An estimated balance of$109,870 will remain as afundfor future pole replacement. The proposed assessment of $16.84 per sin21e-familv home. is the same as the Fiscal Year 2003-04 Assessment. DESCRIPTION: This assessment district funds energy and maintenance costs for the City's street lighting system, except for the lighting installed in Dublin Ranch and Tract 7067, which is funded through the Dublin Ranch Street Lighting Maintenance Assessment District. M ~ y ()b 2- Street Lighting Assessment District to replace the County of Alameda Lighting Service Area. On August 13, 1984, the City Council approved the annual Engineer's Report and ordered levy of assessments for the first time. In 1995-96, the City of Dublin and other agencies in Alameda County took possession of PG&E-owned street lights in order to reduce maintenance costs. The 1996-97 assessments were reduced by 30% flora the 1995-96 level of $19.34. For 2002-2003, tho assessment was increased from $13.26 to $16.84 in order to fired in~ utility costs and the first two years of a phased six-year Capital Improvement Project to replace deteriorated poles in older subdivisions. The first phase of the pole replacement project was completed in Fiscal Year 2002-2003 at a cost that was less than ori~naHy anticipated. The second phase of the project, which was included in the proposed Capital Improvement Program for 2003-2004, was also funded from this Street Light Maintenanc~ Assessment District. A reserve of approximately $109,870 is projected to remain at tho end of Fiscal Year 2004-2005. This reserve is less than the amount allowed by State Law, which permits a reserve of up to 50% of the ope _rating cost for the District. Staff recommends that the City Council conduct a public hearing, deliberate, and adopt the resolution approving engineer's report, confirming diagram and assessment, and ordering levy of assessment. D ITl Tas RESOLUTION NO. -04 A RESOLU~ON OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING ENGINEER*S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT, AND ORDERING LEVY OF ASSESSMENT CITY OF DUBLIN STREET LIGHTING MAINTENANCE ASSESSMENT DISTRICT $3-1 WHEREAS, by its Resolution No. 036-04, a Resolution Directing Preparation of Annual Report for City of Dublin Street Lighting Maintenance Assessment District No. 83-1 (the "District"), this Council designated the City Engineer as Engineer of Work and ordered said Engineer to make and file a report in writing in accordance with and pursuant to the Landscaping and Lighting Act of 1972; and WHEREAS, said report was made and filed with the City Clerk and duly considered by this Council and found to be ~ffieient in every particular, whereupon it was determined that said report should stand as Engineer's Report for all subsequent proceedings under and pursuant to the aforesaid Resolution and that July 20, 2004, at 7:00 p.m. in the Coundl Chambers, Dublin Civic Center, 100 Civic Plaza, Dublin~ California, was appointed as the time and place for a hearing by the Council on the question of the levy of the proposed assessment, notice of which hearing was published and posted in accordance with the Landscaping and Lighting Act of 1972; and WHEREAS, at the appointed time and place, said hearing was held, and all persons interested desiring to be heard were given an oppommity to be heard, and all matters pertaining to said levy were heard and considered by this Council, and this Council thereby acquired jurisdiction to order said levy and confirmation of diagram and assessment prepared by and made a part of the report of said engineer to pay the ecet and expenses thereof; NOW, THEREFORE, BE 1T RESOLVED that the City Council of the City of Dublin does hereby approve (a) The property owners owning more than fifty percent of the area of assessable land within thc District had not, at the conclusion of said heari~ filed written protests against the said proposed levy, or against the Engineer's Estimate of costs and expenses, or against the maps and description, or ag~__in~ tho diagram or the assessment to pay for the costs and expenses thereof; (b) The public interest, convenience, and necessity require that said levy be made; (c) The District benefited by said improvements and to be assessed to pay the costs and expenses thereof, and the exterior boundaries thereof are as shown by a map thereof filed in the office of the City Clerk, which map is made a part hereof by reference thereto. Said assessment is made upon the several lots or parcels of land within said street light maintenance assessment district in proportion to the estimated benefits to be receiyed by said lots or parcels respectively .from the acquisition and maintenance of said improvements. The diagram and assessment numbers appearing herein are the diagram numbers appearing on said diagram, to which reference is hereby made for a more particular description of said property. The scope of work includes the cost of energy and maintenance of street lights within the City of Dublin, excepting street lighting within Street Light Maintenance Assessment District 99-1 (Dublin Ranch). The scope of work shall also include the cost of purchase or installation of street lights. Each lot or parcel of land assessed is described in the assessment list by reference to its parcel number as shown on the Assessor's Maps of the County of Alameda for the Fiscal Year 2004-2005 and includes all of such Parcels excepting those portions thereof within existing public roads or rights of way to be acquired in these proceedings for public road purposes. For a more particular description of said property, reference is hereby made to the deeds and maps on file and of record in the office of the County Recorder of said County. Because the names of the several owners are unknown to me, I hereby place the word #unknown" opposite the number of each lot of parcel of land assessed, the amount assessed thereon, and the number of the assessment. 19leli sa -Morton, . . .
