HomeMy WebLinkAboutReso 147-06 Dougherty Rd Improvements Parcel D RESOLUTION NO. 147 - 06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* FINDING THAT PARCEL "D" IS AN UNECONOMIC REMNANT PARCEL, DECLARING THIS PARCEL SURPLUS, AND AUTHORIZING SALE OF PARCEL "D" WHEREAS, it is necessary for the City of Dublin to widen and improve the intersection of Dublin Boulevard and Dougherty Road as part of Capital Improvement Program Project No. 96852, Dougherty Road Improvements - Houston Place to 1-580; and WHEREAS, as part of the right-of-way negotiations with the owner of the parcels at 6363 through 6451 Scarlett Court for the City's purchase of portions of those parcels, the City needs to agree to sell to the adjacent property a small remnant parcel of land; and WHEREAS, this adjacent parcel, designated as Parcel "D", is a small (1,193 square feet) parcel left over from the property formerly known as "The Dublin Boat House" acquired to extend Dublin Blvd. east of Dougherty Road to the eastern expanding environs of Dublin; and WHEREAS, no utilities have been placed in this Parcel "D" and the City has no other use for the property; and WHEREAS, the adjacent property owner desires to add this parcel to his proposed development and has agreed to pay $40.65 per square foot for the Parcel "D" which amount is the same per square foot cost that the adjacent owner paid for the acquisition of the adjacent parcel; and WHEREAS, the City's Municipal Code allows the City Manager to sell a parcel that is an uneconomic remnant which is not buildable and cannot be utilized on its own under current zoning without advertising for bids, with City Council approval to an adjacent property owner; NOW, THEREFORE, BE IT RESOLVED that the City Council declares that Parcel "D" (at the southeast comer of Dublin Blvd. and Scarlett Court) is surplus and finds that Parcel "D" is an uneconomic remnant parcel that cannot be utilized on its own under current zoning. BE IT FURTHER RESOLVED that the City Council approves the sale of Parcel "D" to the adjacent property owner, KBH Investments, LLC, at a per square foot price of $40.65 and a total price of $48,495.00. BE IT FURTHER RESOLVED that the Mayor is hereby authorized to sign the Quit Claim Deed on behalf of the City of Dublin. QUITCLAIM DEED The City of Dublin, a municipal corporation ("CITY"), does hereby release and quitclaim to KBH Investments LLC, a California limited ,liability company e:KBH"), all right, title. and interest in and to all that real property in the City of Dublin, County of Alamed~ State of California, described herein as: Parcel D, as described in Exhibit A and depicted on Exhibit B attached hereto and incorporated by reference hereto. Subject to special assessments if any,'restrictions, reservations and easements of record RESERVING UNTO CITY a non':'exc1usive temporary easement for construction purposes only, and all incidents related thereto, including, but not limited to, the construction of improvements . (the "Temporary Easement"), over and across said Property as described in Exhibit A-I and depicted on Exhibit B-1 hereto and incorporated by this reference. This construction easement is granted solely.in connection with the construction on the Property in accordance with construction plans approved by Grantor (the "Project"). This Temporary Easement shall automatically expire upon the earlier to occur of (2) two years after the recordation of this Quitclaim Deed or (2) the completion of the Project. CITY shall indemnify, protect, defend and hold harmless KBH against all claims, damages, losses, and expenses, arising out of the performance of the work descnoed herein, caused in . whole or in part by any negligent act of omission of CITY, its contractors, and their respective employees and agents, except where caused by the negligence, or willful misconduct of the KBH or other third party.
