HomeMy WebLinkAbout4.07 Dublin Ranch Area A Landscape Improv accepted by the City, with ongoing maintenance to be performed by the Dublin Ranch Golf Club Homeowner's Association. At the time that the City and Toll CA II, L.P., executed the Tract Improvement Agreement for Landscaping, the developer provided a Performance Bond and a Labor and Materials Bond, each in the amount of $223,368.00, to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with authority contained in ~66499. 7 of the Government Code, and replaced with a Maintenance Bond. The developer has provided a Maintenance Bond in the amount of $55,842.00, which is 25% of the original Performance Bond, and which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the landscape improvements for Tracts 7137, 7138, 7139 and 7140 (Dublin Ranch Area A, Neighborhoods A-2, A-3, A-4 and A-5). Page 2 of2 /ol RESOLUTION NO. - 06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF LANDSCAPE IMPROVEMENTS FOR TRACTS 7137, 7138, 7139 AND 7140 (DUBLIN RANCH AREA A, NEIGHBORHOODS A-2, A-3, A-4 AND A-5) WHEREAS, the subdivider of Tracts 7137, 7138, 7139 and 7140, filed on March 1, 2004, in Book 275 of Maps at Pages 9 - 12, March 1,2004, in Book 275 of Maps at Pages 4 - 8, July 11, 2003, in Book 271 of Maps at Pages 35 - 39, and July 11, 2003, in Book 271 of Maps at Pages 40 - 43 respectively, previously entered into five Tract Improvement Agreements with the City of Dublin, one for Landscape Improvements and four for Street Improvements, to improve said Tracts in accordance with plans and specifications on file with the Public Works Director, said Tracts identified as follows: a) Subdivider: b) Tract Location: c) Tract Size: d) Resolution Approving Agreement: e) City Streets Affected: Toll CA II, L.P., A California Limited Partnership East of Fallon Road, west of Dublin Ranch Golf Course, and west of Bent Tree Drive 250 Single-Family Lots No. 75-03, City of Dublin City Council Sugar Hill Terrace, Bent Tree Drive and Signal Hill Drive WHEREAS, the Landscape Improvements along Signal Hill Drive and Bent Tree Drive and along the frontages of Tracts 7137, 7138, 7139 and 7140, as governed by the landscape Tract Improvement Agreement, are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the Street Improvements governed by the remaining Tract Improvement Agreements for Tracts 7137, 7138, 7139 and 7140 are also complete, and will be accepted separately; and WHEREAS, the original Performance Bond and Labor and Materials Bond that guaranteed the Landscape Improvements can be released, in accordance with the authority contained in ~66499. 7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The Landscape Improvements completed within said Tracts are hereby approved and accepted subject to a one-year guarantee period; and 2.
