Written Statement RECOMMENDATION: 1) Open public hearing. 2) Receive staff presentation and public testimony. 3) Close public hearing and deliberate. 4) Adopt Resolution (Attachment 1) approving PA 01-026 Sonic Facilities Group Temporary Parking Lot Conditional Use Permit DESCRIPTION: The applicant is requesting a Conditional Use Permit (CUP), which would allow the temporary parking of employee vehicles on a 1-acre site, located north of the Nissan facility on Scarlett Dr (APN 941-0550- 019-09). The applicant is requesting a maximum duration for the temporary employee parking to be no more than one year, or for the duration of the construction of the Dublin Volkswagen facility, which ever comes first. BACKGROUND: The Planning Commission approved a Conditional Use Permit and Site Development Review to establish a new 24,852 square foot auto dealer for Dublin Volkswagen on November 13, 2001. The new Volkswagen Dealer will be at the comer of Scarlett Drive and Scarlett Court and will replace an existing small building at this location. The Volkswagen Dealer site currently has vehicle inventory parking as well as employee parking for the entire Dublin Auto Center (which includes Hyundai, Volkswagen, and Dodge auto dealers). The construction of the new Volkswagen facility is anticipated to disrupt the project site and displace the existing inventory and employee parking for the duration of the construction period. The applicant has stated that there is adequate space within the Dublin Auto Center to shuffle vehicle inventory around to meet the demands of the three auto dealers. However, given the requirements of employees to have constant access to vehicles, employee parking with uncomplicated ingress and egress is being requested. The project site is located to the north of the Nissan Dealer, along Scarlett Drive.. Currently, Scarlett Drive is improved along the frontage of the Nissan Dealer and will be improved to the north along the frontage of the Arlen Ness project. At the northern property line of the Nissan Dealer the asphalt ends and the unimproved portion of Scarlett Drive continues. On the project site is a concrete pad that remains from the previous use of the property, where the employee vehicles would be parked. The current zoning for the subject property is M-1 (light industrial) requires that the Planning Commission approve a Conditional Use Permit before a vehicle storage use can be established. Conditions of Approval: Listed below are City Departments that have requested conditions of project approval for the temporary parking lot in order to maintain minimum health and safety standards. Police Department has requested that a clear, well-lighted pedestrian pathway will be designated and maintained between either, the Nissan Dealer or the public sidewalk to clearly demarcate employee ingress and egress to the parking facility. Public Works Department has requested a barricade and gate at the terminus of Scarlett Drive to prevent unauthorized vehicles from driving on the unimproved portion of Scarlett Drive. The gate would allow employee vehicles to access the temporary parking facility. Fire Department has requested that no parking of vehicles be allowed beyond 150 feet of the terminus of Scarlett Drive to prevent vehicles from being beyond the reach of water hoses or emergency vehicles in the event of a medical or fire emergency. Noticing: In accordance with State law, a public notice was mailed to all property owners and occupants within 300 feet of the proposed project, to advertise the project and the upcoming public hearing. A public notice was also published in the Tri-Valley Herald and posted at several locations throughout the City. To date, the City has received no contact or objections from surrounding property owners or tenants regarding the current proposal. Use Permit Findings and Duration: Staff has reviewed the project and has determined that the required Conditional Use Permit findings can be made in the affirmative, given the one-year requested time frame. At the conclusion of the one-year period, if the applicant wishes to extend the time period the following will be required to be completed prior to extension: (1) a new Conditional Use Permit application will need to be submitted; (2) a new notice sent to the surrounding property owners and tenants; and (3) the Planning Commission would need to make new CUP findings at a public hearing. ENVIRONMENTAL REVIEW: This project has been found to be Categorically Exempt from CEQA under Section 15301, Class 1 of the California Environmental Quality Act Guidelines. The project consists of minor modifications to an existing building and is consistent with all General Plan and Zoning regulations and currently served by all required utilities and public services. WHEREAS, the applicant Bob Fisher has requested to establish a temporary parking facility located on APN 941-0550-019-09; and WHEREAS, the Planning Commission held a properly noticed public hearing on said application on February 26, 2002; and WHEREAS, the California Environmental Quality Act (CEQA), together with the State guidelines and City environmental regulations require that certain projects be reviewed for environmental impact and that environmental documents be prepared; and WHEREAS, the project has been found to be Categorically Exempt from the Califomia Environmental Quality Act (CEQA), according to Section 15301 (a), Class 1; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above set forth and used his independent judgment to make a decision; and WHEREAS, the Planning Commission has found that the proposed project is appropriate for the subject site. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does find that: 1. The proposed temporary parking lot use is compatible with other land uses, transportation and service facilities in the vicinity, given the temporary nature of the request. 2. The parking lot will not adversely affect the health or safety of persons residing or working in the vicinity, or be detrimental to the public health, safety, and welfare because the project as conditioned will be consistent with minimum adopted public health, safety, and welfare standards, for temporary facilities. Additionally, the one-year time limit on the duration of the temporary parking facility will minimize affects of the health or safety of persons residing or working in the vicinity. 3. The temporary parking lot use, under all circumstances and conditions of this permit, will not be injurious to property or improvements in the neighborhood given the temporary nature of the facility. 4. There are no required provisions for public access, water, sanitation, and public utilities and services given the temporary nature of the facility and therefore the project will not be detrimental to the public health, safety and welfare. 5. The subject site is physically suitable for the temporary parking lot use being proposed. 6. The approval of this Conditional Use Permit, on a temporary basis, is consistent with the Dublin General Plan. AI'I'ACHMENT BE IT FURTHER RESOLVED THAT TIlE Dublin Planning Commission does hereby approve PA 01-026 Conditional Use Permit to allow a temporary, employee only, parking facility to be located on APN 941-0550-019-09, as depicted on Exhibit A, stamped approved and on file, for the period of one year from the date of this approval or at the issuance of Temporary Certificate of Occupancy for the Dublin Volkswagen project, located at 6085 Scarlett Court, whichever comes first. Any requests for extension of time shall be subject to a new Conditional Use Permit application. The project approval shall be subject to compliance with the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the Conditions of Approval: [PL.] Planning, lB1 Building, [PO] Police, [PW1 Public Works [ADM] Administration/City Attomey, [FIN] Finance, IF] Alameda County Fire Department, [DSR] Dublin San Ramon Services District, [CO] Alameda County Department of Environmental Health. o o Only vehicles of the Dublin Auto Center employees are permitted to be parked at this location, no new or used vehicle inventory parking is permitted. [PL] Prior to issuance of the Temporary Certificate of Occupancy for the Dublin Volkswagen project (located at 6085 Scarlett Court and further described by Assessor Parcel Nos. 941-0550-024 and 941- 0550-025), all vehicles and debris associated with the use of the subject property shall be removed. [PL] No vehicles shall be parked further than 150 feet from the terminus of Scarlett Drive, a temporary fence or other means shall be installed to demarcate this distance, the design material, and location of the fence be shall subject to review and approval by the Fire Marshall and the Director of Community Development. [PL] The address for this site must be clearly posted [PO] A clear pedestrian pathway will be designated and maintained. This pathway will be illuminated with a minimum uniformly maintained minimum level of one-foot candle of light. The light sources shall be: (a) controlled by a photocell device or a time clock that will turn the lights on at dusk and off at dawn and (b) protected by a weather and vandal resistant covers. Alternatively, to providing additional lighting, the applicant can provide a photometric survey, which demonstrates compliance with the one-foot candle requirements. The Applicant shall comply with all applicable Planning, Building, Alameda County Fire, and Police Department regulations and ordinances. [PL, B, F, PO] This Conditional Use Permit shall be null and void on February 26, 2003 or at the issuance of a Temporary Certificate of Occupancy for the Dublin Volkswagen project, located at 6085 Scarlett Court, which ever comes first. [PL] The terminus of Scarlett Drive shall be barricaded with a gate and sign, subject to review and approval by the Director of Public Works. This land ks adjacent to our Nissan Dealership, which is part of ou~ Dublin Auto Center. We will be constructing a new Volkswagen dealership on the property that sits at the comer of Searlett Court and Scarlett Drive. The approximately 1 Acre parcel, which is a portion of APN 941-0550-019-09, will be used to rdoeate employee vehicle parking dur~g the construction time period, which is currently estimator at one year or less. The lot will be cleaned of debris. No improvements are being anticipated at this time. Vehicles will be moved on and offthe property during normal business hours. We feel that there will be no adverse affects or negative impacts to the sun~unding area or community due to the p~u-king of vehicles on this lot.
