Since the street improvements have been constructed pursuant to the Tract Improvement Agreement and to the satisfaction of the Public Works Director, it is appropriate for the improvements to now be accepted by the City for permanent maintenance. The remaining work governed by the landscape agreement is being accepted under a separate item on this agenda. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. Stop control devices have been installed on the easterly approach of West Cog Hill Terrace at Signal Hill Drive, on the easterly approach of West Castle Pines Terrace at Signal Hill Drive, and on the westerly approach of Glen Abbey Place at West Cog Hill Terrace (Traffic Code Section 6.16.020). At the time the City and Toll CA II, L.P., executed the Tract Improvement Agreement for the street, grading and utility improvements, the developer provided a Performance Bond and a Labor and Materials Bond, each in the amount of $354,255.00, for improvements to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in S66499.7 of the Government Code, and replaced with a Maintenance Bond in the amount necessary to guarantee the work for a one-year period following acceptance. The developer has provided a Maintenance Bond in the amount of $88,564.00, which is 25% of the original Performance Bond, and which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the street improvements for Tract 7137, Dublin Ranch Area A, Neighborhood A-2, and approving the regulatory traffic control devices. Page 2 of2 /f913 RESOLUTION NO. - 06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF IMPROVEMENTS FOR TRACT 7137 (DUBLIN RANCH AREA A, NEIGHBORHOOD A-2) AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES WHEREAS, the subdivider of Tract 7137, filed on March 1,2004, in Book 275 of Maps at Pages 9 - 12, previously entered into two Tract Improvement Agreements with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the Public Works Director, said Tract identified as follows: a) Subdivider: b) Tract Location: Toll CA II, L.P., A California Limited Partnership West of Signal Hill Drive, north oftract 713 8, and east of Dublin Ranch Golf Course 51 Single-Family Lots No. 15-04, City of Dublin City Council Glen Abbey Place, West Cog Hill Terrace and West Castle Pines Terrace c) Tract Size: d) Resolution Approving Agreement: e) City Streets Affected: WHEREAS, the Street Improvements associated with Tract 7137 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the developer has installed certain regulatory traffic control devices as part of the Tract improvements; and WHEREAS, the original improvement Performance Bond and Labor and Materials Bond that guaranteed the Street Improvements can be released, in accordance with the authority contained in S66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and 2.
