Resolution of Intention to Amend Underground Utility District
2003-01 Dougherty Road from Sierra Lane to Dublin Boulevard,
and Dublin Boulevard from Dublin Court to Dougherty Road adding
Scarlett Court from Dublin Boulevard to a point 700 feet south of
Dublin Boulevard

Adopt Resolution of Intention, setting public hearing dates of
September 7 and September 21, 2004, for consideration of an
Ordinance amending Underground Utility District 2003-01 to
include a portion of Scarlett Court
RECOMMENDATION:
FINANCIAL STATEMENT:
This undergrounding project will be funded primarily by California
Public Utilities Commission (P.U.C.) Rule 20A funds. Some of the
associated work, such as replacement of street lights that are
currently on existing wood utility poles, is not covered under Rule
20A funds and will be paid from the Dougherty Road Improvements,
Houston Place to 1-580, Capital Improvement Project.
The City has an estimated balance of $112,000 in its P.U.C. Rule
20A account as of FY 2003-2004 and will accrue additional funds at
a rate of approximately $131,000 per year. PG&E allows cities to
"borrow out" funds three years in advance of the project; based on
this assumption, the funding available at the beginning of Fiscal
Year 2005-2006, including the "borrowed" funds, would
approximately be $636,000. The other utility companies are
required to underground their own facilities at their own cost. The
total estimated cost of under grounding the PG&E overhead facilities
is $561,000.

It is anticipated that the utility undergrounding on Scarlett Court will
not add any cost to the City's P.U.C. Rule 20A allocation use. The
existing utilities are expected to be underground in conjunction with
the adjacent development project and/or paid for by the utility
companies.
DESCRIPTION: At its regularly scheduled meeting on February 3, 2004, the City
Council adopted an ordinance establishing an underground Utility District on Dougherty Road from
Dublin Boulevard to Sierra Lane, and on Dublin Boulevard from Dublin Court to Dougherty Road.
The widening of Dougherty Road from Houston Place to 1-580 is scheduled to start construction in Fiscal
Year 2005-2006. The widening of Dougherty Road and the intersection improvements at Dougherty Road
and Dublin Boulevard are required to provide additional traffic lanes for the purpose of improving the
Level of Service (LOS) at the intersection. Preliminary design for this project is currently underway. It is
proposed that the undergrounding of utilities take place in conjunction with or prior to the construction of
the Dougherty Road Improvements project.
Staff has reanalyzed the District boundaries based on the buildings along the east side of Dougherty Road
between Interstate 580 and Dublin Blvd. being proposed for removal. Once the buildings are removed,
some large overhead utility lines will become visible from the Dougherty Road area. An investigation of
the electric utilities has been done and found that these lines will no longer be needed once the
construction begins.
Extending the Underground District down Scarlett Court will require PG&E to remove their lines and
SBC and Comcast to underground their respective lines. Since the PUC Rule 20A underground monies
only go to underground the PG&E lines and the fact that PG&E will not need lines in this segment of
Scarlett Court, there will be no additional use of the Rule 20A allocations needed.
The Dublin Municipal Code establishes a procedure for the formation of and amendments to underground
utility districts. This procedure requires adoption of a Resolution of Intention, which identifies the limits
of the District, sets a timeframe for the undergrounding to occur, and sets dates for public hearings for the
Ordinance creating or modifying the District. There is no change to the dates of the need to receive
underground utility service.
Staff recommends that the City Council adopt the Resolution of Intention, setting public hearing dates of
September 7, 2004, and September 21, 2004, for consideration of an Ordinance amending Underground
Utility District 2003-01 adding a portion of Scarlett Court.

DUBLIN BOULEVARD TO A POINT 700 FEET SOUTH ON SCARLETT COURT
WHEREAS, on February 3, 2004 the City Council adopted an ordinance establishing Underground
Utility District 2003-01 on Dougherty Road rrom Dublin Boulevard to Sierra Lane and on Dublin Boulevard
rrom Dublin Court to Dougherty Road; and
WHEREAS, as part of a concurrent roadway improvement project, building along the eastside of
Dougherty Road will be removed exposing major overhead lines; and
WHEREAS, it would greatly enhance the view of the City entrance to underground these large
overhead utility lines; and
WHEREAS, the PG&E overhead lines on Scarlett Court will no longer be needed once the adjacent
uses have been removed:
NOW, THEREFORE, BE IT RESOLVED as follows:
1) Pursuant to provisions of Municipal Code Chapter 7.12, the Dublin City Council intends to amend
Underground District 2003-01, on Dougherty Road rrom Dublin Boulevard to Sierra Lane, and on
Dublin Boulevard rrom Dublin Court to Dougherty Road, to include Scarlett Court as delineated in
Exhibit "A" attached hereto.
2) Property owners shall be ready to receive underground distribution service by March 31, 2006, and
overhead utility distribution facilities must be removed no later than June 30, 2006.
3) Public hearings for the pwpose of hearing protests and objections to the proposed Underground
Utility District 3002-01 shall be held on September 7,2004, and on September 21,2004.
4) The City Clerk is directed to give notice of such hearings in the manner designated in Municipal
Code Chapter 7.12
