SUBJECT: Acceptance of Landscape Improvements associated with Tract 7141,
Dublin Ranch Area A, Neighborhood A-6 (Toll CA II, L.P., a
California Limited Parmership)

RECOMMENDATION: Adopt the Resolution accepting the landscape improvements for
,4,t~ Tract 7141, Dublin Ranch Area A, Neighborhood A-6
FINANCIAL STATEMENT: Toll CA II, L.P., has provided a Maintenance Bond in the amount of
$98,180.00 to replace the Performance Bond and Labor and
Materials Bond that assured the installation of required landscaping
improvements. The Maintenance Bond will guarantee against
.defects for one year. Landscaping maintenance will be performed
by the Dublin Ranch Golf Club Homeowner's Association.
DESCRIPTION: Toll CA II, L.P., recently completed landscape improvements along
the west side of Bent Tree Drive and the north side of Fallon Road fronting Tract 7141 (Dublin Ranch
Area A, Neighborhood A-6). The work was governed by a Tract Developer Agreement for Landscaping
executed on July 17, 2001, per City Council Resolution No. 130-01. A similar agreement governing
Street Improvements for Tract 7141 was also executed at the same time; however, this work is not yet
complete. Since the landscape improvements have been constructed pursuant to the Tract Developer
Agreement and to the satisfaction of the Public Works Director, it is appropriate for the improvements to
now be accepted by the City, with ongoing maintenance to be performed by the Dublin Ranch Golf Club
Homeowner's Association.
At the time that the City and Toll CA II, L.P., executed the Tract Developer Agreement for Landscaping,
the developer provided a Performance Bond and a Labor and Materials Bond, each in the amount of
$392,720.00, to guarantee performance of.the work. Now that the work is complete, these bonds may be
released in accordance with authority contained in §66499.7 of the Government Code, and replaced with a
Maintenance Bond. The developer has provided a Maintenance Bond in the amount of $98,180.00, which
is 25% of the original Performance Bond, and which is sufficient to guarantee the improvements for a
one-year period after acceptance.
Staff recommends that the City Council adopt the Resolution accepting the landscape improvements for
Tract 7141 (Dublin Ranch Area A, Neighborhood A-6).

RESOLUTION NO. - 04
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF LANDSCAPE IMPROVEMENTS FOR
TRACT 7141 (DUBLIN RANCH AREA A, NEIGHBORHOOD A-6)
WHEREAS, the subdivider of Tract 7141, filed on August 21, 2001, in Book 261 of Maps at
Pages 1-4, previously entered into two Tract Developer Agreements with the City of Dublin, one for
Landscape Improvements and one for Street Improvements, to improve said Tract in accordance with
plans and specifications on file with the Public Works Director, said Tract identified as follows:
a) Subdivider: Toll CA II, L.P., A California Limited Partnership
b) Tract Location: North of Fallon Road and west of Bent Tree Drive
c) Tract Size: 97 Single-Family Lots
d) Resolution Approving Agreement: No. 130-01, City of Dublin City Council
e) City Streets Affected: Bent Tree Drive and Fallon Road
WHEREAS, the Landscape Improvements along the west side of Bent Tree Drive and the north
side of Fallon Road along the frontage of Tract 7141, as governed by one of the Tract Developer
Agreements, are complete in accordance with said plans and specifications, and any approved
modifications thereto, to the satisfaction of the Public Works Director; and
WHEREAS, the Street Improvements governed by the remaining Tract Developer Agreement are
not entirely complete, and will not be accepted at this time; and
WHEREAS, the original Performance Bond and Labor and Materials Bond that guaranteed the
Landscape Improvements can be released, in accordance with the authority contained in §66499.7 of the
Govemmen~t Code of the State of California, and replaced with a Maintenance Bond to guarantee the '
completed work for a one-year period following acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
1. The Landscape Improvements completed within said Tract are hereby approved and
accepted subject to a one-year guarantee period; and
2. The original Performance Bond issued by The Continental Insurance Company (Bond No.
929213821) in the amount of $392,720.00 be released; and
3. The original Labor and Material Bond issued by The Continental Insurance Company
(Bond No. 929213821) in the amount of $392,720.00 be released; and
4. The submitted Maintenance Bond issued by National Fire Insurance Company of Hartford
in the amount of $98,180.00 (Bond No. 929309396) be accepted as security for the
aforesaid one-year warranty period, said period to commence on this date and terminate on
the 15th day of June, 2005.
PASSED, APPROVED AND ADOPTED this 15th day of June, 2004.
