halance of $118, 583 will remain as a fUnd for future pole replacement.
The proposed assessment of $16.84 per sinl!le-familv home. is the same as the
Fiscal Year 2005-06 Assessment.
DESCRIPTION: This assessment distncl funds energy and maintcnance costs for the
City's street lighting system. excepl for the lighting installcd in Dublin Ranch and Tract 7067, which is
I"unded through the Duhlin Ranch Strcct Lighting Maintenance Assessmenl Distnct. Tn 1983, thc City
Council formcd a Citywide Street Lighting Assessment Dlslncl 10 replace the County of Alameda
Lighting Service Area. On August 13, 1984, the City Council approved the annual Enginccr's Rcport and
ordered levy of assessments for the first hme. Tn 1995-1996, the City of Dublin and other agencies in
Alameda County took possession ofPG&E-owncd strcct lights in order to reduce maintenance cosls_ The
1996-1997 asscssments were reduced from the 1995-1996 level of$19.34 by 30%.
For 2002-2003, the assessment was increased from $13.26 to $16.84 in order to fund increased utility
costs and the first two years of a phased four-year Capital Improvement Project 10 replace detcriorated
poles in oldcr subdivisions. The first and second years of the project were funded by this Strcct Light
Maintenance Assessment District. While the thIrd year of the pole replaccmcnt projcct was funded
entirely by the General Fund, $75,000 of the cost of the fourth and final year of the pole replacemenl
project was also I"unded hy Asscssmcnt District 83-1 The balance of the fourth phase cost was paid I"rom
thc General Fund. This pole replacement project is now complete.
A reserve of approximately $118,583 is projected to remain at thc cnd of Fiscal Year 2006-2007 ThIS
reserve is commensurate with thc amount allowed by State Law, which penmts a reserve of up to 50% of
the operating cost for the District. It is recommended lhal this type of rescrvc bc rctained for potential
unplanned expenditures such as major repaIrs and/or for replaccmcnt of poles in future years.
Staff rccommcnds that thc City Council conduct a public heanng, deliberate, and adopt thc rcsolution
approving Engineer's Reporl, confirming diagram and asscssmcnt, and ordering levy of assessment.

4PPROVTNG ENGINEER'S REPORT, CONFIRMING DIAGRAM
AND ASSESSMENT, AND ORDERING LEVY OF ASSESSMENT
CITY OF DUBLIN STREET UGHTlNG MAINTENANCE ASSESSMENT DISTRICT 83-1
WHEREAS, hy its Resolution No. 044-06, a Resolution Dirccting Preparation of Annual Report for
City of Duhlin Street Lighting Maintenan~e Assessment District No. 83-1 (the "District"), this Council
designated the Puhli~ Works Director as Engineer of Work and ordcrcd said Engineer to make and file a
report in writing in a~~ordan~e with and pursuant to the Landscaping and Lighting Act of 1972; and
WHER~;AS, said report was made and filed with the City Clerk and duly considcrcd by this Council
and filUnd to he sufficient in every particular, whereupon it was dctcrmincd that said report should stand as
Engineer's Report for all suhsequent proceedmgs undcr and pursuant to the aforesaid Resolution and that July
18, 2006, at 7:00 p.m. in thc Council Chambcrs, Dublin Civic Center. 100 Civic Plaza, Dublin, California,
was appointcd as the timc and place for a hearing by the Council on the question of the levy of the proposed
assessment, notice of which hearing was published and posted in accordance with the Landscaping and
Lighting Act of 1972, and
WHEREAS, at the appointed time and place, said hcaring was held, and all persons interested
desiring to be heard were given an opportunity to b~ hcard, and all matters pertaining to said levy were heard
and considcrcd by this Council, and this Council thereby acquired jurisdiction to order said levy and
confirmation of diagram and assessment prepared by and made a part of the report of said engineer to pay the
cost and expenses thereof;
NOW. THEREFORE. BE IT RESOLVED that the City Council of the City of Dublin does herehy
approvc that:
(a) Thc prop~rty owners owning more than tlfty percent of the area of assessable land within the
District had not, at the conclusion of said hearing, filed written protests against the said
proposed levy, or against the Engineer's Estimate of costs and expenses, or against the maps
and description, or against the diagram or the assessment to pay for the costs and expenscs
thereof;
(b) The public interest, convenien~e, and necessity requirc that said levy be made;
(c) The DIstrict benefitcd by said improvements and to be asscssed to pay the costs and expenses
thcrcof; and the cxtcrior boundarics thcrcof arc as shown by a map thereof filed in the office of
the City Clcrk, which map is made a part hereof by reterence thereto
PASSED, APPROVED AND ADOI'TED this 18th day of July, 2006.

1 ENGINEER'S LETTER
WHEREAS, on April 18, 2006, the City Council of the City of Dublin, California,
pursuant to the provisions of the Landscaping and Lighting Act of 1972, adopted its Resolution
Directing Preparation of Annual Report for Maintenance Assessment District 1983-1 for the
acquisition and maintenance of improvements more particularly therein described; and
WHEREAS. said Resolution directed the undersigned to prepare and file a report
pursuant to Section 22565, et. seq., of said Act;
NOW, THEREFORE, the undersigned. by virtue of the power vested in me under
said Act and the order of the Council of said City, hereby make the following assessment to
cover the portion of the estimated cost of acquisition of and maintenance of said improvements
and the cost and expenses incidental thereto, to be paid by said District.

As required by said Act, a diagram is hereto attached showing the exterior boundaries of said
street light maintenance assessment district and also the lines and dimensions of each lot or
parcel of land within said landscaping maintenance assessment district as the same existed as of
January 1, 2006, each of which lots or parcels having been given a separate number upon said
diagram.
I do hereby assess the net amount to be assessed upon all assessable lots or parcels of
land within said street light maintenance assessment district by apportioning that amount
among the several lots or parcels in proportion to the estimated benefits to be received by each
such lot or parcel from the acquisition and maintenance of said improvements, and more
particularly set forth in the list hereto attached and by reference made a part hereof.
Said assessment is made upon the several lots or parcels of land within said street light
maintenance assessment district in proportion to the estimated benefits to be received by said
lots or parcels respectively from the acquisition and maintenance of said improvements. The
diagram and assessment numbers appearing herein are the diagram numbers appearing on said
diagram, to which reference is hereby made for a more particular description of said property
The scope of work includes the cost of energy and maintenance of street lights within
the City of Dublin, excepting street lighting within Street Light Maintenance Assessment
District 99-1 (Dublin Ranch). The scope of work shall also include the cost of purchase or
installation of street lights.
Each lot or parcel ofland assessed is described in the assessment list by reference to its
parcel nmnber as shown on the Assessor's Maps of the County of Alameda for the Fiscal Year
2006-2007 and includes all of such parcels excepting those portions thereof within existing
public roads or rights of way to be acquired in these proceedings for public road purposes. For
a more particular description of said property, reference is hereby made to the deeds and maps
on file and of record in the office of the County Recorder of said County Because the names
of the several owners are unknown to me, I hereby place the word "unknown" opposite the
number of each lot of parcel of land assessed, the amount assessed thereon, and the number of
the assessment.

METHOD OF APPORTIONMENT
The assessments shall be spread using a method of "factor rates" assigned to different land
uses.
The establishment of the apportionment of a factor rate of" 1" will be calculated by dividing the
total assessment of the year by the sum off actor rate numbers assigned wherein the factor rates
are assigned as follows:
