This item was heard by the Planning Commission at a public heating on February 24, 2004. The Planning Commission approved the Site Development Review and Vesting Tentative Map for the project. The Commission also recommended approval to the City Council &the Planned Development Rezoning and Stage 2 Development Plan and Development Agreement for the project. On March 4, 2004, an appeal of the Planning Commission's action was filed by Adams Broadwell Joseph & Cardoza, attorneys for the International Brotherhood of Electrical Workers, Local 595, Sheet Metal Workers Union Local 104, and the Plumbers and Steamfitters Union Local 342. ANALYSIS: The City of Dublin Municipal Code, Section 9.08.100 (Subdivisions, Appeals) requires that the City Council set the item for hearing within 15 days of receipt of an appeal on a Vesting Tentative Map. In addition, the City of Dublin Zoning Ordinance requires that the Site Development Review action be heard within 45 days. Requirements of State law (the Subdivision Map Act) require that the appeal of the tentative map approval be heard within 30 days. In order to meet these timeframes, the City Council would have to have a special meeting at the end of March. In the alternative, the Appellant and Applicant could stipulate to have the item heard at a later time. The attorneys for the Appellant as well as the Applicant have agreed to waive the timelines'under State and City law to have the Appeal heard at the same time as the entire project on April 20, 2004. COPIES TO: In-House Distribution Applicant Appellant ITEM NO. ~ RECOMMENDATION: Staff recommends that the City Council receive the Staff Report and schedule the public heating for the Appeal on April 20, 2004.
