Adopt the Resolution accepting improvements to Scarlett Drive and approving traffic control devices FINANCIAL STATEMENT: Sonic Development, LLC, has provided a Maintenance Bond in the amount of $20,462.27 to guarantee against defects for one year. Once these improvements have been accepted, the City will incur maintenance and street sweeping costs for Scarlett Drive. The street light maintenance costs will be paid by the Citywide Street Lighting Maintenance Assessment District. DESCRIPTION: Sonic Development, LLC, recently completed street improvements associated with the portion of Scarlett Drive that extends across the vacant Corrie Development property, south of Dublin Boulevard and east of Chabot Canal. The work was governed by an Improvement Agreement executed on October 23, 2003, via City Council Resolution No. 212-03. Since these improvements have been constructed pursuant to the Improvement Agreement and to the satisfaction of the Public Works Director, it is appropriate for the improvements to now be accepted by the City for permanent maintenance. The following regulatory traffic control devices will also be accepted and approved as part of this project and added to the City of Dublin Traffic Code: "No Parking Anytime" restriction has been installed on both sides of Scarlett Drive between the northerly and the southerly property boundaries, east of the Chabot Canal (Traffic Code Chapter 6.04.250). At the time the City entered into the Improvement Agreement, Sonic Development, LLC, provided a Performance Bond and a Labor and Materials Bond, each in the amount of $81,849.06, to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with a Maintenance Bond COPIES TO: Robert Sanders, Sonic Development Sid Corrie, Corrie Development ITEM NO. G:\DEVELOP\Dublin Volkswagen \agstacpt_st imp_sonic.doc 4,3 in an amount necessary to guarantee the work for a one-year period following acceptance. Sonic Development, LLC, has provided a Maintenance Bond in the amount of $20,462.27, which is 25% of the original Performance Bond and which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the improvements to Scarlett Drive and approving the regulatory traffic control devices installed for the road. Page 2 cr~D~&- RESOLUTION NO. - 04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTANCE OF IMPROVEMENTS FOR SCARLETT DRIVE AND APPROVAL OF REGULATORY TRAFFIC CONTROL DEVICES (SONIC DEVELOPMENT, LLC) WHEREAS, the public right-of-way for Scarlett Drive, in the incorporated territory of the City of Dublin, State of California has been irrevocably dedicated to the public by Corrie Development Corporation, a California Corporation, via an Irrevocable Offer of Dedication together with Grant of Easement for Public Services document recorded on October 9, 2003 (Series No. 2003602219); and WHEREAS, Sonic Development, LLC, a North Carolina Limited Liability Company, previously entered into an Improvement Agreement with the City of Dublin pursuant to City Council Resolution No. 212-03 to improve Scarlett Drive, in accordance with plans and specifications on file with the Public Works Director; and WHEREAS, the improvements associated with the project are now complete in accordance with said plans, specifications, and any approved modifications thereto to the satisfaction of the Public Works Director; and wHEREAS, the developer has installed certain regulatory traffic control devices as a part of the project improvements; and WHEREAS, the original Performance Bond and Labor and Materials Bond can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed on Scarlett Drive are hereby approved and accepted subject to a one-year warranty period; and 2. The traffic regulatory devices installed by Sonic Development, LLC, are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: "No Parking Anytime" restriction has been installed on Scarlett Drive between the northerly and the southerly project boundaries, east of the Chabot Canal. 3. The original Performance Bond issued by Travelers Casualty and Surety Company of America (Bond No. 104-144-619) in the amount of $81,849.06 be released; and 4. The original Labor and Materials BOnd issued by Travelers Casualty and Surety Company of America (Bond No. 104-144-619) in the amount of $81,849.06 be released; and 5. The submitted Maintenance Bond issued by Travelers Casualty and Surety Company of America (Bond No. 104-257-828) in the amount of $20,462.27'be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 20th day of April, 2005.
