HomeMy WebLinkAboutPC Reso83-02 Karns Daycare PA83-012 RESOLUTION NO. 83-02 A RESOLUTICN OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN ------------------------------------ APPROVING PA 83-012, KARNS, DAYCARE, 6851 LANGMUIR LANE, A CONDITIONAL USE PERMIT APPLICATION FROM ROBERT AND MARGARET KARNS TO ALLOW THE OPERATION OF A DAY CARE CENTER IN A SINGLE FAMILY RESIDENTIAL DISTRICT WHEREAS, Rotert and Margaret Karns have filed an applictioll for a Conditional Use Permit (PA 83-012) to allow the operation of a day care center for 12 children per session, in an R-l-B-E (Single Family Residential) District, located at 6851 Langmuir Lane, Dublin, Colifornia (APN 941-191-14); and WHEREAS, the Planning commission did hold a public hearing on said application en May 16, 1983; and WHEREAS, proper notice of said public hearing was given in all respects as required ty law; and ~HEREAS, this application has been reviewed in accordance with the provisions of the California Environn,ental Quality Act and tas been found to be categorically exerrpt; and WHEREAS, a Pre-HeDring Staff Analysis was submitted recommending the appl ication be ccndi tionally approved; cr,d WHEREAS, the Planning Corr~ission did hear and consider all said reports, recommendations and testimony as hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: a} population with facilities; The use is required by the public need as the working parents develops need for day care b) The use will be properly related to other land uses and transportation and service facilities in the vicinity as daytime activities will be commensurate with present use of properties in the neighborhood; c} The use, if permitted, under all the circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met; d) The use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located, as a small scale residential care facility, with limited impacts, is consistent with the character of the residential district; BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve said application as shown by materials labelled Exhibit "A", on file with the Dublin Planning Department, subject to the following conditions: 1) Number of children on the premises at anyone time shall not exceed 12; DP 83-20 2) This permit shall terminate and end May 16, 1985. During the effectivetime period, the permit shall be subject to revocation for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance; 3) The requirements of the Alameda County Building Inspection Department and the Dublin San Ramon Services District Fire Department, as per their letters of April 26, and April 27, respectively, shall be complied with except that any change to the appearance of the garage door shall be approved by the Dublin Planning Department. 4) If the garage door is not left operable, due to the proposed remodeling, the applicant shall post a bond, or letter of credit, with the City of Dublin in the amount of $500 (Five Hundred Dollars). This money is to be used to restore the garage door to an operable condition should, at such time as the day care center is no longer in operation, the door not be made operable and the garage space made accessible to at least one (II car. 51 No signs advertising the day care center shall te installed on the subject property. 6) No side yard encroachment into the required 6-foot side yard is permitted. The existing non-conforming roof cover shall be removed. The water heater, washer, dryer, and freezer, proposed to be located in the side yard, shall be located interior to the building. The exising boat, which is now stored in the required front yard shall be stored in a location that complies with the Zoning Ordinance.
