The construction of frontage improvements for each of the fronting properties is not included in the EDTIF and will instead be the sole responsibility of property owners who develop respective properties pursuant to the Eastern Dublin Specific Plan. The City is also currently collecting Dublin Contra Costa (DCC) fees for future arterial street widening in order to mitigate traffic impacts from development in Dougherty Valley, pursuant to a Joint Exercise of Powers Agreement between the City and Contra Costa County. DCC fees are intended to fund the construction of two of the six ultimate lanes on Tassajara Road. COPIES TO: Affected Property Owners ~ ~C~'~ ITEM NO. G:~DEVELOP~Dublin Ranch\Tassajara Road AlignmentXAgst_estab intention row(rev).doc DESCRIPTION: The Eastern Dublin Specific Plan was adopted in 1994 and identified a need to reserve sufficient right-of-way along Tassajara Road for future road widening to accommodate cumulative development along this roadway corridor. The City previously adopted right- of-way lines for the southern segment of Tassajara Road between 1-580 and the northern boundary of Dublin Ranch Phase 1 as Ordinance No. 20-99, thus allowing portions of the roadway to be constructed to an ultimate width of 128 feet. Presently, the segment of Tassajara Road north of Dublin Ranch remains a two-lane road with gravel shoulders and a right-of-way width of 66 feet. The City annexed portions of this northern segment into the City as part of the Silveria Ranch project by Pinn Brothers, while the balance remains within Alameda County. The proposed Ultimate Right-of-Way Lines for northern Tassajara Road and Fallon Road will establish a right-of-way alignment for the future widening of Tassajara Road to six lanes, and the future extension of Fallon Road to four lanes using a design speed of 45 mph. These future roads will include sidewalks, no parking, bicycle lanes, right and left turn pockets, traffic signals, and raised landscape medians. For Tassajara Road, the alignment will extend from the northern boundary of Dublin Ranch Phase 1 near Shadow Hills Drive to the Alameda County/Contra Costa County line, generally following the existing road. The right-of-way width for this segment varies between 122 feet and 128 feet. For Fallon Road, the alignment will extend from a planned intersection at Tassajara Road to a point approximately 1,500 feet southeast of the intersection for connection with the portion of Fallon Road to be constructed as part of Dublin Ranch Area A. The right-of-way width for this road is 110 feet. These alignments are intended to satisfy Mitigation Measure 3.3/14.0 of the Eastern Dublin General Plan Amendment and Eastern Dublin Specific Plan that requires the City to reserve sufficient right-of-way for future road construction. Adoption of the fight-of-way lines will not result in immediate acquisition of any property. However, the establishment of right-of-way lines will preclude property owners from constructing buildings or other structures within the future right-of-way area. Establishment of Right-of-Way Lines: The procedure for adopting new right-of-way lines is governed by Chapter 7.68 of the Dublin Municipal Code. In addition, Government Code §65402 states, in part, that if a General Plan has been adopted, no real property shall be acquired by dedication or otherwise for street purposes until the location, purpose, and extent of such acquisition have been submitted to and reported upon by the Planning Agency (Planning Commission) as to conformity with an adopted General Plan. Upon receiving a report and recommendation from the Planning Commission, the City Council can adopt a Resolution of Intention designating the right-of-way to be established, and notifying interested parties of a subsequent public hearing. A public hearing can then be conducted so that the City Council can hear testimony related to the proposed right-of-way lines. Finally, the City Council can adopt an ordinance establishing the fight-of- way lines described in the Resolution, if appropriate, and have the ordinance recorded with the County Recorder. Planning Commission: As required by Government Code §65402, the Planning Commission reviewed the proposed ultimate right-of-way lines for Tassajara Road and Fallon Road at a meeting held on May 11, 2004. After considering all testimony, the Planning Commission adopted Resolution No. 04-38, affirming that the proposed alignments are in conformance with the City of Dublin General Plan. The Comtnission also adopted Resolution No. 04-39 recommending that the City Council adopt a Resolution of Intention to Establish the Ultimate Right-of-Way Lines for Tassajara Road and Fallon Road. Page 2 %"~ ANALYSIS: Tassajara Road and Fallon Road are identified in the Eastern Dublin Specific Plan as major north-south arterials between I-$$0 and the Alameda County/Contra Costa County line to the north. To develop a safe and appropriate roadway alignment, Staff considered geometric and access issues, topographic constraints, and jurisdictional restrictions. The Map of Ultimate Right-of-Way Lines (Attachment 2) shows the proposed horizontal and vertical alignment of Tassajara Road and Fallon Road. This Map illustrates how the road was woven between existing homes, driveways, and parking lots, while respecting significant topographic features such as Tassajara Creek and its tributaries, and the surrounding knolls and hillsides. The result is a plan that conforms to the design criteria for major arterials with a design speed of 45 mph, while minimizing adverse impacts to the surrounding topography and riparian areas. The plat maps and legal descriptions (Exhibits 'A & B of Attachment 7) illustrate the 14 properties that will be directly impacted by the proposed right-of-way lines. The areas to be reserved for future road widening or construction are shaded and fully dimensioned, along with a total square footage and acreage estimate of land to be reserved. The shaded areas are shown in relationship to the existing road right-of- way, property lines, and other important topographic features for each property. The alignment was discussed with affected, property owners and other stakeholders at three (3) public informational workshops conducted by the City of Dublin Public Works Department on April 11, 2003, May 2, 2003, and August 28, 2003. The input received from the group was considered in determining the final proposed right-of-way lines. Resolution of Intention: Before establishing any right-of-way lines, §7.68.060 of the Municipal Code requires the City Council to pass a Resolution of Intention upon receipt of a report and recommendation from the Planning Commission. Said report and recommendation are attached to this report as Planning Commission Resolution 04-39 (Attachment 3). Once adopted, the Resolution of Intention must be published or posted in accordance with §7.68.070 to give notice of the first reading of the Ordinance, which is proposed for July 20, 2004. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution of Intention to Establish Ultimate Right'of- Way Lines for TasSajara Road and Fallon Road, and set a public hearing for Suly 20, 2004, at 7:00 p.m., to hear any protests or objections to the establishment of the proposed right-of-way lines for Tassajara Road andFallon Road. RESOLUTION NO. 04 - 39 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN REPORT AND RECOMMENDATION THAT THE CITY COUNCIL ADOPT A RESOLUTION OF INTENTION TO ESTABLISH ULTIMATE RIGHT-OF-WAY LINES FOR TASSAJARA ROAD AND FALLON ROAD WHEREAS, the City of Dublin has proposed the establishment of right-of-way lines for Tassajara Road and Fallon Road in accordance with Municipal Code Chapter 7.68; and WHEREAS, the effected segment of Tassajara Road extends froTM the northern boundary of Dublin Ranch Phase 1 (Tract 6925) near Shadow Hills Drive to the Alameda County/Contra Costa County line, generally following the existing road; and WHEREAS~ the planned segment of Fallon Road extends from a furore intersection at Tassajara Road to a point approximately 1,500 feet south-east of the intersection for connection with the portion of Fallon Road to be constmcted as part of Dublin Ranch Area A; and WHEREAS, the proposed right-of-way lines conform to the lines previously established by Ordinance No. 20-99 adopted on September 7, 1999 for the southern segment of Tassajara Road between 1-580 and the northern boundary of Dublin Ranch Phase I; and WHEREAS, the project has been reviewed in accordance w/th the provisions of the California Environmental Quality .Act (CEQA) and implementing Guidelines, and a Mitigated Negative Declaration has been recommended to the City Council for adoption, as it will have no significant' effect on the environment; and WHEREAS, an Agenda Statement was prepared on behalf of the City Engineer and submitted to the Planning Commission as required by Municipal Code Chapter 7.68 recommending that the Planning Commission recommend to the City Council adoption of a Resolution of Intention to establish fight-of-way lines; and WHEREAS, the Planning Commission did hold a public hearing on May 11, 2004; and WHEREAS, proper notice of said public hearing was given in all respects as required by law. WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth; and WHEREAS, the right-of-way line is appropriate and compatible with the existing land uses and will not overburden public services; and WHEREAS, the right-of-way line will not have a substantial adverse effect on health or safety or be substantially detrimental to the public welfare or be injurious to property or public improvements; NOW, THEREFORE, BE IT. RESOLVED 'that the Dublin Planning Commission does hereby recommend that the City Council adopt a Resolution of Intention to eStablish right-of-way lines for Tassajara Road and Fallon Road as depicted on the plat.maps and legal descriptions included as Attachment 3 to the Agenda Statement.
