Adopt Resolutions if written protests are insufficient FINANCIAL STATEMENT: It is proposed that the solid waste rates in the City of Dublin be increased by approximately 19.9% in order to generatc the compensation required to satisfY the requirements of the City's new solid waste collection services agreement with Amador Valley Industries (A VI). This increase can be primarily attributed to the rising cost of doing business in the Bay Area and the myriad of-new programs and services offered to the community as part of the new agreement. The new agreement provides a cap of five (5%) percent per year on future annual rate increases. An annual fee is collected on the Property tax bill for the cost of Basic Residential Garbage Service. The proposed 2005/2006 Annual Assessment is $146.04 per household. DESCRIPTION: The City's existing contract with Waste Management expires on June 30, 2005. In 2004, the City conducted a competitive proposal process for solid waste services. On December 6, 2004, the Council awarded a ncw 7- year collection service contract to Amador Valley Industries, which offered the best proposal to the City. In January 2005, the City executed the collection service agreement with Amador Valley Industries (A VI) for service to begin July I, 2005. The agreement between the City and A VI requires the City to adopt a rate schedule, which is estimated to produce a specified revenue amount as identified in the Agreement. The City has also adopted an Ordinance, which requires all parcels in the City to subscribe to weekly minimum garbage service. This minimum service includes curbside collection of a 35 gallon garbage container, up to two (2) organic waste carts up to 96 gallons each, up to two (2) recycling carts up to 96 gallons each, used oil and filters, an annual household hazardous waste drop off event and three on-call bulky waste pick -ups per year. Residents desiring larger garbage carts are billed dircctly by the Company for the ineremental rate difference. The City pays the service cost for minimum residential service with monies collected from the property tax bill. GARBAGE RATE CALCULATION Garbal!e Rate Backl!round The current garbage rates became effective July 1, 2003. The rates need to be adjusted in order to meet the compensation requirements of the new agreement with A VI. Detailed Comoarison of Current and Proposed Rates The proposed rate structure is estimated to meet the compensation requirement of $6,039,660 included in thc new agreement. For Fiscal Year 2005-2006 it is proposed that all rate categories increase by approximately 19.9%. The proposed rate increase can primarily be attributed to the rising cost of doing business in the Bay Area and the new programs and services offered to the community as part ofthe new agreement. The new agreement provides a cap of five (5%) percent per year on future annual rate increases. While many ofthe programs will remain unchanged, City residents will be offered several new recycling programs, many not offered by othcr Tri- Valley jurisdictions. Some of the new programs include; residential food scrap collection; multi-family bulky waste collection; free community compost giveback; free curbside collection of items such as electronic waste, household batteries, oil filters, tires, white and brown goods; the "Go Green" enviromnental education program offered to all Dublin schools; and the ability for residents to add an additional organics and/or recycling cart at no additional charge. For commercial customers, recycJing services will now be bundled with the standard garbage rate, similar to the residential program. In addition, the collection vehicle fleet will be the first in the Tri-Valley to have 100% natural gas vehicles, eliminating harmful diesel emissions, and contributing to the improvement of the Tri-Valley's air quality. Attachment I compares the proposed rates to the current rates for service levels, which represent a majority of the subscribers in the City. The proposed rates would be effectivc July I, 2005. Comoetitiveness of Dublin Rates with Neil!hborim! Al!encies As shown in Attachment 2, the proposcd City of Dublin rates remain very competitive compared to rates charged for similar services in surrounding communities. In most cases, the City of Dublin servicc levels are at least comparable, and often better than the survey citics. For example, Pleasanton does not offer any bulky waste pick-ups and Livermore and San Ramon charge extra for many ofthe items such as electronic wastc, and appliances that A VI will pick up free of charge for Dublin residents. Therefore, the City of Dublin customers receive more services. For most rate categories, the proposed City of Dublin rates are similar and in many cases below the average ofthe Tri-VaIJey agencies surveycd. Annual Fee For Minimum Residential Garbal!e Service The City Council will need to establish the annual fee, which is collected with the property tax for residential properties, separately from the rates for other levels of service. The proposed fee for Fiscal Year 2005-2006 is $146.04, which equates to $12.17 per month. The monthly equivalent is the same amount the City will pay the company_ The additional cost of collcction and delinquencies are expected to be covered from the following tJutß sources: prior year fund balance; penalties and prior year taxes collected by the County Tax Collector; and interest on funds held prior to payment to the Company. The proposed annual assessment for 2005/2006 represents a 19.9% increase over the Fiscal Year 2004-2005 assessment. The notice was mailed to all parcel owners on March 18, 2005. Proposition 218 has very specific criteria which must be considered prior to the adoption of this fee. Specifically, Section 6(2) Property-Related Fees and Charges - states the following: The agency shall conduct a public hearing upon the proposed fee or charge not less than 45 days after mailing the notice of the proposed fee or charge to the record property owners of each identified parcel upon which the fee or charge is proposed for imposition. At the public hearing, the agency shall consider all protests against the proposed fee or charge. If the written protests against the fee or charge are presented by a majority of owners of the identified pareels, the agency shall not impose the fee or charge. At the time the Agenda Statement was prepared, the City had receivcd five (5) written protests, which have been included as Attachment 5. The City Council must consider all written protests received at the time of the public hearing. If a majority of property owners subject to the fee submit written protests, the City Council may not adopt the Resolution. Ifless than a majority of written protests are received, the City Council may adopt the Resolution. Recommendation Attached to the Agenda Statement is a Resolution (Attachment 3), which will establish the Amador Valley Industries Rate Schedule in accordance with the Franchise Agreement, under which the Company operates in the City of Dublin. Staff recommends that the City Council conduct a Public Hearing and update the calculation of any additional written protests received. Following the Public Hearing, Staff recommends that the City Council deliberate and adopt the Resolutions. ~~? I~I'].... NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby adopt the Rate Schedule attached hereto, marked Exhibit A and by reference made a part hereof. BE IT FURTHER RESOLVED that, upon the effective date, July I, 2005, this resolution shall supersede all previous resolutions adopting rates for solid waste services, and the rates adopted by this resolution shall continue from year to year. AYES: NOES: ABSENT: ABSTAIN: Mayor ATTEST: City Clerk ATTACHMENT 3 ~I~ PROPOSED ADJUSTMENT TO GARBAGE COMPANY RATES Affected Parcels Chapter 5.32 of the Dublin Municipal Code requires for the protection of the health safety and welfare of the community that all parcels obtain minimum weekiy garbage service. Amador Valley Industries, Inc. is the authorized garbage collection and disposal firm operating within the City. The agreement between the City of Dublin and Amador Valley Industries. Inc. provides that the City shall adopt a rate schedule which is estimated to allow the Company to achieve a fixed amount of annual revenue. Therefore, the adoption of these fees will affect all parcel owners. Rates are effective July 1. 2005. Basis of Fees The City has negotiated a multi-year agreement with Amador Valley Industries, Inc. The Company may request a change in rates based upon a formula which includes' changes in the Refuse Rate Index; Increased Regulatory Fees; and changes in the total tons delivered to the Landfill. The additional costs of each of these components has been allocated to the three classes of service: Residential; Commercial Bin Service; and Drop Box/Compactor. RESIDENTIAL RATES Company Minimum Residential Collection Rate: Applies separately to each single family unit as well as each unit within a duplex or other attached housing, which receives individual garbage collection services. The rate applies to the initial 35 gallons of garbage capacity, including once per week collection and disposal; Weekly Curbside Residential Recycling: and Weekly Curbside Organic Waste Recycling; Large Item Collection Service; and access to an Annual HHW drop-off event. All containers are provided by the Company. NOW, THEREFORE, BE IT RESOLVED that, the City Council of the City of Dublin does hereby approve and establish the collection of minimum residential services fees by the City on the property tax bill as shown in Exhibit A, which is attached hereto and hereby incorpomted by reference. AYES: NOES: ABSENT: ABSTAIN: Mayor ATTEST: City Clerk ATTACHMENT 4 City of Dublin ì"b 12.- RESIDENTIAL MINIMUM GARBAGE I RECYCLING SERVICES (Collected With Residential Property Tax Bills) Basis of Fees The City has negotiated a multi-year agreement with Amador Valley Industries (A VI) requiring a rate adjustment to the residential minimum garbage/recycling services collected with the property tax bills. The current annual fee of$121.80 per year will increase $24.24 for a total of$146.04 for 2005-2006. The annual assessment equates to a monthly increase of$2.02, from $10.15 to $12.17. Each year thereafter, annual adjustments to the rates will be based upon annual changes in tíve separate Indices maintained by tbe Bureau of Labor Statistics (Refuse Rate Index), plus pass-through disposal costs. The five indices account for cost changes in the following categories: labor; fuel and oil; vehicle replacement; vehicle maintenance; and all other costs_ There is a 5% cap on the annual adjustment to the Refuse Rate Index. In order to determine the fee, the City estimates the total revenue required to pay the Garbage Company for Minimum Service to all residential units which are eligible to use the service, according to the terms of the agreement with A VI. The specific factors considered in this calculation include the following components: the residential rate for Minimum Service; estimated number of housing units affected by the fee; costs associated with the collection of the fee as part of the Property Tax Bill; estimated delinquencies; estimatcd revenues from late payments and interest eamings; and funds available from collections in a prior year. Affected Parcels Chapter 5.32 of the Dublin Municipal Code requires for the protection ofthe health safety and welfare ofthe community that all parcels obtain minimum weekly garbage service. Residential housing units are billed for thc cost of Minimum Garbage/Recycling Services, whicb is included with the annual property tax bill. This fee only applies to residential units which have individual garbage containers and are not serviced by central bins. This does include duplexes and other attached housing types, which receive individual service. Households subject to this fee which only receive Minimum Service, will not be billed by the Garbage Company. The City's new solid waste collection service provider, Amador Valley industries will bill customers each quarter for additiona] services, if a household selects weekly garbage collection of a container larger than the 35 gallon container included in the Minimum Service Level. What Services Are Provided By The Fee Minimum service includes weekly curbside collection of a 35 gallon garbage container, up to two organic waste carts up to 96 gallons each, up to two recycling carts up to 96 gallons each, used oil and filters, an annual household hazardous waste drop off event and three on-call bulky waste pick-ups per year. Amount of the Fee The annual amount of the assessment includes the cost of collection as well as the cost of services over the cntirc year. The City makes the payment to Amador Valley Industries based upon the current rate allowed tor Minimum Residential Service_ ANNUAL FEE $146.04 $ 146.04 $ 292.08 $146.04times the number of units Although the proposed Fiscal Year 2005-2006 fee is a 19.9% increase over the 2004-2005 fee, the amount is similar to othcr neighboring jurisdiction that offer fewer services.
