation.

Dispersing and migrating CTS during construction activities on the Property: The banier
fcncing should be maintained and monitored continuously for the dnration of construction
to ensure that migrating and dispersing CTS do not re-enter the Property.
Maintcnance of exclusion fencing: Exclusion fencing should remain in place until the
construction of the project is completed.
Monitoring requirements: A biological monitor should be present on-site during grading and
ground disturbance construction activities to ensure that no take of CTS occurs.
Erosion/sedimentation prevention: Best management practices should he followed on the
Property to minimize impacts of erosion and sedimentation into the existing drainages and
downstream watercourses.
Minimizing CTS habitat disturbance: Grading and vegetation clearing in the immediate area
(normally regarded as 750 feet) sunotlI1ding the breeding pond should not be conducted
during the breeding and migrating seasons (November- June).
Mitigation cfforts: Future mitigation efforts could also include the restoration and
enhancement of existing CTS habitat on the Property, which has the potential to havc high
regional conservation value.

The Mission Peak Project consists of the subdivision of approximately 23.5 acres of land \vith residential units
and the conservation of 44_3 acres of land as penn311ent open space withi.n the 67.8 acre site. Home
construction and grading will occur on the sout11\vestern side of the site, located adjacent to Tassajara Road
and an unnamed tributary to Tassajara Creek. The steep hillsides on the north and eastern side of the Project
site will remain undeveloped.
The Project will involve the construction of an outfall stmcture to Tassajara Creek with impacts to the eastern
bank of the Tassajara Creek tributary above and below the ordinary high water line. The outfall will consist of
a 9 x 20 x 12 foot concrete structure. Sheet pilings will be installed just above the ordinmy high water line to
provide a footing for the outfall. Three concrete chambers have been designed to dissipate \vater velocity
from storm \vater discharges. One chamber includes rock and 1/4 ton rip rap to slow water flow as it enters
the creek channel at the ordinary high water line. Work below the ordinary high water !iDe includes a rock rip
rap protection apron and coir fabric. The bank protection material will be installed over a 15 foot wide length
of chalmel and extend 5 feet below the ordinary high water line. The dimensions of the rock rip rap are
l5x5x3. Additional work i..n CDFG jurisdiction consists of lhe placement of the discharge culvert from the
water tTcatmcnt basin within an underground trench. This activity included the excavation of a tTench 15 feet
by 4 feet from the edge of the riparian drip line to the outfall structure_ The trench is estimated to be
approximately 6 feet in depth. The total area impacted by the culveli placement is 15x4x6.
Other components of the development include specific mitigation measures for special-status amphibian
speCIes. A 200-foot setback buffer occurs between an existing CRlP breeding pond and the proposed
development envelope. A 100-foot setback buffer is provided benveen an existing CTS breeding pond and the
proposed devdopment envelope. A 100-foot setback is provided along the Creek cOlTidor and riparian
restoration is proposed for pOliions of land adjacent to the channel. The existing land use includes cattle
grazing and after implementation of setbacks and development, cattle impacts to the creek corridor will be
eliminated. A permanent concrete curbed CTS and CRLF barrier fence will be constructed around the
dcvelopment area to prevent these amphibians from entering the construction area or the housing subdivision
after the completion of the Project.
T\\:o settling ponds have been designed to capture runoff [rom the development and are 50 feet \vide by 100
feet long each. These 1\:\-'0 ponds are prescribed for yearly sedlment removal. A third water quality pond, deep
enough to support California red-legged frog breeding, is sihlated between the two settling ponds. This CRLF
pond is approximately 0.14 acres in size and will not be maintained with a sediment or vegetation removal
program.

3. PROJECT LOCATION:
The Mission Peak Property is located on the east side of Tassajara Road, nOlih of the City
of Dublin. The Property is found approximately 2.5 miles north ofthe Highway 580 and
Tassaj ara Road interchange. The site is situated at the first bend in the road way where it
curves east to cross over the unnamed Tassajara Creek tributary. The Propeliy is located
in Alameda County, just south of the Contra Costal Alameda County line. The tributary
to Tassajara Creek forms the northwestern boundary of the site, Tassajara Road forms the
westem border, and fence lines foml all other boundaries.
4. WATERBODY:
The tributary to Tassajara Creek is defined by a very deeply incised bed and bank.
Approximately 1,460 linear feet of the chazmel occur along the northwestern propeliy
line. The active charmel avcrages approximately 5 feet wide and lies approximately 20
feet below the top of the banle A nalTOW flood terrace is also located along portions of
the creek adding au average of 9 additional feet to the ehazmel. The slopes of the banks
approach veliical, however, a few locations occur that are less steep allowing access to
the channel. Scour is ongoing along the banks ofthe charll1el and there is a lack of
eharmel vegetation. The portion of the channel in the Property area and directly
downstream appears to suffer from a very high erosion rate. Water was flowing
downstream at the time of the survey with water depth averaging approximately four
inches.
Arroyo willow (Salix lasialepis) and valley oak (Quercus labata) are found along the
active portion ofthe channel and up to the top of the bank. Elderberry (Sambucus
mexicana) and coyote brush (Baecharis pilularis) were also observed as secondary
species in the cOlTidor and were the only understory components along the channel.
Several mature blue gum (Eucalyptus globulus) occur on the top of the east bank and
within the channel.
Fine gravel material and silt are found in the bed of the creek. Where Tassajara Road
crosses thc creek, a large conugated metal culveri transpOlis flows beneath the roadway.
Approximately 1200 feet southwest from the Property, the tributary joins the main
channel of Tassaj ara Creek.
5. PROJECT ACTIVITY:
The Mission Peak Project consists of the subdivision of approximately 23.5 acres ofland
with residential units and the conservation of 44.3 acres of land as permanent open spacc
within the 67.8 acre site. Home construction and grading will occur on the southwestem
side of the site, located adjaccnt to Tassajara Road and the tributary to Tassajara Creck.
The steep hillsides on the north and eastern side of the Project site will remain
undeveloped.
Thc Proj cct will invol ve the construction of an outfall structure to Tassaj ara Creek with
impacts to the eastern bank of Tassaj ara Creek above and below the ordinary high water
line. The outfall will consist of a 9 x 20 x 12 foot concrete structure. Sheet pilings will
be installed just above the ordinary high water line to providc a footing for the outfall.
Three concrete chambers have been designed to dissipate water velocity from storm water

Two settling ponds have been dcsigned outsidc tbe riparian cOlTidor, outside of CDFG
jurisdiction, to capturc nmoff hom the development. Waters from the detention pond site
will discharge to a larger basin and finally into the outfall culvert. The settling ponds arc
50 feet wide by 100 feet long each. These two ponds are prescribcd with yearly
maintenance to remove sediment.
6. PURPOSE:
Thc Project will provide housing for the community of Dublin as provided for in the
Dublin General Plan EIR. The installation of an outfall structure will provide a stable
means to discharge treated stonl1 waters into thc Creek channel and avoid scouring or
erosion. The sediment ponds will rcduce the particulate matter that enters the Creek
chalmel prior to dischargc.
7. DISCHARGE OF DREDGE OR FILL MA TERlAL:
The construction of the outlet structure will rcquire work on the bank of the Creek
including impacts above and below the ordinary high water (OHW) line. To install the
concrete outfall structure, a 240 square foot (0.006 acre) area will be impacted above the
OHW. Approximately 95 cubic yards of bank material will be removed in the process.
Bclow the OHW rock rip rap will occupy an area of approximately 75 square feet (0.001
acre). A 1-3 foot depth of rip rap will be installed ovcr a length of 15 feet. Thc rock may
extend into the chalmel as far as 5 feet. Erosion control fabric will be installed over the
rock rip rap. Approximately 3-5 cubic yards ofthe channel below the OHW will be
impacted to install the rip rap matelial.
8. HABITAT IMPACTS:
A total of 0.007 acres of impact to the Creek channel and embankment is proposed to
install the outfall structure. The bank of the Creek supports limited willow vegetation
and non-native atmual grasses. The Creek channel does not support aquatic vegetation
due to annual scouring and cattle grazing and watering. The outfall structure is
positioned between a break in the willow riparian vegetation, but construction may
require the trimming of trees to accommodate equipment access to the work area. All
herbaceous vegetation will be removed to construct the ontfall and limited ripalian
vegetation removal will oceur only as necessary.
9. NATIONWIDE PERMIT QUALIFICATIONS:
This project qualifies for authorization of Natiol1wide Pem1it 7 (Outfall Structures and
Maintenance) from the U.S. Am1Y Corps of Engineers.

The Mission Peak Property is located on the east side ofTassajara Road, north of the City of Dublin. The Property is found
approximately 2.5 miles north of the Highway 580 and Tassajara Road interchange. The site is situated at the fIrst bend in the
road way where it curves east to cross over the Tassajara Creek tributary_ The Property is located in Alameda County, just south
of the Contra Costa/Alameda County line. The tributary to Tassajara Creek forms the northwestern boundary oftbe site,
Tassajara Road forms the western border, and fence lines form all other boundaries.
13. DIRECTIONS TO THE SITE
Take the Tassajara/Santa Rita Road exit from Highway 580 in
Dublin. Drive north on Tassajara Road 2.5 miles. The site is
on the east side ofTassajara Road at it's fIrst bend.
14. PROJECT PURPOSE (6escrib; the reason or PlJrpos~lurlhc overall project. See inst~~(ion~~-
The purpose of the Project is to develop residential housing consistent with the approved General Plan developed and approved
by the City of Dllblin. Housing demands in the region and the provisions of the Dublin General Plan EIR provide for the
development of single family home subdivision on the subject Property. The purpose of the outfall structure associated with the
development of the site is to meet regulato.ry agency requirements for regulated discharges to \vaters of the U.S. The outfall will
allow for the contTolled discharge of water into the tributary to Tassajara Creek. Rock riprap placement would be required to
dissipate outflow energy and protect the outfall structure from erosion.
15. DESCRIPTION OF ACTIVITY AND ENVIRONMENTAL IMPACTS (Provide a full. technically accurate desaiption of the entire activity and associated environmental impacts. See
instructions)
Grading of the 23.4 acre development area will occur in the southwestern comer of the site where home sites and roadways will
be installed. The Project v..rill involve the construction of an outfall structure to Tassajara Creek with impacts to the eastern creek
bank above and below the ordinary high water line. The outfall will consist ofa 9 x 20 x 12 foot concrete structure. Sheet
pilings will be installed just above the ordinary high water line to provide a footing for the outfall. Three concrete chambers
have been designed to dissipate water velocity fTom storm water discharges. One chamber includes rock and 1/4 ton rip rap to
slow water fiow as it enters the creek channel at the ordinal)' high water line. The outfall will also include work below the
ordinal)' high \vater line of the Creek where a rock rip rap protection apron and coir fabric will be installed. The bank protection
will be installed over a J 5 foot wide length of channel and extend 5 feet below the ordinary high water line.
Two settling ponds have been designed outside the riparian corridor, outside ofRWQCB jurisdiction, to capture runoff from the
development. Waters from the detention pond site will discharge to a larger basin and finally into the outfall culvert. The
settling ponds are 50 feet wide by 100 feet long each. These two ponds are prescribed with yearly maintenance to remove all
potential accumulatd sediment.
16. AVOIDANCE OF IMPACTS (Describe efforts to avoid Clnd minimize impacts to waters of the State. See instructions.)
The project has been designed to minimize the impact area by limiting development to the--[]atest regions on the site. The
steeper hillsides have been preserved for special-status and common \vildlife species habitat. Those areas that are lrnown
breeding habitat for special-status species have been buffered from the development site by prescribed setbacks. A 100-foot
buffer has been established along the Creek corridor, a 200-foot setback has been established from known Califomia red-legged
frog breeding sites, and a laO-foot setback has been established from a knO\VI1 California tiger salamader breeding pond. One
California red-legged frog breeding pond has been designed at the top of the creek bank, just outside the riparian areas. In
addition, a permanent concrete exclusion fence has been designed to sunoW1d the entire development area such that the t\,,:o
special-status amphibians can not enter the site during or after constuction. Riparian revegetation win occur along the creek
corridor and cattle exclusion will result from development project.

Two settling ponds have been designed outside the riparian corridor to capture runoff from the development. \Vaters from the
detention ponds will discharge to a larger constructed wetland and finally into the outfall culvert. The settling ponds afe 50 feet
wide by 100 feet long each. These two ponds are prescribed with yearly maintenance to remove sediment. The speed of water
flow will be reduced prior to entering the creek and water will be filtered through this series of detention basins that will result in
the settling of fines and other sediments. The construction of the outfall and detention basins (outside of regulatory jurisdiction),
will provide for the maintenance of high water quality within the Tassajara Creek system. Approximately 0.14 acres of Con-
structed wetlands will be constructed within the larger water quality basin along the top of the bank to mitigate the 0.001 acre of
impact to the tTibutary to Tassajara Creek, Mitgation has also been specified for the special-status amphibians within a
Biological Assessment Report for the project. . /
