HomeMy WebLinkAboutPC Reso06-43 NegDeclr for Venture CommerceCtr PA06-020 RESOLUTION NO. 06 - 43 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING A NEGATIVE DECLARATION FOR THE VENTURE COMMERCE CENTER LOCATED AT 6300 CLARK AVENUE (APN 941-1401-003) P A 06-020 WHEREAS, Venture Corporation, has requested approval of: 1) a Site Development Review for the demolition of an existing 38,825 square foot building and the construction of the Venture Commerce Center which will be comprised of four new office buildings with a total of 67,029 square feet of office and warehouse space; and 2) a Vesting Tentative Tract Map to subdivide the property for the purpose of creating office condominium units. The applications are collectively known as the "Project"; and WHEREAS, the Venture Commerce Center property consists of 2:4.19 acres located at 6300 Clark Avenue, (APN 941-1401-003); and WHEREAS, an Initial Study has been prepared to analyze the potential effect of the Project pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15063; and based on the Initial Study, a Negative Declaration has been prepared for the Project in accordance with CEQA Guidelines Section 15070 et seq., with the finding that the Project will not significantly effect the environment; and WHEREAS, the draft Negative Declaration, including the Initial Study, was circulated for public review for twenty days as required by CEQA. The draft Negative Declaration, including the Initial Study, is attached as Exhibit A and incorporated herein by reference; and WHEREAS, the City did not receive any public comments regarding the draft Negative Declaration and Initial Study during the public review period from September 19, 2006 through October 9,2006; and WHEREAS, the Planning Commission did hold a properly noticed public hearing on the Project on October 10, 2006; and WHEREAS, a Staff Report, dated October 10, 2006 was submitted to the Planning Commission analyzing the Project and recommending approval of the Negative Declaration and Site Development Review and Vesting Tentative tract Map applications; and WHEREAS, the Planning Commission considered the Negative Declaration before making a recommendation on the Project. The Planning Commission further used its independent judgment and considered all reports, recommendations and testimony before taking action on the Project. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Dublin does hereby make the following findings and determinations regarding the Negative Declaration: A. The Negative Declaration for the Venture Commerce Center Project has been completed III compliance with CEQA, the CEQA Guidelines and the City of Dublin Environmental Guidelines. I B. On the basis of the whole record before the City, including the Negative Declaration as described above, there is no substantial evidence that the Venture Commerce Center Project will have a significant effect on the environment. C. The Negative Declaration as described above, was presented to the Planning Commission who reviewed and considered the information therein prior to approving the Project. D. The Negative Declaration as described above reflects the City's independent judgment and analysis on the potential for environmental effects of the Venture Commerce Center Project. E. The custodian of the documents and other materials which constitute the record of proceedings for the Venture Commerce Center Project is the City of Dublin Community Development Department, 100 Civic Plaza, Dublin, CA 94568. BE IT FURTHER RESOLVED that the Planning Commission hereby adopts the Negative Declaration and related Initial Study, attached as Exhibit A, for the Venture Commerce Center Project (PA 06-020) pursuant to CEQA Guidelines Section 15070 et seq.
