Adopt Resolution Authorizing Execution of the MOU FINANCIAL STATEMENT: Dublin Unified School District agrees to contribute $40,000 to the City in a cooperative effort to sustain a School Resource Officer position for Fiscal Year 2006-2007 DESCRIPTION: The School Resource Officer program, formally implemented in September of 2000, was created with the purpose of maintaining a safe and secure environment for all schools in the Dublin Unified School District (DUSD). Since inception, the program has been highly successful in achieving this objective. In Fiscal Year 2005-2006, a second SRO was added to Dublin Police Services in an effort to maintain service delivery while keeping pace with growth and the increasing student population. In September 2000, a $125,000 federal grant award, through the COPS in Schools program, made creation of the original SRO position possible. The grant required that the City and DUSD work cooperatively to support the program goals. The grant funding was allocated over a period of three years, and required that the City continue to fund the position for a fourth year. The obligation to retain the original position formally ended June 30, 2004; however, DUSD has continued to contribute $40,000 each year to assist in supporting the SRO program. This MOU identifies the goals of the SRO; describes the responsibilities of each entity; and discusses the continued funding agreement. For Fiscal Year 2006-2007, DUSD has agreed to continue their $40,000 contribution, as part of a cooperative effort to sustain the original SRO position. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution authorizing execution of the MOU between Dublin Unified School District and City of Dublin for the School Resource Officer. COPY TO: ITEM NO. ~.~ Page 1 of 1 G:\Records\SRO MOU agenda statement II-OI-05.doc li RESOLUTION NO. - 06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ******** MEMORANDUM OF UNDERSTANDING BETWEEN CITY OF DUBLIN AND DUBLIN UNIFIED SCHOOL DISTRICT FOR SCHOOL RESOURCE OFFICER WHEREAS, through a federal COPS in Schools grant, the School Resource Officer program was formally implemented in September of 2000, to maintain a safe and secure environment for all schools in the DUSD; and WHEREAS, $125,000 was awarded for the School Resource Officer, distributed over a period of three years; and WHEREAS, the grant required that the School Resource Officer position be maintained for one full budget cycle after the grant funding ended; and WHEREAS, the obligation to retain this position formally ended June 30, 2004; and WHEREAS, since creation of the position, Dublin Unified School District has contributed $40,000 annually to further assist in supporting the School Resource Officer; and WHEREAS, the City of Dublin and Dublin Unified School District desire to sustain the School Resource Officer position, identify the goals of the position, and clarify the responsibilities of each entity; and WHEREAS, Dublin Unified School District has agreed to continue their $40,000 contribution for Fiscal Year 2005-2006; WHEREAS, the attached Memorandum of Understanding between the City of Dublin and Dublin Unified School District outlines each entities expectations for the School Resource Officer. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin authorizes the City Manager to execute the MOU between Dublin Unified School District and the City of Dublin for the School Resource Officer. AYES: NOES: ABSENT: ABSTAIN: Mayor ATTEST: City Clerk - 1 - ~,2 A;/~7~nt)lv 20J-.' !,.,,\, ('-J MEMORANDUM of UNDERSTANDING between City of Dublin and Dublin Unified School District The City of Dublin (City) and the Dublin Unified School District (DUSD) hereby enter into a partnership agreement for the purpose of maintaining a safe and secure environment for all sch90ls in the DUSD. City and DUSD aim to accomplish this purpose through continuation of one existing School Resource Officer (SRO) position. A. SCHOOL RESOURCE OFFICER GOALS 1. Address crime and disorder problems, gangs, and drug activities affecting, or occurring in or around, an elementary or secondary school; 2. Develop or expand crime prevention efforts for students; 3. Educate likely school-age victims in crime prevention and safety; 4. Develop or expand community justice initiatives for students; 5. Train students in conflict resolution, restorative justice, and crime awareness; 6. Assist in the identification of physical changes in the environment that may reduce crime in or around the school; 7. Assist in developing school policy that addresses crime and recommends procedural changes; and 8. Promote open communication and mutual understanding between officials, staff, students, and parents ofDUSD and City regarding crime intervention/prevention efforts. B. FUNDING To achieve the outlined goals, DUSD agrees to contribute $40,000, in a cooperative effort to sustain one SRO position, for Fiscal Year 2006-2007. City shall deliver to DUSD an invoice requesting said contribution within thirty (30) days. City shall be responsible for reimbursement of SRO personnel costs to Sheriff, pursuant to the terms of the existing "Agreement for Enforcement of State Laws and Local City Ordinances" between City and Alameda County Sheriff's Office. C. DUBLIN UNIFIED SCHOOL DISTRICT RESPONSIBILITIES 1. Continue to provide office space for the SRO at Dublin High School and Wells Middle School. ATTACHMENT 2 3 r-~ I I '-'0 -, 2. Continue to fully participate and cooperate with Cityin all matters related to the duties of the SRO. D. SCHOOL RESOURCE OFFICER SELECTION PROCESS In the event a change in existing personnel is necessary, DUSD shall provide input to the City on the selection of a School Resource Officer. This input shall come from the Superintendent of Schools, or hislher designee, the principal of Dublin High School, and the principal of Wells Middle School; however, the final selection shall reside with the Sheriff of Alameda County. E. SCHOOL RESOURCE OFFICER RESPONSIBILITIES 1. The SRO's function is to respond to the law enforcement needs of all DUSD schools, in conjunction with the needs of the City. However, primary law enforcement emphasis shall be given to Dublin High School and Wells Middle School. 2. The SRO position will be supervised and under direction of the Sheriff of Alameda County. The Assistant Superintendent of the DUSD, and school administrators within the DUSD, shall additionally provide input and direction. 3. The SRO will coordinate an anti-truancy prograrnwith the DUSD and business community. 4. The SRO will participate in School Attendance Review Board Hearings. 5. The SRO will conduct classroom presentations to educate staff and students about the criminal justice system and substance abuse. 6. The SRO shall work a full-time schedule of 40 hours per week. The starting and ending work hour of the day shall be detemlined by the needs of both DUSD and City. 7. In accordance with the personnel policies of the Sheriff of Alameda County, it will be the responsibility of the SRO to advise the Crime Prevention Sergeant as soon as possible when it has been determined that he or she will be unavailable for duty. The Crime Prevention Sergeant, or in hislher absence, the Administrative Lieutenant, shall then notify DUSD. 8. The SRO may be required to attend state mandated schools and courses, or be off due to vacation, compensatory time, sick leave, etc., during the school year, in which case the Crime Prevention Sergeant will notify DUSD as soon as possible. The Sheriff reserves the right to reassign the SRO to regular patrol or other duties within the police department on an intermittent, temporary basis, such as to cover for another officer, respond to a medical call, or provide back-up. 9. During the summer and school breaks, the SRO shall: If cC) ~ a. Work with school staff to prepare for the next school year; b. Participate in on-going activities in conjunction with the DUSD, the City of Dublin, Parks and Community Services Department, and community organizations (e.g. PAL). F. INDEMNIFICATION DUSD agrees to defend, indemnify and hold harmless the City of Dublin and their officials, representatives, agents, officers and employees from and against' any claim or 'liability arising out of the performance of this Memorandum of Understanding due to any wrongful or negligent conduct of the DUSD, its Board of Trustees, agents, officers and/or employees. The City of Dublin agrees to defend, indenmify and hold harmless the DUSD and their representatives, agents, officers, and employees from and against any claim of liability arising out of the performance of this Memorandum of Understanding due to any wrongful or negligent conduct of the City of Dublin, its agents, officers and/or employees. The parties hereto understand and agree that at all times during the term of this Memorandum of Understanding (MOU) the SRO shall be an employee of the Sheriff of Alameda County and not an employee of the DUSD or City. As a consequence, neither City nor DUSD shall be responsible for any direct payment to the BRO of salary, wage benefits, worker's compensation, or any other form of compensation. The foregoing shall not, however, limit the obligation of the City and DUSD to fund the SRO position, as provided for in section (B), and to pay Sheriff for the SRO's services when invoiced. G. TERMINATION Either party may terminate this agreement with thirty (30) days written notice. City shall refund DUSD a pro-rata amount of the $40,000, based on days served. /j . ~.IJ'1 '.' .' .
