HomeMy WebLinkAboutReso 039-02 DubRanTr6925 ParkAI RESOLUTION NO. 39 - 02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING PARK IMPROVEMENTS AND DEDICATION OF PARCEL "J", TRACT 6925 WITHIN DUBLIN RANCH PHASE 1 WHEREAS, the owner-subdivider of Tract 6925 previously entered into a contract with the City of Dublin to improve the section of Park fronting Antone Way in accordance with plans and specifications on file with the City Engineer and dedicate 5 acres of Park parcel, Parcel "J" of said Tract 6925 identified as follows: a) Subdivider: MSSH Dublin Development LLC b) Parcel Location: Southwest comer of North Dublin Ranch Drive and Antone Way c) Resolution Approving Final Map: No. 83-98, City Council of Dublin d) City Streets Affected by this Parcel: None WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of said City Engineer of the City of DUblin; and WHEREAS, as a condition of said contract, subdivider is required to guarantee the improvements for a period of one year following acceptance of the work by the said City of Dublin; and WHEREAS, as improvements are now completed, the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid one-year period; and WHEREAS, the Final Map for Tract No. 6925, in the incorporated territory of the City of Dublin, County of Alameda, State of California, was accepted by the City Council on June 16, 1998, all in accordance with the provisions of the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and WHEREAS, MSSH Dublin Development LLC, has made an offer of dedication to the City of Dublin Parcel "J" of Tract 6925, which encompass the Park area adjacent to Antone Way; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within the said Park parcel be, and they are hereby approved and accepted subject to the aforesaid one-year guarantee; and 2. The aforesaid original performance bond security requirement may be reduced from the amount of $1,410,910 to an amount of $352,728, upon acceptance by Staff of the replacement maintenance bond as security for the aforesaid one-year maintenance period; and 3. ' The said original performance bond in the amount of $1,410,910 posted in connection with the work involved in the construction of said Tract be hereby released upon acceptance of said maintenance bond. 4. The said Parcel "J" of Tract 6925 as offered to the public is hereby accepted; and that the Clerk of this City Council be and is hereby directed to transmit a certified copy of this resolution to the County Recorder for filing.
