APPLICABLE REGULATIONS:
section 8-26.3 (Conditional Uses: R-1 District) of the
City's zoning Ordinance indicates community facilities including
day care centers are subject to approval of a Conditional Use
Permit.
section 8-94.0 states that conditional uses must be analyzed
to determine: 1) whether or not the use is required by the public
need; 2) whether or not the use will be properly related to other
land uses, transportation and service facilities in the vicinity;
3) whether or not the use will materially affect the health or
safety of persons residing or working in the vicinity; and 4)
whether or not the use will be contrary to the specific intent
clauses or performance standards established for the district in
which it is located.
ENVIRONMENTAL REVIEW: This project has been found to be
Categorically Exempt from CEQA under section 15301, Class 1 of
the California Environmental Quality Act guidelines. This use
consists of the operation of an existing day care and preschool
involving no expansion of use beyond that previously existing.
NOTIFICATION: Public Notice of the January 22, 1991 hearing was
published in the local newspaper, mailed to adjacent property
owners, and posted in public buildings.
ANALYSIS:
The Applicant is requesting approval of a Conditional Use
Permit to continue operation of a day care and preschool for a
maximum of 34 children between the ages of 2-1/2 and 6 years old.
The existing Conditional Use Permit, PA 85-093, expired on
November 18, 1990. On November 20, 1990, the Applicant submitted
a Conditional Use Permit application requesting to continue the
existing day care and preschool use.

The day care/preschool occupies a single family residence
including the garage which has been converted to classrooms, play
areas and an office. The dwelling is no longer used for
residential purposes and is used solely as a day care and
preschool center. The hours of operation are between 7:00 a.m.
and 6:00 p.m.
During the past 5 years, the Wonderful World of Learning Day
Care and Preschool has operated in compliance with the previous
Conditional Use Permit requirements. staff has not received any
complaints concerning the parking, traffic or noise generated by
the operation of the day care.
The application has been reviewed by the applicable City
departments with appropriate conditions identified in the draft
resolution, and is in compliance with the City's Zoning
Ordinance.

RESOLUTION NO. 91 -
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
---------------------------------------------------------------------
APPROVING PA 90-118 WONDERFUL WORLD OF LEARNING CONDITIONAL USE PERMIT
APPLICATION TO CONTINUE OPERATION OF A DAY CARE AND PRESCHOOL CENTER
AT 8010 HOLANDA LANE
WHEREAS, Ramon Ortega filed an application for a Conditional Use
Permit to allow the continued operation of a day care/preschool for a
maximum of 34 children at 8010 Holanda Lane; and
WHEREAS, the City of Dublin Zoning Ordinance allows the operation
of day care uses in residential areas subject to approval of a
Conditional Use Permit; and
WHEREAS, the Planning commission did hold a public hearing on
said application on January 22, 1991; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and was
found to be categorically exempt under Section 15301, Class 1; and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved, subject to conditions; and
WHEREAS, the Planning commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
A. The existing use will serve a public need by providing
facilities for parents in need of child care/preschool
services.
B. The use will be properly related to other land uses and
transportation and service facilities in the vicinity, in
that the daytime activities of the existing use will be
commensurate with the existing single-family residential
neighborhood.
C. The use, under all circumstances and conditions of this
particular case, will not materially adversely affect the
health or safety of persons residing or working in the
vicinity, or be materially detrimental to the public welfare
or injurious to property or improvements in the
neighborhood, as all applicable regulations will be met.
D. The use will not be contrary to the specific intent clauses
or performance standards established for the district in
which it is to be located, in that conditions have been
applied to insure conformance with the Zoning Ordinance.

BE IT FURTHER RESOLVED THAT THE Dublin Planning commission does
hereby conditionally approve PA 90-118 Wonderful World of Learning
Conditional Use Permit as shown on Exhibit A, dated received
November 20, 1990, and on file with the Dublin Planning Department,
subject to the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise. all Conditions of Approval shall be complied
with prior to the issuance of building permits or establishment of
use. and shall be subject to Planning Department review and approval.
1. PA 90-118 Wonderful World of Learning Day care/Preschool is
approved as generally depicted on the attached site plans
submitted to the Planning Department on November 20, 1990 and
subject to conditions of approval.
2. The day care and preschool center shall be limited to a maximum
of 34 children.
3. Hours of operation for the day care/preschool center shall be
limited to the hours between 7:00 a.m. and 6:00 p.m.
4. School noise shall be controlled so as not to create a nuisance
to the adjoining residential neighborhood.
5. The existing driveway shall be kept clear to accommodate vehicles
dropping off and picking up children attending the facility.
6. The day care/preschool operators shall direct patrons of the
facility dropping off and picking up children to exit and enter
Vomac Road via Holanda Lane rather than via Millbrook Avenue.
7. The day care/preschool operator shall, at the minimum, on an
annual basis make arrangements to have the Dublin Police Services
Child Abuse Program or an equivalent program presented to the
center's Staff and children attending the facility, and upon
completion of the program, submit a written statement to the
Planning Department verifying the presentation.
8. The Applicant shall submit to the Planning Director copies of
applicable state licenses and permits and any renewal or
extensions of such documents to operate (or continue to operate)
a day care/preschool.
9. This approval shall be null and void in the event the approved
use ceases to operate for a continuous one-year period.
10. Upon termination of the day care/preschool use, the Applicant
shall convert the structure to a single family residence with
the garage accessible for parking cars.
11. The Applicant has posted a cash deposit with the City of Dublin
in the amount of $500.00 (five hundred dollars) to secure the
faithful performance of Condition #10 (single family residence

conversion). Said cash deposit shall guarantee that these funds
will be available and that the instrument of credit will remain
effective until termination of the day care/preschool use.
12. No future modifications to the site or exterior portion of the
residence shall be done without prior review and approval of the
Planning Director and must comply with all applicable zoning,
building code and engineering regulations including issuance of
building permits.
13. The Applicant shall comply with all the requirements of the
Dougherty Regional Fire Authority.
14. No exterior signs identifying the name of the day care/preschool
facility shall be allowed.
15. On at least an annual basis, this Conditional Use Permit shall be
subject to Zoning Investigator review and determination as to
compliance with the conditions of approval.
16. This permit shall be revocable for cause in accordance with
section 8-90.3 of the Dublin Zoning Ordinance. Any violation of
the terms of conditions of this use permit shall be subject to
citation.
PASSED, APPROVED AND ADOPTED this 22nd day of January, 1991.

We are licensed for 34 children ages from 2~ to 6 yrs.
We range from a low of 20 children to the maximum of
34 children.
We have three teachers and 2 aids as our staff.
The staff park in the street leaving the driveway open
for parents.
