GENERAL INFOR~ffiTION
PROJECT: A request by Growing Tree Preschool for a Conditional
Use Permit to operate a daycare center in Wing C(a) at
the Fallon School Site for approximately 120 children,
ranging in age from 8 weeks through 10 years of age.

APPLICABLE REGULATIONS:
Section 8-26.3 states that a school is a Conditional Use in
an R-l district.
Section 8-94.0 states that conditional uses must be analyzed
to determine: 1) whether or not the use is required by the public
need; 2) whether or not the use will be properly related to other
land uses, transportation and service facilities in the vicinity;
3) whether or not the use will materially affect the health or
safety of persons residing or working in the vicinity; and 4)
whether or not the use will be contrary to the specific intent
clauses or performance standards established for the district in
which it is located.
section 8-94.4 states the approval of a Conditional Use
Permit may be valid only for a specified term, and may be made
contingent upon the acceptance and observance of specified
conditions.
ENVIRONMENTAL REVIEW:
Categorically exempt
NOTIFICATION: Public Notice of the November 19, 1984, hearing
was published in the Tri-Valley Herald, mailed to
adjacent property owners, and posted in public
buildings
ANALYSIS:
The applicant is requesting a Conditional Use Permit to
establish a daycare center in one of the wings at the Fallon
School Site located at 7425 Larkdale Avenue. It is
estimated that there will be approximately 120 children,
ranging in age from 8 weeks through 10 years of age. The
applicant stated in their application that as a service to
local parents they will deliver and pick up school age
children within the Murray School District.
The Planning Commission has previously approved Conditional
Use Permits for Tri-Valley Church of God (120 children),
Kaliedoscope (50 children), and Montessori Preschool (80
children). If this use permit is approved it will bring the
total number of children to 370 (120 + 50 + 80 + 120 = 370).
The Murray School District personnel have informed Staff
that when the school closed in 1983, there was a total of
379 children; Therefore, even with the approval of this use
permit, there will be fewer children then when the school
was in operation.
Parking and loading/unloading will take place in designated
areas on site. Off street parking is limited, but should be
sufficient to accomodate the Staff of the four uses.
It should be noted that the Murray School District will be
responsible for the maintenance of the buildings and
grounds. Concerning the playground activities, there is a
play area located immediately north of the wing which will
be utilized for preschool children. The older children will
have access to the general play area north of the parking
lot.
The City has not received any complaints regarding excessive
traffic or noise stemming from the uses that presently exist
on the site. Staff does not feel that this additional use
will cause traffic or noise problems for the neighborhood.
It is likely that many of the adjacent residents will
utilize the services provided at the Fallon School Site. As
indicated by past applicants, there is a tremendous need for
these types of services.

RECOMMENDATION
FORMAT:

Open public hearing and hear staff
presentation
2) Take testimony from applicant and the public
3) Question staff, applicant and the public
4) Close public hearing and deliberate
5) Adopt Resolution regarding the Conditional Use
Permit
ACTION:
Staff recommends that the Planning Commission adopt the
attached Resolution (Attachment 1) which approves
Growing Tree Preschool's application for Conditional
Use Permit to establish a daycare center in wing C (a)
at the Fallon School Site, 7425 Larkdale Avenue,
Dublin.

APPROVING 84-061 GROWING TREE PRESCHOOL CONDITIONAL USE PERMIT
APPLICATION TO OPERATE A DAYCARE CENTER AT THE FALLON SCHOOL SITE
WHEREAS, Susan Ansel and Faye Brown, representing
Growing Tree Preschool filed an application for a Conditional Use
Permit to operate a daycare center at the Fallon School Site; and
WHEREAS, the Planning Commission did hold a public
hearing on said application on November 19, 1984; and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and
WHEREAS,

WHEREAS, the Staff Report was submitted recommending
that the application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations and testimony as here in above
set forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
a) The use is required by the public need to provide a daycare
center
b) The use will be properly related to other land use and
transportation and service facilities in the vicinity as
daytime activities will be commensurate with present use of
properties in the neighborhood
c) The use, if permitted, under all the circumstances and
conditions of this particular case will not materially affect
adversely the health or safety of persons residing or
working in the vicinity or be materially detrimental to the
public welfare or injurious to property improvements in the
neighborhood as all applicable regulations will be met
d) The use will not be contrary to the specific intent clauses
or performance standards established for the district in
which it is located as a daycare center with limited impact
is consistent with the character of the residential district
e) The daycare center will be consistent with policies of the
General Plan
f) Should the use ultimately be found to be inconsistent with
the Draft General Plan, there is little or no probability
that the use will be detrimental or interfere with the future
General Plan
BE IT FURTHER RESOLVED that the Planning Commission does
hereby conditionally approve said application subject to the
following conditions: Said conditions shall be subject to the
review and approval of the Dublin Planning Department

1) The number of children in the daycare center shall not exceed
120
2) All school activity shall be restricted between the hours
of 7 a.m. and 6:30 p.m.
3) No outside activities may take place before 8 a.m.
4) All signage shall be approved by the Dublin Planning
Department
5) All loading and unloading shall take place on designated
areas on site
6) School noise shall be controlled so as not to create a
nuisance to adjoining residential neighborhood
7) Comply with the requirements of the Dublin/San Ramon
Services District Fire Department
8) The playground area for the small children, including the
fence, shall be upgraded in both appearance and usefulness
9) A comprehensive sign program shall be developed for all
uses on the Fallon School site
10) Evidence shall be submitted that the applicant has acquired
all the appropriate state licenses and permits
11) This approval shall be valid until November 19, 1987 and
shall be revocable for cause in accordance with Section
8-90.3 of the Dublin zoning Ordinance
