RESOLUTION NO. 84-01
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN

APPROVING PA 83-059 BUSICK AIR CONDITIONING
A CONDITIONAL USE PERMIT TO ALLOW THE ESTABLISHMENT OF
TWO OUTDOOR STORAGE YARDS AND TO PERMIT MATERIALS TO BE STACKED
HIGHER THAN THE ENCLOSING 6-FOOT FENCE
WHEREAS, Doreen Green, for Busick Properties has filed
for a Conditional Use Permit to allow the establishment of two
outdoor storage yards and to permit materials to be stacked higher
than the enclosing 6-foot fence, in an M-l (Light Industrial)
District, located at 6335 Scarlett Court, Dublin (APN 941-550-15-
4); and,
WHEREAS, the Planning Commission did hold a public
hearing on said application on November 21, 1983; and,
WHEREAS, the application was continued to allow the
applicant's engineer to provide more accurate survey information
with respect to the location of the existing fence in relation to
the property line; and,
WHEREAS, Staff and the applicant determined, through a
review of existing improvement plans, that the existing fence was
one-half foot back from the property line; and,
WHEREAS, the Planning Commission did hold a second
public hearing on December 19, 1983, to review this new
information; and,
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and
WHEREAS, this application has been reviewed in
accordance with the provisions of the California Environmental
Quality Act and has been found to be categorically exempt; and,
WHEREAS, a Pre-Hearing Staff Analysis was submitted
recommending the application be conditionally approved; and,
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations and testimony as hereinabove set
forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
a) The use is required as there is need for outdoor
storage within the light industrial district
bl The use will be properly related to other land uses
and transportation and service facilities in the vicinity and will
be compatible with present use of properties in the neighborhood;
c) The use, if permitted and as conditioned, under the
circumstances and conditions of this particular case, will not
materially affect adversely the health or safety of persons
residing or working in the vicinity, or be materially detrimental
to the public welfare or injurious to property or improvements in
the neighborhood, as all applicable regulations will be met;
d) The use will not be contrary to the specific intent
clauses or performance standards established for the District in
which it is to be located, and is consistent with the character of
the light industrial district; . .." ,~

BE IT FURTHER RESOLVED that the Planning Commission. does
hereby conditionally approve said application as shown by
materials labelled Exhibit "A", on file with the Dublin Planning
Department, subject to the following conditions:
1. A landscaped buffer, a minimum of 5 feet wide, shall be
installed along the front property line, with the outdoor storage
yard fence being relocated. behind the .landscaping. The buffer
shall contain 15-gallon evergreen trees, 25 feet on-center, 5-
gallon shrubs, and ground cover. The landscaping and irrigation
plan shall be approved by the Planning Department and shall be
installed by April, 1984. A letter of credit, or bond shall be
filed with the City within 30 days, in the amount of $2,000, to
cover the cost of installation of the landscapin~ and irrigation.
2. Curb, gutter, sidewalk, conform paving, street lights, and
street trees shall be installed as acceptable to the City
Engineer. Acceptable improvement plans reflecting said
improvements shall be submitted to the City Engineer within 60
days. Further, a 100% faithful performance bond, and a 50% labor
and materials bond, shall be submitted to the city Engineer within
30 days.
3. No material, equipment, supplies, or vehicles can be stored i~
the Scarlett Court side .storage yard that is over eight (8) feet
high. All materials, equipment, supplies, or vehicles over 6 feet
high shall be stored at least 8 feet away from an enclosing solid
6' high fence, or wall.
4. All fencing, landscaping, and irrigation shall be maintained
in a state of good repair at all times. No refuse, garbage, and
the like, can be located outside the outdoor storage yards unless
it is within an approved trash enclosure.
5. This approval is valid until January 3, 1986, ano 1S subject
to revocation for cause in accordance with Section 8-90.3 or the
Zoning Ordinance.
PASSED, APPROVED AND ADOPTED this 3rd day of January,
1984.
