FINANCIAL STATEMENT:
Toll CA II, LP (Toll Brothers, Inc.) has provided a Maintenance
Bond in the amount of $292,644.00 to replace the Performance and
Labor and Materials Bonds that guaranteed the improvements. Said
Maintenance Bond will guarantee against defects for one year.
Once these improvements have been accepted, the City will incur
maintenance and street sweeping costs for the City street
improvements. The street light maintenance costs will be paid by
the Street Lighting Maintenance Assessment District 99-1.
DESCRIPTION: Toll CA II, LP, recently completed street improvements associated
with Tract 7141, Dublin Ranch Area A, Neighborhood A-6, a subdivision located in the Eastern Dublin
Specific Plan area west of Bent Tree Drive, north of Fallon Road, and southeast of the Dublin Ranch Golf
Course. The work was governed by two separate Tract Developer Agreements, one for Street
Improvements and one for Landscaping, both executed on July 17, 2001, via City Council Resolution No.
130-01. The landscaping improvements were accepted on June 15,2004, via City Council Resolution No.
97-04. The street improvements have now been completed pursuant to the Tract Developer Agreement
and to the satisfaction of the Director of Public Works. As such, it is appropriate for the street
improvements to now be accepted by the City for permanent maintenance.
The following regulatory traffic control devices will be accepted and approved as part of this project and
added to the City of Dublin Traffic Code:

A. Stop control devices (Traffic Code Section 6.16.020) have been installed on the:
· southerly approach of Royal Pines Way at Twin Eagles Lane,
· northerly approach of Royal Pines Court at Twin Eagles Lane,
· easterly approach of Twin Eagles Lane at Bent Tree Drive,
· westerly approach of Twin Eagles Lane at Grayhawk Lane,
· westerly approach of Poppy Hills Lane at Grayhawk Lane,
· northerly approach of Royal Pines Way at Poppy Hills Lane, and
· easterly approach of Southwind Lane at Bent Tree Drive.
At the time the City and Toll CA II, LP, executed the Tract Developer Agreements, the developer
provided a Performance Bond in the amount of $780,384.00 and a Labor and Materials Bond in the
amount of $390,192.00 for street improvements to guarantee performance of the work. Now that the
work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of
the Government Code, and replaced with a Maintenance Bond in an amount necessary to guarantee the
work for a one-year period following acceptance. The developer has provided a Maintenance Bond in the
amount of $292,644.00, which is 25% of the original Performance Bonds, and which is sufficient to
guarantee the improvements for a one-year period after acceptance.
Staff recommends that the City Council adopt the Resolution accepting the improvements for Tract 7141,
Dublin Ranch Area A, Neighborhood A-6, and approving the regulatory traffic control devices.

ACCEPTANCE OF IMPROVEMENTS FOR
TRACT 7141 (DUBLIN RANCH AREA A, NEIGHBORHOOD A-6)
AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES
WHEREAS, the subdivider of Tract 7141, filed on August 21,2001, in Book 261 of Maps at
Pages 1 - 4, previously entered into two Tract Developer Agreements with the City of Dublin to improve
said Tract in accordance with plans and specifications on file with the Public Works Director, said Tract
identified as follows:

WHEREAS, the Landscape Improvements along the west side of Bent Tree Drive and the
north side of Fallon Road along the frontage of Tract 7141, as governed by one of the Tract Developer
Agreements, were completed and accepted by the City Council via Resolution No. 97-04 on June 15,
2004; and
WHEREAS, the street improvements associated with Tract 7141, as governed by the remaining
Tract Developer Agreement, are complete in accordance with said plans and specifications, and any
approved modifications thereto, to the satisfaction of the Public Works Director; and
WHEREAS, the developer has installed certain regulatory traffic control devices as a part ofthe
Tract improvements; and
WHEREAS, the original improvement Performance Bond and Labor and Materials Bond that
guaranteed the Street hnprovements can be released, in accordance with the authority contained in
§66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond
to guarantee the completed work for a one-year period following acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
1.
The improvements completed within said Tract are hereby approved and accepted subject
to a one-year guarantee period; and
2.
The traffic regulatory devices installed by the developer are hereby included in the City of

a) Stop control device installed on the southerly approach of Royal Pines Way at Twin

b) Stop control device installed on the northerly approach of Royal Pines Court at Twin
Eagles Lane.

d) Stop control device installed on the westerly approach of Twin Eagles Lane at
Grayhawk Lane.
e) Stop control device installed on the westerly approach of Poppy Hills Lane at
Grayhawk Lane.

3. The original Performance Bond issued by The Continental Insurance Company (Bond No.
929200647) in the amount of$780,384.00 be released; and
4. The original Labor and Materials Bond issued by The Continental Insurance Company
(Bond No. 929200647) in the amount of$390,192.00 be released; and
5. The submitted Maintenance Bond issued by The Continental Insurance Company in the
amount of $292,644.00 (Bond No. 929328710) for street improvements be accepted as
security for the aforesaid one-year maintenance period, said period to commence on this
date and terminate on the 17th day of August, 2005.
