Thompson, Public Works Director ATTACHMENTS: 1) 2) Resolution Location Map RECOMMENDATION: /1^ p(/I) '-J( \,Fe' 2) Adopt resolution to accept work completed Authorize Staff to accept maintenance bond FINANCIAL STATEMENT: A maintenance bond in the amount of $967,925 to guarantee against defects will be provided to the City. The City will incur future maintenance cost for street sweeping and other public improvement maintenance costs for the portions of Gleason Drive, Arnold Road, and Hacienda Drive that are included under this parcel map. The roadside landscaping maintenance is a part of the Santa Rita Landscape Maintenance Assessment District No. 97-1. . DESCRIPTION: On March 18, 1997, the City Council approved Parcel Map 7042, a portion of the Santa Rita Development Area that is located south of Gleason Drive between Arnold Road and the extension of Hacienda Drive. The OPUS Creekside Business Park is located on this property, and OPUS Southwest has constructed the improvements. At the time that the City and OPUS Southwest Corporation executed the contract for the subdivision improvements, the subdivider was required to provide a performance bond in the amount of $3,871,700 to provide the necessary security for the performance of work involved. As the work is now completed, the performance security requirement can be reduced, in accordance with the authority contained in Government Code Section 66499.7, to an amount necessary to guarantee maintenance of the work for a one-year period following acceptance of the work. Staff recommends that the City Council adopt the resolution accepting improvements and authorize Staff to accept the maintenance bond at a future date. --------------------------------------------------------------- . RESOLUTION NO. - 99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * * * * * * * * * ACCEPTING IMPROVEMENTS CONSTRUCTED IN PARCEL MAP 7042 (PORTION OF SANTA RITA DEVELOPl\iENT AREA) OPUS CREEKSIDE BUSINESS PARK WHEREAS, the owner-subdivider of the aforesaid Parcel Map previously entered into a contract with the City of Dublin to improve said Parcel Map in accordance with the plans and specifications on file with the City Engineer, said Parcel Map identified as follows: Subdivider: Location: OPUS Southwest Corporation Southerly of Gleason Drive, easterly of Arnold Road, and westerly of Hacienda Drive. Parcel Map Size: One commercial parcel Resolution Approving Final Map: 26-97 City Streets Affected: Gleason Drive, Arnold Road, Hacienda Drive (portions) . WHEREAS, said improvements have been completed in accordance with said plans and specifications and any approved modifications thereof, to the satisfaction of the City Engineer of the City of Dublin; and WHEREAS, as a condition of said contract, the subdivider is required to guarantee the improvements and to maintain the completed work for a period of one year following acceptance ofthe work by the said City of Dublin; and WHEREAS, as the improvements are now completed, the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid one year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Parcel Map be, and they are hereby approved and accepted subject to the aforesaid one year guarantee; and 2. The aforesaid original performance bond security requirement be reduced from the amount of $3,871,700 to a revised security requirement in the amount of $967,925 upon acceptance by Staff of the replacement maintenance bond in the said amount of $967,925 as security for the aforesaid one year guarantee period, and the Mayor of this City Council be, and he is hereby authorized and directed to execute said bond on behalf of the City of Dublin; and . ~.TT" r-r ;P;, ~F'~. ~-r.'"
