Some of the associated work, such as replacement of street lighting currently on wood utility poles, is not covered under Rule 20A funds and will be paid from the Dougherty Road Improvements, 1-580 to Houston Place, Capital Improvement Project. The City has a balance of $115,000 in its P.U.C. Rule 20A (PG&E) account as of FY 2003-2004 and will accrue additional allocations at a rate of about $125,000 per year. PG&E allows cities to "borrow out" funds three years in advance; based on this assumption, the funding available at the beginning of Fiscal Year 2005-2006, including the "borrowed" funds, would be $865,000. The other utility companies are required to underground their own facilities and bear the cost. The estimated cost of undergrounding the PG&E overhead facilities is $561,000. This is dependent on the timing of the development in relation to the timing of the Underground District. DESCRIPTION: At the City Council meeting of January 6, 2004, an Ordinance was introduced to form Underground Utility District 2003-01 (Dougherty Road from Sierr~[i, ane to Dublin Boulevard, and Dublin Boulevard from Dublin Court to Dougherty Road). This is the second public hearing for this Ordinance. - This project is intended to coincide with the Dougherty Road Improvements, 1-580 to Houston Place project. The project is scheduled for construction in Fiscal Year 2005,2006, and it is proposed that the undergrounding of utilities takes place in conjunction with or prior to construction of the project. As the result of a preliminary walk-through of the project site with representatives of the utilities, it was determined that none of the existing businesses within the project limits have overhead services from the utility poles to be undergrounded. Vangelatos Staff recommends that the City Council conduct a public hearing, deliberate, waive the reading and adopt the ordinance establishing Underground Utility District 2003-01. Page 2 ~ ~- ORDINANCE NO. -04 AN ORDINANCE OF THE CITY OF DUBLIN ESTABLISHING UNDERGROUND UTILITY DISTRICT 2003-01 ON DOUGHERTY ROAD FROM DUBLIN BOULEVARD TO SIERRA LANE AND ON DUBLIN BOULEVARD FROM DUBLIN COURT TO DOUGHERTY ROAD WHEREAS, on December 2, 2003, the City Council received a report from the Director of Public Works regarding undergrounding of utilities on segments of various City streets and subsequently determined that the highest priority for undergrounding is the segment of Dougherty Road from Dublin Boulevard to Sierra Lane and on Dublin Boulevard from Dublin Court to Dougherty Road; and WHEREAS, on December 16, 2003, the City Council adopted Resolution No. 238-03, a Resolution of Intention to form Underground Utility District 2003-01 on Dougherty Road from Dublin Boulevard to Sierra Lane and on Dublin Boulevard from Dublin C0~to'Dougherty Road; and WHEREAS, notices of adoption of the Resolution of Intention were published, posted, and mailed to property owners and utilities as provided in Municipal Code Section 7.12.080; and WHEREAS, public hearings were held on January 6 and February 3, 2004, for the purpose of hearing protests or objections to the proposed District; and WHEREAS, no protests or objections were received; NOW, THEREFORE, the City Council of the City of Dublin does ordain as follows: Section 1: City of Dublin Underground Utility District 2003-01 is established on Dougherty Road from Sierra Lane to Dublin Boulevard, and on Dublin Boulevard fromlDublin Court to Dougherty Road, as delineated on the map, Exhibit "A", attached hereto. Section 3: This ordinance shall become effective thirty (30) days after its final passage and adoption by the City Council. The City Clerk of the City of Dublin shall cause this ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California.
