HomeMy WebLinkAbout4.03 Shaefer Height Sale CITY CLERK AGENDA STATEMENT CITY COUNCIL MEETING DATE: July 6, 2004 SUBJECT: Approval of Sale of Property to Schaefer Heights, Inc., for the Westerly Extension of Dublin Boulevard Report Prepared by: Melissa Morton, Public Works Director ATTACHMENTS: Resolution Approving Sale of Property to Schaefer Heights, Inc., for the Westerly Extension of Dublin Boulevard, together with Exhibit "A", Grant Deed RECOMMENDATION: Adopt resolution approving the sale of property to Schaefer  Heights, Inc., for the westerly extension of Dublin Boulevard FINANCIAL STATEMENT: Schaefer Heights, Inc., has paid the sum of $55,000 plus interest of $11,991.15, for a total of $66,991.15, to purchase the subject parcel. DESCRIPTION: When the California Highlands Development was being processed near the westerly end of Dublin Boulevard in 1995, an exchange of land was made between the City of Dublin and the developer, Kaufman and Broad (K&B). This exchange gave K&B additional property along the frontage of the K&B development in exchange for a much larger parcel, which in the future would allow for the westerly extension of Dublin Boulevard (toward Schaefer Ranch). At the time of the exchange, these two properties were each valued at $55,000. On August 11, 1998, the Planning Commission of the City of Dublin approved Tentative Map 6765 for the development known as Schaefer Ranch. As part of the development, the developer, Schaefer Heights, included the extension of the westerly end of Dublin Boulevard to the Schaefer Ranch development. In order to complete this improvement, it was necessary to acquire the above-referenced parcel owned by the City of Dublin. As part of the project Development Agreement, Schaefer Heights would obtain the parcel from the City at the sum of $55,000, together with interest. Schaefer Heights' development was subsequently delayed due to environmental concerns raised by outside regulatory agencies. These issues have been resolved, and the Schaefer Ranch development has again begun processing. The developers have now paid the City for the subject parcel, together with the required interest. It is now appropriate for the City to transfer the deed to the developers of Schaefer Ranch for inclusion into the Schaefer Heights development. Staff recommends that the City Council adopt the Resolution approving the sale of property to Schaefer Heights, Inc., for the westerly extension of Dublin Boulevard. RESOLUTION NO. - 04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING SALE OF PROPERTY TO SCHAEFER HEIGHTS, INC., FOR WESTERLY EXTENSION OF DUBLIN BOULEVARD WHEREAS, Tentative Map 6765 (Schaefer Heights) was approved by the City of Dublin Planning Commission on August 11, 1998; and WHEREAS, an infrastructure element for the project for access required the construction the westerly extension of Dublin Boulevard; and WHEREAS, in order to satisfy required access, it was necessary to acquire property from the City of Dublin along Interstate 580; and WHEREAS, the City of Dublin had previously acquired this property through an exchange for a developable parcel of land fronting the Kaufman & Broad project; and WHEREAS, Schaefer Heights, Inc., is purchasing the subject parcel from the City for the sum of $55,000 plus interest of $11,991.15, for a total of $66,991.15; and WHEREAS, in order to complete the transaction of the transfer of property, it is now necessary for the City of Dublin to approve the sale of property and conveyance of Grant Deed to Schaefer Heights, Inc.; NOW, THEREFORE, BE IT RESOLVED that the City of Dublin City Council does hereby approve the sale of property, as described in Exhibit "A" attached hereto, to Schaefer Heights, Inc., for the westerly extension of Dublin Boulevard.
