Adopt resolution approving Parcel Map 8310, accepting the Offer of
Dedication for Street Purposes, and accepting the Grant of
Conservation Easement.
FINANCIAL STATEMENT:
No new public improvements are proposed under Parcel Map 8310,
and the City will not incur any new maintenance costs.
DESCRIPTION: Parcel Map 8310 subdivides the existing Valley Christian School
property located at the northwest and northeast comer of Dublin Boulevard and Inspiration Drive. Street
and other public improvements currently exist. Two small triangles of public right-of-way located at the
corners of Dublin Boulevard and Inspiration Drive will be dedicated to the City with this Parcel Map, in
conformance with the Conditions of Approval. The Conditions of Approval also require dedication of a
conservation easement over portions of Lot 3. Said easement will be offered for dedication under a
separate grant deed. Because no new on-site or public improvements are needed, the developer is not
required to enter into an improvement agreement or tender any security.
Parcel Map 8310 has been reviewed and found to be in conformance with the Tentative Parcel Map
and Conditions of Approval approved by the Community Development Director Resolution No. 3-17 on
April 22, 2003.
Staff recommends that the City Council adopt the resolution approving Parcel Map 8310, accepting the
Offer of Dedication for Street Purposes, and accepting the Grant of Conservation Easement.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

APPROVING PARCEL MAP 8310 (VALLEY CHRISTIAN SCHOOL),
ACCEPTING OFFER OF DEDICATION FOR STREET PURPOSES
AND ACCEPTING GRANT OF CONSERVATION EASEMENT
WHEREAS, Parcel Map 8310, in the incorporated territory of the City of Dublin, State of
California, has been presented to this City Council for approval, aU in accordance with provisions of the
Subdivision Map Act of the State of California and thc City of Dublin Municipal Code; and
WHEREAS, the City of Dublin Planning Commission adopted Resolution No. 03-17 on April 22,
2003, approving the Vesting Tentative Map and Site Development Review for Parcel Map 8310, subject
to Conditions of Approval regarding required on-site/off-site improvements (P A 00-017); and
WHEREAS, Parcel Map 8310 inc!udcs an offer of dedication for public street purposes to the
public; and
WHEREAS, Condition No, 39 of the Conditions of Approval requires the dedication of a
conservation easement ovcr a portion of Parcel 3 as shown on the Tentative Map; and
WHEREAS, a grant of conservation easement has been received from Vaney Christian School in
compliance with Condition No. 39;
NOW, THEREFORE, BE IT RESOLVED that Parcel Map 8310 is hereby approved, and that
rights to the areas marked as offered for dedication to public use for public street purposes in conformity
with the terms of dedication are hereby accepted, and that the Clerk of this City Council is hereby directed
to transmit said Map to the County Recorder for filing.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized by the City Council to
accept the grant deed, attacbed hereto as Exhibit "A."

GRANT OF CONSER VA TION EASEMENT
This Grant of Conservation Eascmcnt is made by Valley Christian Center of
Dublin ("VCC") in favor of the City of Dublin, California, a municipal corporation
("City").
RECITALS
A. VCC owns that certain real property in the City of Dublin commonly
known as 7500 Inspiration Drive, Dublin, California ("the Property").
B. VCC recently sought City approval for a master plan for the future
development of the Property and an associated parcel map ("the Approvals") and
expressed a desire that certain portions of the property remain permanently undeveloped.
The Approvals were finally granted by City Counci1 Rcsolution Nos. 092-03 and 093-03
adoptcd on May 20, 2003. In conjunction with the Approvals, VCC agreed to a condition
that requires the recordation of a conservation easement or deed restrictions that precludc
development on those portions of the Property.
C, Accordingly, VCC and City desire to limit the use of a portion of the
properly more particularJy described in Exhibit A attached hereto, by grant of a
conservation easement in order to reduce potential adverse impacts on such land
including grading, vegetation removal, and erosion, recognizing that such land is
cssentially unimprovcd and if rctained in its natural state has substantial scenic value to
the public and that the preservation of such land as open space constitutes an important
physical, social, aesthetic and economic asset to the City and to YCC.
D. City has indicatcd that the conservation easement that would be crcatcd by
the acceptance of this grant is consistcnt with the City's General Plan, satisfics the
conditions of the Approvals, and is in the bcst interests of the City.
NOW, THEREFORE, YCC, as grantor, hereby grants, conveys, and transfers a
conservation easement to the City of Dublin, a municipal corporation, County of

Alameda, State of California, over the real property described and shown as Exhibit A,
("the Site"), to have and to hold said conservation easement for the term and for the
purposes and subject to the conditions, covenants, and exceptions described herein.
1. Statutory Authorization. This grant of conservation easement is made and
entcred into pursuant to Chapter 4 commencing with Section 815 of Part 2, Division 2,
Title 2 of the Civil Code. It is subject to all of the provisions of said scctions and
chapters including any amendments thereto which may hereafter he enacted.
2. Restriction on Usc of Sitc. During the term of this conservation easement
granted herein, the Site shall not be used for any purpose other than a conservation
easement and those uses related to or compatible therewith. VCC, for the direct benefit
of the Site described herein, hereby declares that the Site shall be subject to restrictivc
covenants running with the land which shall be binding upon all subsequent grantees.
Said restrictivc covenants shall be:
a. against the right of VCC to construct any improvements on or
within the Sitc except for public and private utilities. provide these reserved exceptions
shall he consistent with the purposes of maintaining and preserving the natural or scenic
character of the land; and
b. against the extraction of natural resources or other activitics which
may destroy the unique physical and scenic characteristics of the land; and
c. against the grading of land for reasons other than attendant to
permitted uses; and
d. against the erection of structurcs othcr than lawful fences.
Notwithstanding the foregoing, VCC may landscape the Site and may perform such
ordinary and customary activities as are necessary to maintain such landscaping. VCC
may also pcrform weed abatement activities in conformance with the City's Wildfire
Management Plan,
3. ExceDtions. The Dublin City Council may authorize exceptions to the
foregoing restrictive covenants, provided such exceptions are consistent with the
purposes of law and not incompatible with maintaining and preserving the natural
character of the land.
4. Restrictions on Public Use. The public shall not have a right of entry upon
the Site, The right of entry and surface use is limited solely to the City, but only for the
purpose of inspection of condition of the Property.
5. Term of Easement. Upon acceptance, this conservation easement shall
remain in effect in perpetuity, unless abandoned pursuant to Government Code Sections
51093 and 51094, or any successor legislation.

7. Successors in Interest. This conservation easement shall TUn with the
Property and shall be binding upon and inure to the benefit of the heirs, successors and
assigns of the parties hereto.
