RECOMMENDATION: FINANCIAL STATEMENT: Toll CA II, L.P., has provided Maintenance Bonds in the amounts of $325,500 for Fallon Road and $61,609 for Signal Hill Drive, for a total of $387,109, to replace the Performance Bonds and Labor and Materials Bonds that guaranteed the improvements. Said Maintenance Bonds will assure the correction of latent defects for one year following acceptance. Once these improvements have been accepted, the City will incur maintenance and street sweeping costs for Fallon Road and Signal Hill Drive. Street light maintenance costs will be paid by Street Lighting Maintenance Assessment District 99-1. DESCRIPTION: Toll CA II, L.P. (Toll Brothers, Inc.) recently completed street improvements on Fallon Road north of Antone Way and Signal Hill Drive along the frontage of the Dublin Ranch Golf Course Clubhouse and Recreation Facility, associated with Tract 7252, Dublin Ranch Area A. This work was governed by three separate Tract Developer Agreements executed on December 4, 2001 pursuant to City Council Resolution No. 206-01, as amended by Resolution No. 225-02, as follows: 1) Traffic signals on Fallon Road at Kingsmill Terrace/Signal Hill Drive and on Fallon Road at Turnberry Drive 2) Fallon Road and Signal Hill Drive Landscaping 3) Street improvements for the extension of Fallon Road north of Antone Way and Signal Hill Drive along the frontage of the Dublin Ranch Golf Course Clubhouse and Recreation Facility - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - COPIES TO: H. The Fallon Road and Signal Hill Drive Landscaping is nearly complete and will be recommended for acceptance in the near future. Street improvements for the extension of Fallon Road north of Antone Way and Signal Hill Drive along the frontage of the Dublin Ranch Golf Course Clubhouse and Recreation Facility have been constructed pursuant to the Tract Developer Agreement and to the satisfaction of the Public Works Director. It is therefore appropriate for these improvements to now be accepted by the City for permanent maintenance. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. Fallon Road and Signal Hill Drive are each designated as a "Through Street" (Traffic Code Chapter 6.08). B. "No Parking Anytime" restriction has been installed on both sides of Fallon Road north of Antone Way (Traffic Code Chapter 6.04.250). C. "No Parking Anytime" restriction has been installed on both sides of Signal Hill Drive along the frontage of the Golf Course Clubhouse and Recreation Facility (Traffic Code Chapter 6.04.250). At the time the City and Toll CA II, L.P., executed the Tract Developer Agreements governing the improvements for Fallon Road and Signal Hill Drive, the developer provided Performance Bonds and Labor and Materials Bonds each totaling $1,548,435 ($1,302,000 for Fallon Road, and $246,435 for Signal Hill Drive) to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with Maintenance Bonds in amounts necessary to guarantee the work for a one-year period following acceptance. The developer has provided Maintenance Bonds in amounts totaling $387,109.00 ($325,500.00 for Fallon Road, and $61,609.00 for Signal Hill Drive), which is 25% of the original Performance Bond amounts, and which is sufficient to warranty the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the street improvements for Fallon Road and Signal Hill Drive associated with Tract 7252, Dublin Ranch Area A, and approving the traffic control devices. ~"'þ Page 2 ~U"",- \~? RESOLUTION NO. ~ 04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF STREET IMPROVEMENTS FOR FALLON ROAD AND SIGNAL HILL DRIVE ASSOCIATED WITH TRACT 7252 (DUBLIN RANCH AREA A) AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES WHEREAS, the developer of Tract 7252, filed on March 22,2002, in Book 263 of Maps at Pages 63 - 68, previously entered into three (3) Tract Developer Agreements with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the Public Works Director, said Tract identified as follows: e) City Streets Affected: Toll CA II, L.P. Fallon Road north of Antone Way 10 bulk parcels for subsequent subdivision as Dublin Ranch, Neighborhoods A-I through A-5, plus various golf course parcels No. 206-01, as amended by No. 225-02, Dublin City Council Fallon Road and Signal Hill Drive a) Developer: b) Tract Location: c) Tract Size: d) Resolution Approving Agreement: WHEREAS, the three agreements govern the following improvements: 1. Traffic signals on Fallon Road at Kingsmill Terrace/Signal Hill Drive and on Fallon Road at Tumberry Drive; 2. Fallon Road and Signal Hill Landscaping; 3. Street improvements for the extension of Fallon Road north of Antone Way and Signal Hill Drive along the frontage of the Dublin Ranch Golf Course Clubhouse and Recreation Facility; and WHEREAS, traffic signals on Fallon Road at Kingsmill Terrace/Signal Hill Drive and on Fallon Road at Turnberry Drive, as governed by the first of the three Tract Developer Agreements for Tract 7252, were completed and accepted on January 20,2004, via City Council Resolution No. 10-04; and WHEREAS, the Fallon Road and Signal Hill landscaping, as governed by the second of three Tract Developer Agreements for Tract 7252, is nearing completion and will be recommended for acceptance in the near future; and WHEREAS, the street improvements for Fallon Road and Signal Hill Drive, as governed by the third of three Tract Developer Agreements for Tract 7252, are now complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the original Performance Bonds and Labor and Materials Bonds associated with the street improvements for Fallon Road and Signal Hill Drive can be released in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with I 0- lCC -0 t..t 14 - Y - 1 - ATTACHMENT' ~t~ Maintenance Bonds in amounts necessary to guarantee the completed work for a one-year period following acceptance. NOW, THEREFORE, BE IT RESOLVED that: 1. The street improvements for Fallon Road and Signal Hill Drive completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and 2. The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: a) Fallon Road and Signal Hill Drive are each designated as a "Through Street". b) "No Parking Anytime" restriction on both sides of Fallon Road north of Antone Way. c) "No Parking Anytime" restriction on both sides of Signal Hill Drive along the frontage of the Golf Course Clubhouse and Recreation Facility. 3. The original Performance Bond issued by The Continental Insurance Company (Bond No. 929213840) in the amount of$I,302,000.00 be released; and 4. The original Performance Bond issued by The Continental Insurance Company (Bond No. 929218643) in the amount of $246,435.00 be released; and 5. The original Labor and Materials Bond issued by The Continental Insurance Company (Bond No. 929213840) in the amount of$I,302,000.00 be released; and 6. The original Labor and Materials Bond issued by The Continental Insurance Company 929218643) in the amount of $246,435.00 be released; and 7. The submitted Maintenance Bond issued by The Continental Insurance Company (Bond No. 929328712) in the amount of$325,500.00 for Fallon Road be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 19th day of October, 2005. 8. The submitted Maintenance Bond issued by The Continental Insurance Company (Bond No. 929328711) in the amount of$61,609.00 for Signal Hill Drive be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 19th day of October, 2005.
