DESCRIPTION: On January 18, 2005 the City Council awarded Contract 04-15 to
Golden Bay Fence Plus Iron Works, Inc. to complete the modifications to Baseball Field B. At this time
the construction is completc. Staff along with rcpresentatives from Golden Day Fence Plus Iron Works
completed a walkthrough of the project on June 16,2005 and all elements ofthe project were finished.
The City presently holds a pcrformancc bond in thc amount of $90,173.91 to provide thc necessary
security for the performance of the work involved. As the work is now complete, the performance
security rcquirement can be rcduced, in accordance with authority contained in Section 66499.7 of the
Govermnent Code, to an amount necessary to guarantee warranty of the work for a one-year period
Ib1l0wing acceptance of the work. The Contractor wi11 provide a new maintenance bond in the amount of
$9,017.39, which is 10% of the final contract amount, and is sufficient to cover the one-year guarantee
period.
Upon City Council acceptance of the project, Staff will file a notice of completion with Alameda County
Clerk. The City will release the 10% retention thirty-five days subsequ.ent to recording the notice of
completion with Alameda County.
It is the recommendation of Stafl'that the City Council take the It11l0wing action:
1) Accept the final facility improvcmcnts;
2) Adopt Resolution accepting the completed facility improvements; and
3) Authorize Staff to accept a maintenance bond in the amount 01'$9,017.39 at a future date.

RESOLUTION NO. - 05
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

ACCEPTING IMPROVEMENTS TO EMERALD GLEN PARK BACKSTOP
WHEREAS, Golden Bay Fencc plus Ironworks, Inc. entered into a contract with the City of
Dublin to complete the construction of the Emerald Glen Park Backstop in accordance with plans and
spccifications on filc with the City Enginccr; and
WHEREAS, said improvements have been completed in accordance with said plans and
specifications, and any approved modifications thcrcof, to the satisfaction of said City Engineer of the
City of Dublin; and
WHEREAS, as a condition or said contract, Golden Bay Fence plus Ironworks, Inc, is required to
guarantee the improvements for a period of onc ycar following acceptance of the work by the said City of
Dublin; and
WHEREAS, as improvements are now completed, the original performance bond sccurity
rcquirement can be reduced, in accordance with the authority contained in Section 66499.7 of the
Government Code of the State of California, to an amount found necessary to guarantee maintenance of
the completed work for the aforesaid one-year period;
NOW, THEREFORE BE IT RESOLVED that:
1. The improvements completed within the said Facility, are hereby approved and
acccptcd subjcet to the aforesaid one-year guarantee; and
2. The aforesaid performance bond security requirement may be reduced from thc
amount 01'$90,173.91 to the amount of $9,017.39 upon acceptance by Staff of the
replacement maintenance bond as security for the aforesaid one-year maintenance
period; and
3. Thc said original pcrformance bond in the amount of $90,173.91 posted in
connection with the work involved in the construction of said Facility be hereby
released upon acceptance of said maintenance bond.
PASSED, APPROVED AND ADOPTED this 21 st day of June 2005.
