ADOPTING A MITIGATED NEGATIVE DECLARATION, STATEMENT OF
OVERRIDING CONSIDERATIONS AND MITIGA nON MONITORING PLAN
FOR THE FALLON CROSSING PROJECT
PA 04-016
WHEREAS, Standard Pacific Homes has requested annexation to the City and DSRSD, and
approval of a Planned Development prezoning and related Stage 1 Development Plan on a vacant 67 8
acre site known as the Mission Peak property and located northeast ofthe intersection of Tassajara Road
and Fallon Road. The residential project consists of 103 single-family detached homes on 19.5 acres of
the site and a I-acre linear park. The annexation and prezoning request also includes the 6 17 acre
Fredrich property The annexation and prezoning requests are collectively referred to as the "Project" or
"Fallon Crossing project", and
WHEREAS, the Project site is located north of the Pinn Brothers/Silveria Ranch residential
subdivision on the east side of Tassajllra Road, which is currently under construction, and southeast of the
Dublin Ranch West/Wallis residential project on the west side of Tassajara Road. Other surrounding land
uses include vacant agricultural land to the north, west and east; and
WHEREAS, the Project site is in Eastern Dublin for which the City adopted the 1993 Eastern
Dublin General Plan Amendment and Specific Plan to provide a comprehensive planning framework for
future development in the area. In connection with this approval, the City certified a program EIR
pursuant to CEQA Guidelines section 15168 (SCH No. 91103064, Resolution 51-93, hereafter "Eastern
Dublin EIR") that is available for review in the City Community Development Department and is
incorporated herein by reference. The Eastern Dublin ElR was integral to the planning process and
examined the direct and indirect effects, cumulative impacts, broad policy alternatives, and areawide
mitigation measures for developing Eastern Dublin. The Eastern Dublin EIR identified significant
unavoidable impacts from development of Eastern Dublin, some of which would apply to the Project.
Pursuant to the Communities for a Better Environment case, any Council approval of the project must be
supported by a new Statement of Overriding Considerations with respect to these previously identified
impacts; and
WHEREAS, the Eastern Dublin EIR identified potentially significant environmental impacts and
related mitigation measures, which the City adopted together WIth mitigation findings and a Mitigation
Monitoring Program (Resolution 53-93) The mitigation measures and monitoring program continue to
apply to development in Eastern Dublin, and
WHEREAS, the City prepared an Initial Study dated February 9, 2006 for the Project consistent
with CEQA Guidelines section 15162 to determine if additional environmental review would be required
beyond the previously adopted Eastern Dublin EIR. Based on the Initial Study, the City prepared a
Mitigated Negative Declaration dated February 14,2006 ("Draft MND"). The Draft MND is a separately
bound document available at the Dublin Community Development Department and is incorporated herein
by reference, and

WHEREAS, the Draft MND was circulated for public review from February 14, 2006 to March
16,2006 The City received two letters commenting on the Draft MND; one additional letter was
received after the close of the public comment period. Although not required by CEQA, the City
prepared written responses to the comments. The comment letters and related responses are attached as
E;lhibit A, and incorporated herein by reference; and
WHEREAS, the Draft MND, the three comment letters and related responses collectively
comprise the Mitigated Negative Declaration ("Mitigated Negative Declaration") for the Project; and
WHEREAS, a staff report, dated April 25, 2006 and incorporated herein by reference, described
and analyzed the Mitigated Negative Declaration and the Project for the Planmng Commission; and
WHEREAS, the Planning Commission reviewed the staff report and the Mitigated Negative
Declaration at a noticed public hearing on April 25, 2006, at which time all interested parties had the
opportunity to be heard, and approved Resolution 06.11 recommending adoption of the Mitigated
Negative Declaration, which resolution is incorporated herein by reference; and
WHEREAS, a staff report dated May 16, 2006, and incorporated herein by reference, described
and analyzed the Mitigated Negative Declaration and the Project for the City Council, and
WHEREAS, the City Council reviewed the staff report and the Mitigated Negative Declaration at
a noticed public hearing on May 16, 2006, at which time all interested parties had the opportunity to be
heard, and
WHEREAS, the location and custodian of the Mitigated Negative Declaration and other
documents that constitute the record of proceedings for the Project is the City of Dublin Community
Development Department, 100 Civic Plaza, Dublin, CA 94568, file P A 04-016
NOW, THEREFORE, BE IT RESOLVED that the foregoing recitals are true and correct and
made a part of this resolution.
BE IT FURTHER RESOLVED THAT the Mitigated Negative Declaration consists of the Draft
MND dated February 14, 2006, and the three comment letters and related responses, attached as Exhibit
A.
BE IT FURTHER RESOLVED THAT the City Council hereby finds as follows.
A. The City Council reviewed and considered the Mitigated Negative Declaration prior to approving
the Project.
B. The Eastern Dublin ElR and the Mitigated Negative Declaration adequately describe the impacts
of the Project. Project specific environmental effects have been analyzed in the Initial
StudyIMitigated Negative Declaration which determined that the Project will not have a
significant effect on the environment with the application of mitigation measures identified in the
Eastern Dublin EIR and the Mitigated Negative Declaration. There is no substantial evidence in
light of the whole record before the City that the Project as mitigated will have a significant effect
upon the environment.
C The Mitigated Negative Declaration has been completed in compliance with CEQA, the CEQA
Guidelines and the City of Dublin Environmental Guidelines.

D The Mitigated Negative DeclaratIon is complete and adequate and reflects the City's independent
judgment and analysis as to the environmental effects of the proposed annexation and prezoning

BE IT FURTHER RESOLVED that based on the above findings, the City Council adopts the
Mitigated Negative Declaration for PA 04-016, as described above, including the mitigation measures
identified therein.
BE IT FURTHER RESOL VED that the City Council adopts the following Statement of
Overriding Considerations for significant unavoidable impacts identified in the Eastern Dublin EIR that
apply to the Project.
Statement of Overriding Considerations
1. General. Pursuant to CEQA Guidelines section 15093, the City Council of the City of Dublin adopted
a Statement of Overriding Considerations for those impacts identified in the Eastern Dublin EIR as
significant and unavoidable. (Resolution 53-93, May 10, 1993) The City Council carefully considered
each impact in its decision to approve urbanization of Eastern Dublin through approval of the Eastern
Dublin General Plan Amendment and Specific Plan project. The City Council is currently considering the
Mission Peak and Fredrich annexation and prezoning project, PA 04-016. Although the City Council
adopted a Statement ofOveniding Considerations with the original land use approvals for urbanization of
Eastern Dublin, pursuant to a recent court decision, the City Council hereby adopts specific overriding
considerations for the Project. I
The City Council believes that many of the unavoidable environmental effects identified in the Eastern
Dublin EIR that are applicable to the Project will be substantially lessened by mitigation measures
adopted with the original approval and by mitigation measures adopted through the Project. Even with
mitigation, the City Council recognizes that the implementation of the project carries with it unavoidable
adverse environmental effects as identified in the Eastern Dublin EIR. The City Council specifically finds
that to the extent that the identified adverse or potentially adverse impacts for the Project have not been
mitigated to acceptable levels, there are specific economic, social, environmental, land use, and other
considerations that support approval of the Project.
2. Unavoidable Sienificant Adverse Imnacts. The following unavoidable significant environmental
impacts identified in the Eastern Dublin EIR for future development of Eastern Dublin apply to the
annexation and prezoning project.
Land Use Impact 3 IfF Cumulative Loss of Agricultural and Open Space Lands; Visual Impacts 3 8/B,
Alteration ofRuraVOpen Space Character and 3 8!F, Alteration of Visual Character of Flatlands. Future
development of the vacant Project site will contribute to the cumulative loss of open space land.
Traffic and Circulation Impacts 3.3/B, 33!F 1-580 Freeway, Cumulative Freeway Impacts: Future
development of the Project will contribute to the unavoidable freeway impacts identified in the Eastern
Dublin EIR.
Community Services and Facilities Impact 3 4/S. Consumption of Non-Renewable Natural Resources and
Sewer, Water; and Storm Drainage Impact 3. 5!F, H, U Increases in Energy Usage Through Increased

Water Treatment, Disposal and Operation of Water Distribution System: Future development of the
Project will contribute to increased energy consumption.
Soils, Geology, and Seismicity Impact 3 6/B Earthquake Ground Shaking, Primary Effects: Even with
seismic design, future development on the Project site could be subject to damage from large earthquakes.
Air Quality Impacts 3 IliA, B, C, E. Future development of the Project will contribute to cumulative
dust deposition, construction equipment emissions, mobile and stationary source emissions.
3. Overridinl! Considerations. The City Council previously balanced the benefits of the Eastern
Dublin project approvals against the significant and potentially significant adverse impacts identified in
the Eastern Dublin EIR. The City Council now balances those unavoidable impacts that apply to future
development on the Project site against its benefits, and hereby determines that such unavoidable impacts
are outweighed by the benefits of the Project as further set forth below
The Mission Peak portion of the Project would result in construction of housing, thereby increasing the
City's housing opportunities as envIsioned 10 the General Plan and its Housing Element, and also
providing construction jobs. The Mission Peak design accounts for sensitive topographic and biological
resources on the site by locating the residences in flatter areas near Tassajara Road and retaining
approximately two-thirds of the site in open space. Annexation and prezoning of the Fredrich site is
consistent with the goals of the General Plan and Eastern Dublin Specific Plan for future development
based on City and urban level services.
BE IT FURTHER RESOLVED that the City Council adopts a Mitigation Monitoring Plan dated
April 2006, attached as Exhibit B and incorporated herein by reference.

Reference is made to your transmittal of February 14, 2006, of the Notice of Intent to Adopt a
Mitigated Negative Declaration for the Fallon Crossing Development Project, located on
approximately 67.R acres ofland on the east side of Tassajara Road and 7.9 acres ofland on
the west side of Tassajara Road, south of the Alameda-Contra Costa COWlty line in
Wlincorporated Alameda County
We have revicwcd the submitted document and offer the following comments:
From this, and other proposed development projects along Tassajara Road it appears that
the entire length ofTassajara Road within Alameda COWlty is to be annexed by the City of
Dublin. V crifY that annexation will not leave short sections of T assajara Road in the
unincorporated County area.
2. Restoration/repair of County roadways due to damage caused by construction traffic will
be required. Truck haul routes need to be designated.
3. Although the project site is located in Zone 7, runoff ultimately drains to the Alameda
Creek Federal Project in western Alameda County This flood control facility is
maintained by the Alameda COWlty Flood Control District. The District is concerned with
augmentation in runoff from the site that may impact flow capacity in the Federal Project
and in the watercourses between the site and the Federal Project, as well as the potential
for runoff wm the project to increase the rate of erosion along those same watercourses
that could cause localized damage and result in deposition of silt in the Federal Project.
There should be no augmentation in runoff quantity or duration from the project site that

will adversely impact downstream drainage facilities. The District should be involved in
the review of the project hydrologic and hydraulic models, including the design of any
detention ponds that may be necessary

Dear Ms. Harbin:
Zone 7 has reviewed the rcfcrenced CEQA document in the context of Zonc Ts mission to provide
drinkmg water, non-potable water for agriculture and irrigated turf, flood protection, and groundwater and
stream management within the Livermore.Amador Valley Ollr comments arc as follows.
Therc is an inconsIstency in the Hydrology and Water Quality section ofthe IS/MND between the
dcten11ination that the projcct may have an either direct or mdirect physical impact un hydrology and
water quality and the level of significance of the impaDt. Per item 3 under the Evaluation of
Environmcntal Impacts on the suggested CEQA Environmental Checklist Form (see Appendix G of the
CEQA Guidelines), it states the following:

Therefore, a "No hnpact" determination demonstrates that the project will not have an either direct 01'
indin;ct physical impact to the enVIronment, in this case on hydrology and water quality, and would not
require mitigation. In thIS section ofthe enviromnental checklist, the "No hnpact" hox was checked for
all items. TIm is inconsistent with the detailed analYSIS provided in the ISIMND as some ik'TI1S have
mitigation measures associatcd with them indicating that there is an impact that rcgenres mitigation.
As an example, on page 93, under item (d), it states that "the project would reqUlrc l,'tading that would
change and alter existmg drainage pattenlS on the sIte and would increase thc amount and rate of surface
water runoff that could result in flooding on and off-site" The project proposes installing a detention
basin to minimize the potential for downstream flooding and to meet the water quality requirements of the
Alameda CountYWIde Clean Water Program s NPDES permit. Without this detention basin, the proposed
project will have a potentially sil,'TIificant impact on items (a), (c), (d), (el, and If) on the checklist.
Therefore, the detention basin IS also a mitigation measure, in addition to the mitigation measures listed in
the IS/MND, that would potentiall~ change the impact from potentially significant to "less than
sigmficant with mitigation incorporated"
Thoughout the ISIMND, a description ofthe proposed size and intended function of both the detention
basin and outfall structure is provided. In the last paragraph on page 93, it states that the detention basin
will dIscharge into the ummmed tributary via the outfall at the samc rate as the existing pre-proj ect
discharge rate. It further states that the downstreanl facilities including Tassajara Creek and proposed

Zone 7 projects adequately handle the existing rate; therefore, there is "No Impact." 111e ISIMND does
not provide supporting information such as, but not limited to the following: how much water and under
what storm conditions thc basm and outfall are designed for li.e. 2., 50-, or 100-year storms); the existing
discharge rate; when and under what conditions discharges will OCCUT; and flow of the unnamed tributary
under a I OO.year storm event. The IS/MND does not provide the supporting hydrolugylhydraulic
documentation for the design and fun chon uf the detention basin and outfall structure that leads to the
"Nu Impact" determination or even a "less than significant with mihgatlOn incorporated" determination.
The Developer should be required to submit proposed plans and supporting reports, data, and infommtion
for aU its flood and storm water relatcd improvements for Zone 7 review and approval.
The validity of any existing hydrologylhydraulic or dramage studies performed as part ofthe Eastern
Dublin Specific Plan, may require additional assessment. Since the adoption ofthe Eastern Dublin
Specific Plan, Zone 7 has been working On the Stream Management Master Plan (SMill), which is an
update to Zone 7's 1966 Flood Control Master Plan. Recent findings in the development of :Zone 7's
SMMP indicate the need for consideration and analysis ofthe impacts of development to the regional
flood control system and the identification of appropriate mitigations. Developers may need to provide
hydrologic and hydraulic studies to study the cffects of increased 11ll10ff in the larger euntext of Zone 7' s
regional floud cuntrol system and plan for regional water storage. Therefore, during the interim period,
before full implementation of the regional wat~']" storage plan contemplated by the SMMP, the Developer
should consult with Zone 7 prior tu undertaking the impact and mitigation analySIS. Future improvements
tu thc flood control system are planned, thus, it is imperative that thc Dcveloper provide a technical
analysis to identifY any impacts to the regiolJal fluud cuntrul system that may OCCUT dOWllslrcam of
proposed project in the interim penod.
The remaining comments are clarification commcnts un the remaining IS/MND document.
Throughout the ISIMND, nomenclature of the basin alternatcs bctwcen detention and retention basin. As
an example, in the last paragraph on page 2, a detention basin is proposed. Howcver, th.e following
sentences go on tu describe the basin as a retention basin. There is an inconsistency between description
of the basin's function and the terminology used. A detention hasin is used to hold water for release at a
later pcnod; whereas a rct~'llhon basin keeps all water onsile. Based On the description of how the basin
t\.mctions, this hasin is a detention basin and this term shuuld be utilized throughout the ISIMND
On page 89, the last sentence of the second paragraph states that "Zune 7 of the Alameda County Flood
Control and Water Conservation District is presently finalizing plans to store treated wastewater within
thc aquif~']" during winter months, which would be pumped out and used for landscape irrigation during
dry, summer months." Zone 7 does not have any plans to store treated wastewater within the aquifn
This statement is incorrect and must bc delct.cd.
The first sentence on page 90 and Mitigation Measures 64 and 65 on page 91 states the project shall meet
the water quality requirements of the City of Dublin NPDES permit and the Alameda County Urhan
Runoff Clean Water Program. The water quality requirements that the project must mcct are that of the
Alamcda CountyWIde Clean Water Program NPDES Municipal Stonnwatcr Permit, in which the City of
Dublin ;s a co-permittee. It is recommend that the first scnt.cnce on page 90 and two mitigation measures
be combined to reflect this clarification.

On page 91, last para~'faph under item (b), it states that the project developer would be requircd by
DSRSD to pay drainage and flood control fees as a mihgation for groundwater recharge Impacts of the
project. Thc proposed project will be suhject to Zone Ts Special Area Drainage 7-1 (SDA 7-1) fees that
are asscssed by Zone 7, not DSRSD The SDA 7-1 fees are meant to mitigate for creation of impervious
surfacc arca only The SDA 7-1 fee does not does not mitigate groundwater recharge impacts; therefore,
this paragraph is incurrect and must be delcted.
On page 92, Mitigation Measure 66 states that "The project develuper shall submit a preliminary creek
alignment plan to the resource agencies for the realignment of Tassajara Creek prior to approval of the
project by the City" Developer shall be required to submit proposed plans and supporting reports, data,
and infonnation for this realignment plan and similar plans for Zone 7 review and approval in addition w
the appropnate Federal and State regulatory agencies with jurisdiction.

SB221 Verification of Sufficient Water Supply

This letter provides SB221 verification of sufficient water supply from the Dublin San Ramon
Service~ Di~trict roSRSD) for service to Tract 7586 in Fallon Village.
The Project is induded in the Distnct's Urban Water Managcment Plan and Water Master Plan.
DSRSD does have thc capability to provide water service to Tract 7586 in Fallon ViUagc. The
providing of services is contingent on installation of water and sewer infrastructure, payment of
fees, and satisfaction of all requirements contamed in the District Codc and implementing
DIstrict Master Plans, policies, and ordinances.
The District's 2005 Urban Water Managcment Plan Update (UWMP), which was adoptcd by our
Board at its May 17, 2005 meeting, includes detailed 'Water servicc analysis for Tract 7586 of the
Fallon Village Development Project. Thc vcrification of sufficient water supply included in the
lJWMP meets the reqUIrements of SB221 The District's water supply IS documented in Section
4.0 of the UWMP. Historical and projected demands arc documented in Section 6.0 Water
supply and demand comparisons were conducted in Section 7.0. The comparisons include
supply and demands for normal, dry, and multiple dry years. The UWMP indicates that the
projected water supply is sufficient for Tract 7586 in Fallon Village. The District can providc
service to the project without significantly and adversely affecting the reliability of watcr service
to the DIstrict's cxisting customers. The UWMP was distrihuted to the City of Duhlin, City of
Livermore, Citizens for Balanced Growth, and othcr parties associated with the "Agreement to
Settle Water Litigation By and Between Zone 7 Water Agency, Dublin San Ramon Services
District, et. al." The District has received no opposition to the UWMP

Section 15097 of the Calitornia Environmental Qoality Act (CEQA) requires all stale and local
agencies to establish monitorin~ or reporting programs for projects approved by a public agency
whenever approval involve..", the adoption of either a \~mitigated negative declaration" or specjfied
rnvirunm~ntal finding..;; related to environmental -impact reports.
This is the Mitigation Monitoring Plan (MMP) for Fallon Crossing project. It has been prepal'ed
pursuant to the requirements of Public Resource; Code 921081.6 which, llJUoug other things, states
. that when a governmental agency adopts or certifies a CEQA document that. contains the
environmental review of a proposed proiect, "The public a~erlCy shall lldopl II reporting or
monit.oring program for the:: chang-c.r,; made to the project or conditions of project approval~ adopted

During construction of the Fallun Crossing pruject, the City will assigo an inspector who will he

City's Conununity Development Department and be thoroughly familiar with permit conditions and
the Ml\1.P In addition, the inspector will be familiar with constructiun uuntract requirements,
constl'uction schedulesl standard construction practices, and mitigation techniques, 111 order to traek
the statuS of mitigation mea....ure imp lcmcntation, field-monitoring activities wilt be du{;umented on
compliance munitoring report worksheets. The time commitment of the inspector will vary
depending on tht: intrnsity i:IJ1d location of construction. Aided by the attached table, the inspector
will be responsible for the following activities:
. On-site day-to-day monitoring of constructjon activities;
. Review construction plans and equipment staging! access plans to ensure confurmance
with adopled mitigation measures;
. Ensuring contractor knowledge of and compliance with the MMP;
. Verifying thc accuracy and adequacy of contract wording;

The inspector shall have the ability and authority to secure compliance with the Ml\1P;
