RECOMMENDATION: ~ Adopt Resolutions
FINANCIAL STATEME~: The 1991-92 assessment per single-family lot for
landscaping and lighting maintenance costs is proposed
to be $78.48. Multi-family lots are proposed to be
$39.24 per dwelling unit. The City's costs are being
reimbursed by this assessment district.
DESCRIPTION: As part of the review and approval of the 145-unit
single family development (Ridgecreek - Village VI) and the other, multi-
family Villages, certain landscaping and open space maintenance was made a
condition of approval. This maintenance assessment district provides funds
for this work. The City Council approved formation of the District on
November 10, 1986, with the initial assessment in the 1987-88 tax year.
The County Assessor collects these monies for the City for the maintenance of
landscaping and irrigation systems, right-of-way fencing, walls and entrance
signs and trash removal. The open space parcel maintenance was charged to the
District for three years only, with the 1989-90 fiscal year being the final
year, similar to the agreement made for Tract 4719. The District's boundaries
include all of Tract 5511.
This year, it is proposed to add the landscaping maintenance of the north end
of Crossridge Road, which is now a weed problem, to the scope of work for this
maintenance district.
In previous years, Staff has held informational meetings prior to the public
hearings for both this and the "Stagecoach Road" assessment district so that
the residents within the districts could ask questions of Staff in an informal
atmosphere. For the last two years, no one has attended these meetings, and
Staff recommends discontinuing the scheduled informational meetings but
continuing to offer to meet with any residents expressing an interest, either
on an individual or collective basis. Staff will send a newsletter to all
property owners which provides updates on the effects of frost damage and the
drought on the landscaping.
Adoption of the resolutions approves the Preliminary Engineer's Report and
sets June 24, 1991 as the date for a protest hearing for the Assessment.
Staff recommends that the City Council adopt the resolutions.
The assessment per single family lot last year was $120.00, with the multi-
family lots being assessed on the basis of approximately $60.00 per dwelling
unit. This year's assessment is proposed to be aPproximately 65% of last
year's figures. The cost of water and some other maintenance activities is
anticipated to be less than last year du~o'water conservation measures. It
is also proposed to use $6,000 of the substantial reserve funds to help defray
the cost of replanting damaged material when water restrictions end.

ASSESSMENT
WHEREAS, on March 25, 1991, the City Council of the City of Dublin,
California, pursuant to the provisions of the Landscaping and Lighting Act of
1972, adopted its Resolution Directing Preparation of Annual Report for
Maintenance Assessment District for the maintenance of improvements more
particularly therein described: and
WHEREAS, said Resolution directed the undersigned to Prepare and file a
report pursuant to Section 22565, et. seq. of said Act;
NOW, THEREFORE, the undersigned, by virtue of the power vested in me
under said Act and the order of the Council of said City, hereby make the
following assessment to cover the portion of the estimated cost of the
maintenance of said improvements and the cost and expenses incidental thereto, to
be paid by said District.

As required by said Act, a diagram is hereto attached showing the
exterior boundaries of said landscaping maintenance assessment district and also
the lines and dimensions of each lot or parcel of land within said landscaping
maintenance assessment district as the same existed at the time of the passage of
said resolution, each of which lots or parcels having been given a separate
number upon said diagram.

I do hereby assess the net amount to be assessed upon all assessable
lots or parcels of land within said landscaping maintenance assessment district
by apportioning that amount among the several lots or parcels in proportion to
the estimated benefits to be received by each such lot or parcel from the
maintenance of said improvements, and more particularly set forth in the list
hereto attached and by reference made a part hereof.
Said assessment is made upon the several lots or parcels of land within
said landscaping maintenance assessment district in proportion to the estimated
benefits to be received by said lots or parcels respectively from the maintenance
of said improvements. The diagram and assessment numbers appearing herein are
the diagram numbers appearing on said diagram, to which reference is hereby made
for a more particular description of said property.
Each lot or parcel of land assessed is described in the assessment list
by reference to its parcel number as shown on the Assessor's Maps of the County
of Alameda for the fiscal year 1991-1992 and includes all of such parcel
excepting those portions thereof within existing public roads or right-of-way to
be acquired in these proceedings for public road purposes. For a more particular
description of said property, reference is hereby made to the deeds and maps on
file and of record in the office of the County Recorder of said County. Because
the names of the several owners are unknown to me, I hereby place the word
"Unknown" opposite the number of each lot or parcel of land assessed, the amount
assessed thereon, and the number of the assessment.

SCOPE OF WORK
The following areas are to be maintained by this Maintenance Assessment District:
1) The median and roadside landscaping along the north side of the street for
the entire length of Willow Creek Drive.
2) Roadside landscaping along Shady Creek Drive within Lots 1, 2, 3, 4, 5, 6,
15, 16, 37, 38, and south of Lot 145, all within Tract 5511.
3) Roadside landscaping, wall, fence, and pathway improvements along the west
side of Dougherty Road between Amador Valley Boulevard and the northerly City
Limit line, and along the north side of Amador Valley Boulevard between Dougherty
Road and Wildwood Road.
4) Roadside landscaping, fence, and pathway improvements along the west side of
Wildwood Road.
5) Roadside landscaping, fence, wall, and pathway improvements along the west
side of Dougherty Road and the south side of Amador Valley Boulevard adjacent to
Lot 150.
6) Roadside landscaping, fence, and pathway improvements along the west and
north sides of Fall Creek Road.
7) Roadside landscaping and emergency access surfacing at the north end of
Crossridge Road within the street right-of-way.

METHOD OF APPORTIONING
Each single family lot shall be assigned a benefit unit of one, each multifamily
unit assigned a benefit unit of one-half, the commercial lot shall have a benefit
unit of 4, and the open space lots shall have a benefit unit of zero. This gives
the following benefit units and apportionments for each Village for this Fiscal

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
APPROVING PRELIMINARY ENGINEER'S REPORT,
CONFIRMING DIAGRAM AND ASSESSMENT
CITY OF DUBLIN LANDSCAPING AND LIGHTING
MAINTENANCE ASSESSMENT DISTRICT 86-1
WHEREAS, by its Resolution No. 30-91, a Resolution Directing
Preparation of Annual Report for Maintenance Assessment District, City of
Dublin Landscaping and Lighting Maintenance Assessment District, 86-1 (the
"district"), this Council designated the City Engineer, as Engineer and
ordered said engineer to make and file a report in writing in accordance with
and pursuant to the Landscaping and Lighting Act of 1972; and
WHEREAS, said Engineer of Work has made and filed with the City
Clerk a preliminary report in writing as called for in said Resolution No.
30-91 and under and pursuant to said Act, which report has been presented to
this Council for consideration; and
WHEREAS, said Council has duly considered said report and each
and every part thereof, and finds that each and every part of said report is
sufficient; and that said report, nor any part thereof requires or should be
modified in any respect;
NOW, THEREFORE, BE IT RESOLVED
a) that the Engineer's estimate of the itemized and total costs
and expenses of maintaining said improvements and of the incidental expenses
of maintaining said improvements and of the incidental expenses in connection
therewith, as contained in said report be, and each of them are hereby
preliminarily approved.
b) that the diagram showing the assessment district, description
of the improvements to be maintained, and the boundaries and dimensions of the
respective lots and parcels of land within said district, as contained in said
report be, and it is hereby preliminarily approved.
c) the assessment of the total amount of the cost and expenses of
the proposed maintenance of said improvements upon the several lots and
parcels of land in said District in proportion to the estimated benefits to be
received by such lots and parcels, respectively, from said maintenance, and of
the expenses incidental thereto, as contained in said report be and they are
hereby preliminarily approved.

APPOINTING TIME AND PLACE OF HEARING PROTESTS
IN RELATION TO pROPOSED ASSESSMENTS

WHEREAS, by its Resolution No. 30-91, a Resolution Directing
Preparation of Annual Report for Maintenance Assessment District, City of
Dublin Landscaping and Lighting Maintenance Assessment District 86-1 (the
"District") this Council designated the City Engineer as Engineer and ordered
that engineer to make and file a report in writing in accordance with and
pursuant to the Landscaping and Lighting Act of 1972; and
WHEREAS, said Engineer of Work has made and filed with the City
Clerk a preliminary report in writing as called for in said Resolution No.
30-91, and under and pursuant to said Act, which report has been presented to
this Council for consideration; and
WHEREAS, said Council has duly considered said report and each
and every part thereof, and finds that each and every part of said report is
sufficient;
NOW, THEREFORE, BE IT RESOLVED that on July 22, 1991, at the hour
of 7:30 p.m. in the regular meeting place of said Council, Dublin Civic
Center, 100 Civic Plaza, Dublin, California, be, and the same are hereby
appointed and fixed as the time and place when and where it will consider and
finally act upon the Engineer's Report.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to
give notice of said hearing once a week for two weeks in the local newspaper
published and circulated in said City, and by conspicuously posting a notice
thereof at public locations, and not less than three in all; said posting and
first publication to be had and completed at least ten (10) days before the
date herein set for hearing of protests.
BE IT FURTHER RESOLVED that said notices shall be headed "Notice
of Assessment" and shall, in legible characters, state the fact and date of
the passage of this Resolution and approving the preliminary Engineer's Report
and of the date, hour, and place set for the hearing of said protests, and
briefly describe the assessments proposed to be made, and refer to said
Resolution and report for further particulars.
