Home My WebLink AboutReso 82-06 Zumwald Engineering Amend Agmt RESOLUTION NO. 82 - 06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN . * * * * * * * * APPROVING AMENDMENT TO AGREEMENT WITH ZUMWALT ENGINEERING GROlJP FOR ENGINEERING SERVICES WHEREAS, the City of Dublin, State of California, entered into a two-year agreement with Zumwalt Engineering Group on July 20, 2004, to perform general engineering services; and WHEREAS, the term of the agreement is proposed to be extended until June 30, 2008, allowing Zumwalt Engineering Group to request an adjustment of rates for the second year of the term; and WHEREAS, Consultant is requesting an adjustment of rates for Fiscal Year 2006-2007 as allowed by Section 2 of the Agreement; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve the amendment to the agreement with Zumwalt Engineering Group, which is attached hereto as "Exhibit A." BE IT FURTHER RESOLVED that the Mayor is authorized to execute the amendment to the Agreement. PASSED, APPROVED AND ADOPTED this 6th day ofJune, 2006, by the following vote: AYES Councilmembers Hildenbrand, McCormick, Oravetz and Zika, and Mayor Lockhart NOES None ABSENT None ABSTAIN None A~6)tA ~ City Clerk Reso 82-06, Adop1ed 6/6/06, Item 4.6 Page] of 1 EXHIBIT "A" OF RESOLUTION ~-06 AMENDMENT TO AGREEMENT BETWEEN CITY OF DUBLIN AND ZUMWALT ENGINEERING GROUP FOR ENGINEERING SERVICES WHEREAS, the City of Dublin (hereinafter referred to as "CITY") and Zumwalt Engineering Group (hereinafter referred to as "CONSULTANT"), entered into a two-year agreement on July 20,2004, to provide engineering services to CITY, and WHEREAS, the City and the Consultant wish to extend the term of agreement for an additional two years, terminating June 30, 2008, WHEREAS, Consultant has requested an adjustment of rates for Fiscal Year 2006-2007; NOW, THEREl?ORE, the parties hereto agree as follows: Extension of Term The term of the agrecment shall be extended from July l, 2006, to June 30, 2008. Should a new agreement or amendment to agreement to cxtend the contract not be entered into by June 30, 2008, then this agrcement will automatically extend until a new agreement or amendment to agreement is cntered into or City gives written notice oftermination. OUTSIDE SERVICES Invoice cost of services and expenses cbarged to Zumwalt Engineering Group by outside consultanlS, profes.ional, or technical firms engaged in connection with th.e order, plus 15% handling charge. D. MISCELLANEOUS EXPENSES 1 The invoice co.t of materials, .upplies, reproduction work, and other .ervices procured by Zumwalt Engineering Group from outside SOUl'CeS, plus a handling charge of 15%.
