DESCRIPTION: Mayor Lockhart requests that $20,000 in financial assistancc, which would go to the Katrina Hurricane Relief Efforts, be considered by the City Council. In the past, the City has made financial assistance available toward the victims of the tragic events that occurred on September 11,2001 and the South Asia Tsunami in Dccember 2004. In each of these events the City has uscd the American Red Cross to help distribute the necessary funds needed to aid thc victims ofthese disasters. The California Constitution prohibits gifts of public funds, howcver, an expenditure is not considered a "gift" if it serves a public purpose, If a City Council makes a determination that it does constitutc a public purpose, in the past the courts have supported this type of determination. As it relates to the Katrina Hurricane Relief efforts, Staff believes that thc City Council can find that the donation would serve a public purpose by creating an atmosphere of reciprocal good will, simply stated if the City of Dublin or the Bay Area were to ever face a major catastrophe it might rcceive similar donations from other communities. Mayor Lockhart is requesting that instead of a matching program that was done previously with the South Asia Tsunami Victims, the funds, if approvcd, are made immediately to the Amcrican Red Cross. The City would still complete Outrcach Efforts within the Dublin Community on this relief effort. ---------~__W________________~_R____._____________________~__________._______________________________________ COPIES TO: ITEM NO. B.L H/cc-formslagdastrnt.doc \Db'- {}' Proposed Outreach Efforts If the City Councils dircction were to support the financial assistance request, Staff would propose the following outreach cffort: Post the infomlation on thc City Website with a direct link to thc American Red Cross Prepare various media releases (which would indude print, television, and radio) on the City's contribution on behalf of the Dublin community to the Katrina Hurricane Relief Efforts. Sct-up a City phone line for 30 days to help facilitate contributions to this disaster effort. Recommendation: It is recommended that thc Council consider a $20,000 appropriation from the City's Contingent Reserve to aid with thc Katrina HLlrricane Relief Efforts based on the criteria that it serves a public purpose and approve the proposcd outreach efforts, or supply Staff with additional direction. .. 2.lb "2...
