Adopt the Resolution finding that the inclusion of the Dublin Historic
Park Acquisition Project to the 2006-2011 Capital Improvement
Program (CIP), of the City of Dublin is consistent with the General
Plan and that the acquisition of the Dublin Square Shopping Center
(APN 941-1560-007-01) is consistent with the General Plan
RECOMMENDATION:
PROJECT DESCRIPTION:
Government Code Section 65401 requires the Planning Commission to review public works projects
proposed as a part of the Capital Improvement Program (CIP) for the ensuing fiscal year for their
conformance with the City's adopted General Plan. Government Code Section 65402 (a) requires the
Planning Commission to review the proposed acquisition of property for conformance with the City's
General Plan.
On June 16,2006, the Planning Commission adopted Resolution 06-14 finding that those projects covered
in the adopted General Plan as part of the 2006-2011 Capital Improvement Plan (CIP) to be consistent
with the adopted City of Dublin General Plan. The City Council subsequently adopted the CIP on June
13, 2006.
Since adoption of the 2006-2011 CIP, an additional project has been proposed for Fiscal Year 2006-2007;
the Dublin Historic Park Acquisition. Consequently it will be necessary for the City Council to amend
the 2006-2011 CIP (anticipated for September 19, 2006). Prior to amending the 2006-2011 CIP to
include the Dublin Historic Park Acquisition project, it is necessary for the Planning Commission to
determine that the proposed project is consistent with the City of Dublin General Plan.
In addition, because the Dublin Historic Park Acquisition project, proposed to be included in the 2006-
2011 CIP, includes the acquisition of real property, the Planning Commission must determine whether
such acquisition is consistent with the General Plan.

BACKGROUND:
At the August 1, 2006 meeting of the Dublin City Council, the Council adopted Resolution 149-06
approving General Plan Amendments and approval of the Dublin Village Historic Area Specific Plan.
This action changed the General Plan land use designation of the Dublin Square Shopping Center from
RetaiVOffice to ParksIPublic Recreation and became effective on August 31, 2006. Additionally, at the
August 1, 2006 meeting, the City Council adopted the Parks and Recreation Master Plan, May 2006
Update (Resolution 150-06) and the Dublin Historic Park Master Plan (Resolution 151-06).
In order to proceed with acquisition of the Dublin Square Shopping Center for the future Dublin Historic
Park, the City Council on August 15,2006 authorized the City Attorney to secure appraisal services of the
property at such time that Resolution 149-06 is effective (August 31, 2006).
The Dublin Historic Park Acquisition project includes costs related to: I) appraisal of the land; 2)
goodwill appraisals; 3) furniture/fixtures/equipment appraisal; 4) relocation costs (assistance and
benefits); 5) fair market value for the land; and 6) potential loss of business goodwill. These costs are for
the acquisition of the property known as the Dublin Square Shopping Center (APN 941-1560-007-01,
Attachment I which includes a parcel map).
GENERAL PLAN CONFORMITY:
The proposed CIP project provides for the acquisition of the Dublin Square Shopping Center for the
future Dublin Historic Park. As noted on the previous page, the City Council on August 1,2006 approved
a General Plan Amendment and the Dublin Village Historic Area Specific Plan which changed the
General Plan land use designation of the Dublin Square Shopping Center from RetaiVOffice to
ParksIPublic Recreation. The Council also adopted the Parks and Recreation Master Plan May 2006
Update and the Dublin Historic Park Master Plan. The Dublin Historic Park Acquisition project is in
conformance with the City of Dublin General Plan, as amended on August 1, 2006, and the acquisition of
the Dublin Square Shopping Center property is consistent with the General Plan.
ENVIRONMENTAL REVIEW:
An Initial Study and Mitigated Negative Declaration (IS/MND) were prepared in compliance with the
California Environmental Quality Act (CEQA), State CEQA Guidelines, and the City of Dublin
Environmental Guidelines, to identify and analyze impacts of the implementation of the Dublin Historic
Park project. The project description for the IS/MND included the acquisition, demolition of the existing
buildings, and construction of the park itself. A 30-day public review period for the IS/MND began May
31, 2006 and ended June 30, 2006. The IS/MND was sent to the State Clearinghouse and was
disseminated to all appropriate State agencies. A Mitigated Negative Declaration was prepared because it
was determined, through the review process, that the project will not have a significant effect on the
environment with the incorporation of the proposed mitigation measures. The IS/MND was adopted by
the City Council on August 1, 2006.
RECOMMENDATION:
Staff recomqlends that the Planning Commission adopt the Resolution finding the Dublin Historic Park
Acquisition project proposed for addition to the Fiscal Year 2006-2007 capital improvement budget
within the 2006-2011 Capital Improvement Program to be consistent with the General Plan and find the
acquisition of the Dublin Square Shopping Center consistent with the General Plan.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
FINDING THAT THE INCLUSION OF THE DUBLIN HISTORIC PARK ACQUISITION
PROJECT TO THE 2006-2011 CAPITAL IMPROVEMENT PROGRAM (CIP), OF THE CITY
OF DUBLIN IS CONSISTENT WITH THE GENERAL PLAN AND THAT THE ACQUISITION
OF THE DUBLIN SQUARE SHOPPING CENTER (APN 941-1560-007-01) IS CONSISTENT
WITH THE GENERAL PLAN
WHEREAS, the City Council of the City of Dublin adopted the 2006-2011 Capital Improvement
Program (CIP) on June 13, 2006; and
WHEREAS, the CIP outlines major infrastructure improvements through Fiscal Year 2011; and
WHEREAS, since adoption of the CIP, an additional project has been proposed for Fiscal Year
2006-2007, Dublin Historic Park Acquisition; and
WHEREAS, this project is a result of actions taken by the City Council on August 1, 2006
including the adoption of Resolution 149-06 approving General Plan Amendments and approval of the
Dublin Village Historic Area Specific Plan, the adoption ofthe Parks and Recreation Master Plan May
2006 Update (Resolution 150-06) and the adoption of the Dublin Historic Park Master Plan (Resolution
151-06); and .
WHEREAS, Section 65401 of the Government Code requires that plans for major public works
for the ensuing fiscal year be submitted to the Planning Commission for review as to conformance with
the adopted City of Dublin General Plan; and
WHEREAS, Government Code Section 65402 (a) requires the Planning Commission to review
the proposed acquisition of property for conformance with the City's General Plan.

find that the Dublin Historic Park Acquisition project which is proposed as an amendment to the 2006-
2011 CIP is in conformance with the City of Dublin General Plan.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the Dublin Planning Commission
does hereby find that the proposed acquisition ofthe Dublin Square Shopping Center (APN 941-1560-
007-01) which is proposed as an amendment to the 2006-2011 CIP is in conformance with the City of
Dublin General Plan.
