Acceptance of Work - Park Improvements and Parcel "J" of Tract
6925 within Dublin Ranch Phase I - Ted Fairfield Park

2) Adopt Resolution accepting the completed Park improvements,
Dublin Ranch Phase I and accept dedication of Parcel "J", Tract
6925.
3) Authorize Staff to accept a maintenance bond in the amount of
$352,728 at a future date.
FINANCIAL STATEMENT:
A maintenance bond in the amount of $352,728 to guarantee against
defects will be provided to the City at a future date. The City
currently has a $1,410,910 surety bond which will be relinquished
when the maintenance bond is received. The City will incur Park
maintenance costs and sufficient funds are available in Fiscal Year
2001-02 to assume the maintenance of these improvements
DESCRIPTION: In August 2001, the City Council authorized partial acceptance of
Ted Fairfield Park in the Dublin Ranch Phase I Development per the approved Improvement Developer
Agreement between the City and MSSH Dublin Development, LLC (developer). At that time one area of
the park remained to be completed including; the children's play area and adjacent plaza. The Developer
has completed these facilities to the satisfaction of City Staff with the exception of one item that requires
remediation to meet code. This item, a ramp approximately two feet long, is currently being constructed
and will be completed before the next Council Meeting on April 16, 2002.
Staff is requesting that Council authorize the City Manager to accept all final improvements pending
completion of the remaining item to allow the park to be opened to the public and for the City to hold the
Park Dedication scheduled for April 13, 2002.

The final dedication of the park area parcel to the City together with improvements was conditioned as
part of the approval of Dublin Ranch Tract Map 6925. The improvements were further outlined in
September 2000, in the City Council approved Improvement Developer Agreement between the City and
MSSH Dublin Development, LLC (developer) to construct the Park in the Dublin Ranch Phase I
Development adjacent to the future school site. The improvements include the construction of a five-acre
neighborhood park with a ball field, soccer field, play area, basketball court and surrounding landscaping.
This park fronts Antone Way on the South.
The City presently holds a performance bond in the amount of $1,410,910 to provide the necessary
security for the performance of the work involved. As the work is now completed, the performance
security requirement can be reduced, in accordance with authority contained in Section 66499.7 of the
Government Code, to an amount necessary to guarantee warranty of the work for a one-year Period
following acceptance of the work. The Developer may provide a new maintenance bond in the amount of
$352,728 which is 25% of the original bond required, and which is sufficient to cover the one-year
guarantee period, or may leave the performance bond in place.
In addition, the restroom facilities in the Pump Station Building constructed by DSRSD are also complete
and ready for public use. The remaining Pump Station Building is completed but will not be fully
operational until the reservoir tank under construction in the hills above the park is also completed. .
Recommendation:
It is the recommendation of Staff that the City Council take the following action:
1) Authorize the City Manager to accept the final park improvements pending completion of the
remaining minor remediation;
2) Adopt Resolution accepting the completed Park improvements, Dublin Ranch Phase I and accept
dedication of Parcel "J", Tract 6925;
3) Authorize Staffto accept a maintenance bond in the amount of $352,728 at a future date.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING PARK IMPROVEMENTS AND DEDICATION OF PARCEL "J", TRACT 6925
WITHIN
DUBLIN RANCH PHASE 1
WHEREAS, the owner-subdivider of Tract 6925 previously entered into a contract with the City
of Dublin to improve the section of Park fi.onting Antone Way in accordance with plans and specifications
onfile with the City' Engineer and dedicate 5 acres of Park parcel, Parcel "J" of said Tract 6925 identified
as follows:

WHEREAS, said improvements have been completed in accordance with said plans and
specifications, and anY approved modifications thereof, to the satisfaction of said City Engineer of the
City of Dublin; and
WHEREAS, as a condition of said contract, subdivider is required to guarantee the improvements
for a period of one year following acceptance of the work by the said City of Dublin; and
WHEREAS, as imprOvements are now completed, the original performance bond security
requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the
Government Code of the State of California, to an amount found necessary to guarantee maintenance
of the completed work for the aforesaid one-year period; and
WHEREAS, the Final Map for Tract No. 6925, in the incorporated territOry of the City of Dublin,
County of Alameda, State of California, was accepted by the City Council on June 16, 1998, all in
accordance with the provisions of the Subdivision Map Act of the State of California and the City of
Dublin Municipal Code; and
WHEREAS, MSSH Dublin Development LLC, has made an offer of dedication to the City of '
Dublin Parcel "J" of Tract 6925, which encompass the Park area adjacent to Antone Way;
NOW, THEREFORE, BE IT RESOLVED that:
The improvements completed within the said Park parcel be, and they are hereby approved
and accepted subject to the aforesaid one-Year guarantee; and

The aforesaid original performance bond security requirement may be reduced from the
amount of $1,410,910 to an amount of $352,728, upon acceptance by Staff of the
replacement maintenance bond as security for the aforesaid one-year maintenance period;
and

The said original performance bond in the amount of $1,410,910 posted in connection with
the work involved in the construction of said Tract be herebyreleased upon acceptance of
said maintenance bond.
The said Parcel "J" of Tract 6925 as offered to the public is hereby accepted; and that the
Clerk of this City Council be and is hereby directed to transmit a certified copy of this
resolution to the County Recorder for filing.
